Street.
2. Because railroad crossarm hardware may narrow Railroad Avenue at Main and
in order to maintain transit turning radius, either (1) a widened Railroad
Avenue may be required or, (2) a southbound only traffic pattern. A south -
bound Railroad Avenue could avoid R.O.W. acquisition, should the railroad
crossarm hardware close part of the street.
Councilman Naughten questioned whether additional right-of-way would be needed for the
bus stop, and Mr. Sood said that he thinks it is in the present right-of-way. Council-
man Gould asked if the Washington State Ferry projects scheduled between 1979 and 1981
should be included as short-range projects. Mr. Sood stated that he would discuss this
with Ralph White, Deputy General Manager of the Department of Transportation,and report
back. Councilman Gould stated that he feels approval should not be given to those
projects that involve property belonging to citizens until they have an opportunity to
express their thoughts. Mr. Sood agreed and said that they would be given an opportunity
to discuss this when the long-range projects were presented to the Council. COUNCILMAN
MOTION: NAUGHTEN MOVED, SECONDED BY COUNCILWOMAN ALLEN, TO APPROVE THE SHORT-RANGE PROJECTS

HEARING ON SHORELINE MANAGEMENT SUBSTANTIAL DEVELOPMENT PERMIT FOR COMMERCIAL RETAIL,
RESTAURANT, AND OFFICE SPACE AT 138 RAILROAD AVENUE (SM-2-80).
Councilmen Nordquist and Naughten stepped down from the podium during this hearing due
to the Appearance of Fairness Doctrine. Both councilmen have a family member employed
by Pantley's Division.
Planning Division Manager Mary Lou Block informed the Council that application for this
permit was heard by the Planning Commission on September 10. In view of the fact that
the proposal was consistent with the Edmonds Shorelines Master Plan and the Comprehensive
Policy Plan, the Planning Commission approved this permit with the condition of a cove-
nant to allow public access to the berm area during daylight hours. Ms. Block explained
that this site is on the Edmonds waterfront, south of the ferry terminal, and has an
existing two-story manufacturing building on it. Present uses of the building include a
skin diving shop, refrigeration sales, and freight storage. The remodeled structure would
be a a 29,500 sq. ft., three-story, retail/office/restaurant complex. The first floor,
would have retail and service shops, mixed with covered parking; the second floor would
have offices and a rooftop putting green; and the third floor would have restaurant and
office space. The building will be terraced from the west down to the east in stories.
All required parking will be provided on site (37 office, 23 restaurant, 5 retail) as
well as 11 additional stalls for public use. Zoning in the area is Commercial Water-
front (CW) to the north and south, Community Business (BC) to the east, and Marine
rr Resource (MR) to the west. The site is designated as "Urban Environment" in the Edmonds
Shorelines Master Program. Environmental impacts will not be significant in view of the
fact that site coverage will not be increased, and traffic and storm water will be
handled adequately. Ms. Block then showed slides of the proposed project. (Council-
woman Goetz arrived at this time.) Public portion of the hearing was opened.
Bob Morrison, 250 Beach Place, asked if the bulkhead would remain in place, and Ms.
Block answered that nothing in that area would be changed.
Lem Everett, 403 Third Ave. N., Co -Chairman of the Building Committee for the Senior
Center, discussed the parking situation between the proposed complex and the Senior
Center. This matter will be discussed further by City Staff and the Director of the
Senior Center.
John Munn, 2917 - 220th S.W., explained briefly the purpose for the Shorelines Management
Protection Act.

Bob Pantley, 936 Maple St., developer of the property in question, reiterated his desire
to make the waterfront accessible to as many people as possible. He stated that the
parking stalls in front of the building will be available to the general public during
daylight hours with a possible four-hour limit. Parking along the bulkhead will be
back -in.
Floyd Smith, 814 Dayton St., advised the City Staff not to build steps down from the
bulkhead to the beach, as he feels that they could not withstand a storm.
Lloyd Ostrom 711 Puget Lane, expressed concern over whether parking would be adequate
for the complex. Ms. Block stated that the stalls should accommodate the parking that
is generated by the complex adequately.
Mary Ann Anderson, 711 Olympic Ave., expressed concern over increased traffic. Ms.
Block stated that circulation into and out of this project has been approved by the
Engineering Division. No one else wished to speak on this matter, and the hearing

