INTRODUCTION The applicant is proposing a lot line adjustment that will rearrange boundaries of two existing lots (Attachments 1 — 2). The subject site is located at 8025 — 192"d Street SW and the two lots are located in the RS-10 zone (Single-family Residential; 10,000 square feet minimum lot size). The following is staff's analysis and decision on the proposal. II. FINDINGS AND CONCLUSIONS A. GENERAL INFORMATION 1. Request: The applicant is proposing a lot line adjustment that will rearrange boundaries of two existing lots. 2. Review Process: A lot line adjustment is a Type I decision pursuant to ECDC 20.01.003. The director or his/her designee reviews the project and issues an administrative decision pursuant to ECDC 20.75.050.C. 3. Owners: Robert Bruce Wallace III 4. Tax Parcel Numbers: 00481600600800 5. Location: The project site is located at 8025 192"d Street SW. (Attachment 4). 6. Zoning: The subject site is located in the RS-10 zone (Single-family Residential; 10,000 minimum lot size). 7. Acreage / Square Footage: The lot line adjustment will alter the boundary of two existing lots together containing approximately 32,970 square feet. The new lots will contain the following square footage: PLN2020-0027 — Wallace Lot Line Adjustment Page 1 of 5 Parcel A — 20,623 square feet Parcel B—12,347 square feet 8. Existing Use: There is one single family residence on the property and several out buildings. 9. Proposed Use: There is no proposed change to the existing use. 10. Shoreline Management: None of the subject parcels are located within shoreline jurisdiction. Therefore, the proposal is not subject to Shorelines of the State regulations. 11. Access: The new Parcel B while continue to take access from 192nd Street SW. While there is currently no development application for Parcel A, access to Parcel A could be taken from either 192nd Street SW or 81" Avenue W. 12. Dedications: No dedication of land is required by the City Engineer with the proposed lot line adjustment. 13. Improvements: No improvements are required by the City Engineer with the proposed lot line adjustment. B. SEPA THRESHOLD DETERMINATION Review under the State Environmental Policy Act (SEPA) is not required for lot line adjustments pursuant to WAC 197-11-800(6)(f). C. NEIGHBORHOOD CHARACTERISTICS The project site is located within the Sewview Neighborhood (Attachment 4). The site is located just south of Sierra Park with is zoned Public. There is residential development on the east and west sides of the property which are also located in the RS-10 zone. Properties to the south are zoned RS-8 and developed with single family residences. D. COMPREHENSIVE PLAN The subject property contains three Comprehensive Plan designation for this site is Single Family Urban 3. There is no proposed change to the existing designation. The current proposal meets the intent of the Comprehensive Plan. E. ENVIRONMENTAL ASSESSMENT A critical area determination on the property conducted under file number CRA2017-0133 identified a wetland on the subject property. According to a wetland report submitted with a different application on the subject property, the wetland is a Category III wetland which has a minimum buffer of 60 feet pursuant to ECDC 23.50.040.F. The existing residence on the property is located within the wetland buffer and building setback. The proposed lot line adjustment does not change the nonconforming aspect of the existing residence. Pursuant ECDC 23.40.270.13, sites with field -verified presence of critical areas and/or critical area buffers for which a permit application is submitted shall as a condition of permit issuance, record a notice of the existence of the critical area and/or critical area buffer against the property with the Snohomish County Auditor's Office. A condition of approval has been PLN2020-0027 — Wallace Lot Line Adjustment Page 2 of 5 added requiring the critical area notice to be recorded on the subject property prior to recording the lot line adjustment. Any subsequent development on the property will be subject to the critical area regulations in place at the time a complete application is submitted. F. TECHNICAL COMMITTEE The application materials were reviewed by the City's Engineering Division. The Engineering Division found the proposal to be consistent with Title 18 Edmonds Community Development Code and Engineering Standards (Attachment 5). Compliance with Engineering codes and construction standards will be reviewed with any future building permit application, if any, for development of the site. G. LOT LINE ADJUSTMENT COMPLIANCE (ECDC 20.75.050) ECDC 20.75.050.0 states that the lot line adjustment shall be approved unless the proposed adjustment will: 1. Create a new lot, tract, parcel, site, or division; The existing tax parcel consists of Tracts 8 and 9 of the Oscar E. Jensens' Seattle Suburban Tracts