Snohomish Health District, Food & Living Environment 3020 Rucker Avenue, Suite 104 Everett, Washington 98201-3900 GARY HAAKENSON MAYOR RE: Express Water & Nutrition Center @ 119 West Dayton Street, Edmonds, WA Dear Mr. Zahalka: The purpose of this letter is to inform the Snohomish Health District of the nature of business and sales associated with Express Water & Nutrition Center located in Edmonds. The City's involvement in this matter includes the issuance of a remodeling and plumbing permit and City business license. During the permit review process the City required inter- agency approvals to be obtained for this business to operate within our jurisdiction. The business owner was instructed to contact Snohomish Health District for regulations and approval and our Assistant Building Official contacted the State Department of Health and the State Department of Agriculture offices for direction and jurisdiction on this type of business use. As explained by the business owner, Mr. Larry Gormley, to City officials, Express Water pipes City water through a type of filtering system into holding tanks. Customers either purchase a bottle from the proprietor or bring in their own bottles to fill from dispensers piped from the holding tanks. Filtered water can either be bottled by a customer and taken away, or consumed on site. At this time no filtered water is bottled by Mr. Gormley for retail or wholesale sales, nor is filtered water trucked/tanked or transported off site for sales (either retail or wholesale). It is our understanding only City approval is required based on the way the business is structured as described above. However, Mr. Gormley has officially informed the City he intends to truck or transport water (method unknown) off site to vendors/customers in the near future. When specifically asked what inter -agency approvals were required Mr. Gormley's stated if water is sold as retail in any manner or container type —he is exempt from Snohomish Health District, State Department of Health and State Department of Agriculture approval —however, if water is sold wholesale in any manner or container type, the business must receive State Department of Agriculture approval. • Incorporated August 11, 1890 • Sister City - Hekinan, Japan Mr. Zahalka September 14, 2004 Page Two By copy of this letter, all noted agencies are informed about the nature of the subject business use and City understanding at time of occupancy approval. If additional approvals are required by an effected agency please notify the City of what approvals are required. Note, the City has no method to ascertain when Mr. Gormley changes the nature of his current business use.