HEARING ON AMENDMENTS TO PARKING ORDINANCE (RAILROAD AVENUE)
City Engineer Jim Adams explained that in order to promote traffic safety and convenience
for the public, an ordinance has been drawn up to add new sections to the Edmonds City
Code prohibiting parking on the east side of Railroad Avenue from Main to Dayton and
on the west side of Railroad Street from Main to James, and to establish four-hour
parking on the west side of Railroad Avenue from Dayton Street to Main Street.
Councilman Gould expressed concern over where the people who have been using this
parking will move their cars, and Mr. Adams stated that there is ample space in the
City parking lot. The public portion of the hearing was opened.
Bob Morrison, 250 Beach Place, suggested that the four-hour limit be adopted for
daytime hours only, so that residents and visitors could utilize the waterfront for
longer periods of time at night. He feels that most of the parking is now utilized by
ferry commuters, and that they should have to park elsewhere. The public portion of
this hearing was closed.

REPORT ON MEETING BETWEEN ALBERTSONS AND CITIZENS
Mayor Harrison reported that the City Staff had arranged a meeting between Albertsons'
officials and citizens neighboring the new store that is being built. Members from
both groups were present to speak to this matter.
Douglas Mulvanny, Architect for Albertsons, thanked the Council and Staff for coordi-
nating the meeting.
Leona Pace, 9828 - 228th Pl. S.W., expressed her appreciation for the steps Albertsons
has taken to improve the project for neighboring citizens.
Grant Woodfield, 9820 - 228th P1. S.W., also expressed his appreciation to everyone
that was involved in working out the problems neighbors were having with this project.
HEARING TO ESTABLISH SMALL WORKS ROSTER
Public Works Director Fred Herzberg reported that the State Legislature has enacted a
new section to the statutes governing the public works contracts of code cities. This
section allows code cities the size of Edmond's population to use a "small works roster"
in awarding public works contracts estimated at $30,000 or less. This roster must
include all contractors who request that they be listed on such roster and who are
licensed to do work in the State of Washington, if there is such a license required.

2. It is understood that prior to any use of the
easement herein conveyed, the Grantee, if .consistent with
existing city codes, will issue the Grantors an occupancy
permit relating to the construction of the commercial,
office, retail and restaurant building as approved by SM-2-
80, and until the referred -to easement area has been approved
for public use by the City of Edmonds.
3. The Grantee agrees, as a consideration of
this easement, to install wood signs to mark the entrance
and exit of the Grantors' property and the times the easement
area is open to the general public. Grantee may place such
facilities on the subject property which are consistent with
the public use of the easement granted herein, provided said
facilities are approved by Grantors.

4. The Grantee further agrees to hold and save
harmless the Grantors from any and all claims for damages,
whether to persons or property that may in any manner directly
or indirectly arise out of the use of this easement by the
general public, provided that said damage does not result
from the negligence of the Grantors, their agents or employees.
5. The Grantee does further agree that it will
hold harmless the Grantors for any damages caused to the
property set forth in Exhibit A, or the Grantors' property
now or hereafter placed upon said property, or from death or
injury to any persons or to Grantors' employees, in any
manner caused by the installation, operation, repair, main-
tenance or patrolling of the facilities of Grantee placed
upon or within said property, provided said damage and/or
injury are not caused by the negligence of Grantors, their
agents or employees.
6. This easement shall be for a period of twenty
(20) years and thereafter until terminated by the Grantors
upon 180 days' notice in writing to Grantee.
7. As a material part of this agreement and
notwithstanding anything herein to the contrary, the Grantee
specifically agrees to relocate all or any part of this
easement and associated facilities constructed hereunder so
as to avoid and not interfere with any structure or facility
or any operation which the Grantors may hereafter desire to
construct or conduct upon the above -described property,
subject to proper municipal approvals. Grantee shall commence

AMENDED COMMENTS FOR ADB-65-80
The amended ingress/egress design is acceptable to engineering. The
circulation design with the back -in stalls is also acceptable. Further
details are required on the layout beneath the building.
The four parallel parking stalls along the south side of the building
are not acceptable. It is felt that a potentially hazardous congestion
problem could result if an inexperenced driver was attempting to get into
one of these stalls and backed traffic up out onto Railroad Avenue. Also,
we cannot at this time approve the parking concept;on the Senior Citizen
Center property. We suggest a'curb knock out at this point, to be used,
when/if the concept is approved by the proper agencies.

1971Chapter 43.21C, RCW; requires all state and local
governmental agencies to consider environmental values
both for their own actions and when licensing private
