Re: Driveway access

Dear Jim:
I am in receipt of your correspondence dated July 19,
1982 with reference to the above matter. It appears that
a variance was granted in 1966 to subdivide property con-
sisting of the above address together with an adjoining lot.
The subdivision was granted on the condition that access
would not be on to 196th. Last year the current owners of
the above property granted the State Department of Trans-
portation certain property in exchange for a curb cut along
196th. The City did not know of this agreement and did
not consent to it. Your suggestion of filling in the driveway
would definitely solve the problem, but could place the City
in a position between the property owners, who gave up some
property in exchange for the curb cut, and the Washington
State Department of Transportation, who presumably did not
know of the variance condition.
In order to solve the problem, without involving the City
between the two parties, I would suggest that the City
notify the present properfy' owner of the requirements of
-th-e"variance'and explain to him that the City will not issue
any more building permits for the property if access is
going �to� be out on „196th. FaLjt eer, the City could elect to
preyent..ac,c.ess onto 196th if the curb cut was utilized. The
only alternative for the property owner would be to obtain another
variance without the condition of no access on 196th. The
letter should then suggest that with the property owners
approval, the City would take the necessary steps to fill
in the curb cut. If the property owner does not agree to
the fill in, then I would suggest some means of flagging

the property so that the Building Department does not issue
any further permits without the express condition that access
be some other way than onto 196th.

SUBJECT: DRIVEWAY ACCESS 9509 - 196TH ST. S.W.
The contractor, Bass Construction, at the direction of the
Washington State Department of Transportation, built a driveway
apron at the above location. Mr. Thomas J. Hohmann, the pre-
vious owner of 9509 - 196th St. S..W., granted to W.S.D.O.T. the
right to construct the driveway.
Mrs.Wayne Hutton complained about the driveway, indicating
that there i.s a question of whether the W.S.D.O.T. obtained the
right to construct the driveway. They feel the driveway is a
violation of Variance V-251 granted by the Board of Adjustment on
July 26, 1966.
The Planning Department and Engineering Department opposed
the driveway access to 196th St. S.W.
We plan to direct the Public Works Department to fill the
driveway approach if we don't receive a reply from your office by
August 16, 1982.

V-248, David W. Crow - Variance from 60' width to 55' width of lot at 348 Sunset (RS-6 zone)
Affidavit of Poster and Publication presented'+• The application was reviewed, and it was ,
noted that this was an old existing lot. There was no response from the audience. The
lot contains more than enough square footage for the zone. It was moved by Mr. Luschen,
seconded by Mr. Scott, that the variance requested by David W. Crow, File No'. V-248, be -
approved.' Motion carried.
r. C. Collier - Variance to join two non -conforming buildings at 7833 - 196th S.W.
(RML and RS-8 zone) -
Affidavits of publication and poster presented. A letter had been received from the
Edmonds Planning Commission recommending approval of the variance because of a hardship
and problem not of their own making. The report of Mr. Gilchrest, the professional planner,
offered no objection provided applicant understood that the variance is in violation.of
the intent of the ordinance, and no further variance for expansion of this
business should be granted. The application was reviewed, and it was noted that there was
2400 sq. ft. involved. Mr. Blackbourn said he imagined such expansion would not alleviate
the problem permanently. It was emphasized to the applicant that granting of a variance
at this time would not change the non -conforming status of the use. Mr. Murphy said if
the variance were granted, the construction contemplated could be built, assuring at least
twelve years in the building at a minimum. In the meantime, if it should be rezoned to
Industrial use, then further expansion would be legal. The two owners of Evergreen
Industries were present. Motion was made by Mr. Scott, seconded by Mr. Luschen, to grant
the variance as applied for in File No. V-250. Motion carried.

The regular meeting of the Edmonds Board of Adjustment was called to order at 7:30 P.M.
by Chairman Blackbourn.

,It was moved by Mr. Scott, seconded by Mr. Luschen, that the minutes of the previous
meeting be approved as mailed and posted. Motion carried.
HEARINGS
Variances:
V-248, David W. Crow - Variance from 60' width to 55' width of lot at 348 Sunset (RS-6 zone)

Affidavit of Poster and Publication presented',. The application was reviewed, and it was
j noted that this was an old existing lot. There was no response from the audience. The
lot contains more than enough square footage for the zone. It was moved by Mr. Luschen,
seconded by Mr. Scott, that the variance requested by David W. Crow, File No V-248, be
approved. Motion carried.
1-250, E. C. Collier - Variance to join two non -conforming buildings at 7833 - 196th P.W.
( RML and RS- 6 zone)
Affidavits of publication acid poster presented. A letter had been received from the
Edmonds Planning Commission recommending; approval of the variance because of a hardship
and problem not of their own making. The report of Mr. Gilchrest, the professional planner,
offered no objection provided applicant understood that the variance is in violation.of
the intent of the'ordinance, and no further variance for expansion of this
business should be granted. The application was reviewed, and it was noted that there was
2400 sq. ft. involved. Mr. Blackbourn said he imagined such expansion would not alleviate
the problem permanently. It was emphasized to the applicant that granting of a variance
at this time would not change the non -conforming status of the use. Mr. Murphy said if
the variance were granted, the construction contemplated could be built, assuring at least
twelve years in the building at a minimum. In the meantime, if it should be rezoned to
Industrial use, then further expansion would be legal. The two owners of Evergreen
Industries were present. Motion was made by Mr. Scott, seconded by Mr. Luschen, to grant
the variance as applied for in File No. V-250. Motion carried.
V-251, Wayne E. Hutton_ - Variance to subdivide with westerly lot 70' wide instead of 80!
1 at 9509 - 196th S. W. (RS-12 zone)
/ ••Affidavits of. publication.and.poster were presented. The applicants were present. The
lot layout was reviewed, and it was noted by',Mr. Slabaugh that ther.e,was no extra traffic
t¢�e created on 196th because i,ress and egress were su posed to be from Excelsior Way:
'He"added that this is a topographical ivision. There was a recommendation from the
Planning Commission to grant the variance on the basis of topography. It was then move
by Mr,.,Luschen, seconded -by Mr. Scott, that the variance requested in File.No. V-251 be
granted. Motion carried:
V-25 , Ernest Peter & Margaret Amorin - Variance from minimum square footage and width
requirements in 3-lot subdivision at 1507 Fir St. (RS-8 zone)

that no decision on a subdivision had been reached by the Planning Commission and, there:...
hearing on a variance would have to be continued until such time as there is a sketch to ;..{
work with. 'Mrs. Amorin wanted a variance granted' with the details of a subdivision to'be.
worked out later, but Mr. Blackbourn explained that a variance can be granted only for'a,:
specific request with all details set forth. It was moved by Mr. Scott, seconded by:=
Mr. Luschen, that hearing on File No. V-252 be continued to the meeting of August 23,�1466.
