I. INTRODUCTION
The applicant has applied for a noise variance (Attachment 1) due to an emergency project that
will require replacement of (2) critical circuit feeder cables that feed the downtown Edmonds area
(Edmonds Switching Station). Old conduits have collapsed and are unusable. The switching
station is located at 335 3' Ave S and the work proposed will take place along 3' Ave S and
Walnut Street, as well as within the alley adjacent to the switching station. The off -site work
proposed at this location has been approved under a separate right-of-way construction permit.
Work will take place during daytime hours, but also on weekends and through extended hours
into the evening on an as needed basis. The applicant prefers to complete work during daytime
hours. A variance is required for work that falls outside normal construction hours, which would
otherwise be limited to M-F 7am-6pm and on Saturdays 10am-6pm.
The following is staff s analysis and decision on the proposal.
II. FINDINGS AND CONCLUSIONS
A. GENERAL INFORMATION
1. Request: The applicant is requesting a noise variance for work proposed as part of an
emergency repair project at their Edmonds Switching Station.
2. Review Process: A noise variance is a Type I decision pursuant to ECDC 20.01.003. The
director or his/her designee reviews the project and issues an administrative decision
pursuant to ECDC 20.75.050.C.

B. PUBLIC CONVENIENCE —Will the work result insignificant delays for transportation,
services, or other customer needs if done only during the day and within the hour restrictions
set out in other parts ofECC Chapter 5.30?
The emergency work being performed will include construction during typical daytime hours
as well as into the weekends and evenings. The noise variance will allow critical work to be
continue until critical infrastructure is restored.
C. PUBLIC SAFETY —Does working at night sign f cantly improve safety conditions for the
traveling public and/or construction workers?
Completing the emergency work within a timely manner will improve public safety by
allowing power to be maintained to Edmonds customers. Daytime work is preferred by the
applicant.
D. PUBLIC EXPOSURE — What will be the setting for any proposed work outside of regular
hours? Is it located on an arterial street or in a mostly residential area?
The proposed work is located in a residential area, both on private property and in the public
right-of-way. PUD has coordinated with residents in the West Wind Condos as their parking
will be impacted.
E. PUBLIC COSTS —Does a limited amount of authorized work outside of regular hours
established by this chapter save the public significant cost compared to daytime work?
A failure at the switching station could place thousands of Edmonds residents without power.
F. NOISE REDUCTION MEASURES —Have all reasonable steps been taken to reduce the
impact of any necessary noise outside the standard hours?
The applicant prefers daytime work and will continue work into the evenings on an as needed
basis.
III. DECISION
Based on the Findings of Fact and Conclusions, the following decision is issued by the City of
Edmonds Development Services Department. The noise variance, is APPROVED with the
following conditions:
1. The noise variance is granted for work approved with Right -of -Way Permit #ENG2020-0499.
PUD estimates completion of work within 1-week.
2. Construction activity and associated traffic control shall be performed consistent with
separately approved right-of-way construction permit.

3. The grant of a variance shall not relieve any person from the requirements of ECC 5.30.130
relating to public disturbance noises.
IV. APPEALS
Type I permit decisions may be appealed by a party of record to Snohomish County superior
court within 21 days of the date of the decision pursuant to ECDC 20.07.006.

the evening will only be as needed. Daytime work is preferred.
