All such uses are unrestricted in location within the right-of-way and shall not be limited in any way whatsoever by the state of being, condition or location of the street. The Grantee shall have the right to utilize such additional width as may be necessary temporarily for the placing of excavated materials thereon and for initial construction and maintenance operations (hereinafter "Temporary Easement"). The Grantee shall provide the Grantors with reasonable written notice, not less than three (3) days prior to any planned entry, of the purpose and duration of the Temporary Easement and shall restore the disturbed property to equal or better condition. The Grantee shall indemnify and hold harmless Grantors from and against all claims, demands, suits, costs, expenses, liabilities, fines, penalties, losses, damages and injury to person, property or otherwise, including, without limitation, direct, indirect and consequential damages, court costs and reasonable attorney's fees, arising from or in any respect related to any exercise of this right or use of a Temporary Easement by the City, and their guests and invitees and the public, except those arising from any of the Grantors' acts, omissions or negligence. The easement hereby granted is located in the COUNTY OF SNOHOMISH, STATE OF WASHINGTON, and is more particularly described as the following property: SEE ATTACHED legal description (Exhibit A) and depiction (Exhibit B). The undersigned hereby covenant that they are the owners of the above -described property in fee simple; that the property is free of all liens and encumbrances, and that they have good and legal right to grant this deed. The undersigned also hereby request the Assessor and Treasurer of said County to set over to the remainder the lien of all unpaid taxes, if any, affecting the property hereby conveyed, as provided by RCW 84.60.070. It is understood and agreed that delivery of this Deed is hereby tendered and that the terms and obligations hereof shall not become binding upon the City of Edmonds unless and until accepted and approved hereon in writing by the City of Edmonds.