which was recorded in 1911 (Attachment 3). Since the proposed lot line adjustment will result in two lots, the proposed lot line adjustment will not result in a new lot, tract, parcel, site or division. Therefore, this criterion is met. 2. Reduce the setbacks of existing structures below the minimum required by code or make existing nonconforming setbacks of existing structures more nonconforming than before; The subject properties are located in the RS-10 zone. Setbacks for the RS-8 zone are contained in ECDC 16.20.030 and are as follows: Minimum Street Minimum Side Minimum Rear Zone Setback Setback Setback RS-10 25' 10, 20' There is an existing single family residence the will be located on the new Parcel B and a number of accessory structures that will be located on the new Parcel A. The existing residence is nonconforming with regard to the street setback being located approximately 23 feet from the street lot line, but the lot line adjustment will not make this setback more nonconforming. The residence will be compliant with all other setbacks following the lot line adjustment. One of the accessory structure s would straddle the lot line between Parcel A and Parcel B. The lot line adjustment in Attachment 2 notes this structure will be removed. A condition of approval has been added that this structure must be removed before the lot line adjustment is recorded. The accessory structure closest to the northern property line is nonconforming with regards to side setbacks being approximately 7 feet from the northern property line, however the lot line adjustment will not make this setback more nonconforming. The remaining accessory structures on the new Parcel A are compliant with the RS-10 setbacks. As conditioned, this criterion is met. PLN2020-0027 — Wallace Lot Line Adjustment Page 3 of 5 3. Reduce the lot width or lot size below the minimum required for the applicable zone, Pursuant to ECDC 16.20.030, the minimum lot width in the RS-10 zone is 75 feet and the minimum lot size is 10,000 square feet. The new Parcel A contains 20,623 square feet and is more than 75 feet in width. The new Parcel B contains 12,347 square feet and is more than 75 feet in width. Therefore, this criterion is met. 4. Transform a nonbuildable lot, tract, parcel, site or division into a buildable lot, tract, parcel, site or division; The proposed lot line adjustment would not transform a nonbuildable lot, tract, parcel site or division into a buildable lot, tract, parcel, site or division. Therefore, this criterion is met. 5. Would otherwise result in a lot which is in violation of any requirement of the ECDC. The proposed lot line adjustment does not result in creating a lot which is in violation of any requirement of the Edmonds Community Development Code. Therefore, this criterion is met. III. DECISION Based on the Findings of Fact, Conclusions, and Attachments to this report, the following decision is issued by the City of Edmonds Planning Division. The lot line adjustment, as proposed in Attachment 2, is APPROVED with the following conditions: 1. A demolition permit must be submitted and the accessory located on the lot boundary between the future Parcels A and B must be removed prior to recording on the lot line adjustment. 2. In accordance with ECDC 23.40.270.13, a critical area notice on title must be recording against the subject property prior to recording the lot line adjustment. 3. Prior to submitting documents to the Planning Division for "Final Review," please make the following changes: a. Ensure that all references to the City's lot line adjustment reference the file number as PLN2020-0027. b. It is the applicant's responsibility to ensure that all documents to be recorded meet the Snohomish County Auditor's requirements for recording. These requirements include, but are not limited to, minimum margin requirements, provision of a County Treasurer tax statement, and all signatures original and in black ink. 4. After the above changes have been made, submit revised documents to the Planning Division for "Final Review." 5. Once "Final Approval" has been issued from the City, the applicant shall take the documents to the Snohomish County Auditor's Office for recording. 6. After recording the lot line adjustment, the applicant must provide the City of Edmonds Planning Division with TWO (2) copies of the recorded map (with the recording number shown). The County may not consider the lot line adjustment to have been completed until this is done. IV. APPEALS Type I permit decisions may be appealed by a party of record to Snohomish County superior court within 21 days of the date of the decision pursuant to ECDC 20.06.150. V. NOTICE TO THE COUNTY ASSESSOR The property owner may, as a result of the decision rendered by the staff, request a change in the valuation of the property by the Snohomish County Assessor's Office.
