As promised you in our meeting, a comprehensive auditing of your
utility account has been made, resulting in the following adjustments:

In the past, you have not paid the entire billing; and as a re-
sult, we allotted an appropriate amount of your remittance to each of the
charges. The adjusted amounts above reflect the exact amount owed for
utility charges and the resultant charges to both water and city tax amounts.
Past correspondence indicates your dispute with payment of the
utility charge. Again, I state, the utility charge is applied to each and
every utility account within the City of Edmonds. Your unconnected rate is
charged as a result of the benefit derived by a better environment, within
a community, served by a sanitary sewage distribution system, a sewage treat-
ment plant, and a storm sewer collection system.
Your conversation seemed to indicate that a dispute arises between
you and the State of Washington (the apparent new owner of the property), as
to who is liable for payment of the billing. We look to you initially for
payment and request that you contact the appropriate purchasing agent from
the State of Washington to settle your personal transaction with them.
The enclosed billing is included and listed as a "final notice".
It is hoped that an early resolution of payment will result to preclude
turn-off of the water.

UTILITY CHARGE -- LEGALITY CONFIRMATION
CITY of EDMONDS
In determining the way the first treatment plant would be financed
and subsequent extensions, additions, or the building of new treatment plants;
the attorney, after receiving advice on this matter from several sources,
determined that the charge as made would be legal. The City of Edmonds re-
ceived confirmation from the Attorney General that the utility charge is not
a part of the city's bonded indebtedness and also the confirmation of its
legality.
According to the City of Edmonds Code; "6.20.030 Utility charges.
A. GENERALLY. The utility charges hereinafter set forth shall be added to
and made a part of monthly rates for water supplied through the meters as
hereinbefore set forth....."
