A. Property Owner Applicant Del Mar Condominiums 210-3 d Avenue South Edmonds, WA 98020 B. Project Description Patricia Sterling 210-3 d Avenue South Apt. D Edmonds, WA 98020 The applicant is proposing to remove one cedar tree at the Del Mar Condominium property located at 210 — 3rd Avenue South (Attachments 1 - 2). The tree has outgrown its location and is grown into the condominium building (Attachment 2). The applicant has proposed to replace the tree with an Italian cypress tree (Attachment 2). C. Findings and Conclusions 1. The West Isles Condominium site is located at 210 — 3rd Avenue South and is zoned RM-1.5 (Multi -Family Residential). The parcels adjacent to the north are zoned RM- 1.5 and BD4 (Downtown Mixed Residential) and developed with residential buildings. The site to the west is zoned P (Public) and contains a City Building primarily used for storage and offices for the Driftwood Players theater group. The Page 1 of 4 File No. PLN2020-0042 Administrative Design Review Del Mar Condominiums Landscape Modification property to the east across V Avenue south are zoned RM-1.5 and BD2 (Downtown Mixed Commercial) developed with residential buildings (Attachment 5). 2. The Del Mar Condominiums were constructed in 1975 and a landscape plan from the time of construction was located in the City of Edmonds files (Attachment 3). While the current landscaping at the site does not match the 1975 landscape plan, the property is w 3. The location of the cedar tree proposed for removal is identified on the landscape plan in Attachment 3. The tree is located of the northwest corner of the Del Mar Condominium building and is growing into the building and its roots are growing under the fence onto the adjacent property to the north (Attachments 2 and 4). 4. The area were the tree is located is between the Del Mar Condominiums and the residential properties to the north. ECDC 20.13 requires Type III landscaping along this property line, which pursuant to ECDC 20.13.030.0 requires: C. Type 111 Landscaping. Type Ill landscaping is intended to provide visual separation of uses from streets, and visual separation of compatible uses so as to soften the appearance of streets, parking areas and building elevations. 1. Evergreen and deciduous trees, with no more than 50 percent being deciduous, a minimum of six feet in height, and planted at intervals no greater than 30 feet on center; and 2. If planted to buffer a building elevation, shrubs, a minimum of three and one- half feet in height, and living ground cover planted so that the ground will be covered within three years, or 3. If planted to buffer a parking area, access, or site development other than a building, any of the following alternatives may be used unless otherwise noted: a. Shrubs, a minimum of three and one-half feet in height, and living ground cover must be planted so that the ground will be covered within three years. b. Earth -mounding, an average of three and one-half feet in height, planted with shrubs or living ground cover so that the ground will be covered within three years. This alternative may not be used in a downtown or waterfront area. c. A combination of earth mounding, opaque fences and shrubs to produce a visual barrier at least three and one-half feet in height. 5. While the property is well landscaped, the existing landscaping along the northern property line is not consistent with the Type III landscaping requirements. Ease and west of the Del Mar Condominium building, the landscaping provides effective screen consistent with the Type III landscaping requirement , but there is no landscaping directly between the building on the property line. 6. In order to at least maintain the currently level of landscaping, the cedar tree that is proposed for remove must be replaced. The applicant has proposed an Italian cypress as a replacement tree. Italian cypress trees are fairly skinny trees that should case the same problem that the existing cedar has. Technical Review The Engineering Division reviewed the application and found the proposal to be consistent with Title 18 Edmonds Community Development Code and Engineering standards and requested conditions of approval which have been added to the decision (Attachment 6). E. Decision Based on the findings, conclusions, and attachments to this report, staff finds that the design review for file number PLN2020-0042 is APPROVED with the following conditions: 1. This approval is valid only for the removal of the one cedar tree noted in the application. Removal of any other trees requires separate approval. 2. The tree must be replaced with another tree. A species different than the Italian cypress noted in the application must be approved by the City of Edmonds. In accordance with ECDC 20.13.015.13, evergreen trees must be a minimum of six feet in height at time of planting. 3. The replacement tree should be planted in the vicinity of the removed cedar tree where there is sufficient growing space. 4. Call for a final inspection from the Planning Division once the replacement has been planted. 5. Trees shall be fell onto private property. 6. Vehicles and equipment shall be located on private property. Should it be necessary to utilize any portion of the City right-of-way, including the street or sidewalk, to perform any of this work then the contractor shall apply for and obtain a right-of- way construction permit in advance of starting work. A traffic control plan will be required as part of the right-of-way permit application. 7. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 8. Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk or other public improvements in City right-of-way per City standards that is caused by or occurs during the permitted project. 9. Contractor/owner is responsible for locating all on -site utilities and any utilities on neighboring properties that could be impacted by the tree removal. This tree is way too large to be growing in such a small area. We have had to trim it because it brushes our building and most of the large limbs hang over into the neighbor's yard and are almost touching his building. The tree trunk is only two feet away from the neighbor's fence. This tree was planted right on a small rockery and roots can be seen growing under the fence into our neighbor's yard. This tree is at least a nuisance and will probably become a hazard as it grows even larger. The roots concern me as I have had cedar roots damage my foundation in my last house and that cedar was about 15-20 feet from the foundation.. We would consider putting in another tree if required and we are thinking of an Italian Cypress. That area is pretty root bound but a Cypress would look very nice there. At this time we have someone coming to take out the tree on Sept. 11 th so if this is ongoing to be allowed or if we will not know by then please let me know so that I can cancel or reschedule with Chandler's Tree Service. I'm sure it makes a big mess in your yard and the trunk is only two feet from your fence and growing out of a rockery. The tree is far too large for this area and it is only going to keep growing. We would like to remove it before it becomes more of a problem for you and for us. I have all the paperwork from the city and thought if you could back us on this we could expedite getting the tree out sooner rather than later. We really appreciate the tree you took out that was brushing our building so maybe we can return the favor. It was really a beautiful tree and my granddaughter was sad to see it cut down but it was the right thing to do. A short note from you (an email would be fine) saying you would also like it removed would certainly help us out. Compliance with Engineering codes and construction standards will be reviewed with any future building permit application, if any, for development on the site. 1) Trees shall be fell onto private property. 2) Vehicles and equipment shall be located on private property.
