INTRODUCTION The subject application is to establish an Accessory Dwelling Unit (ADU) of approximately 1,012 square feet in a portion of the basement floor of the existing single-family residence at 22425 1001h Ave. W. The proposed ADU repurposes the ground level into a one -bedroom accessory dwelling unit (Attachment 2 & 3). Approval of an ADU requires compliance with Edmonds Community Development Code (ECDC) Chapters 16.20 and 20.21. Pursuant to ECDC 20.01, conditional use applications are a Type II staff decision requiring public notice. B. COMPLIANCE WITH ECDC CHAPTER 16.20 The subject site is located within the Single -Family Residential, RS-8 zone. The RS — Single -Family Residential zones reserve and regulate areas primarily for families living in single-family dwellings and to provide for additional non-residential uses which complement and are compatible with single- family dwelling use. ECDC 16.20.010(D) conditionally permits an attached Accessory Dwelling Unit (ADU) as a secondary use. The proposal must comply with the purposes of the single-family residential zone (ECDC 16.20.000). Based on staff s review of the specific ADU criteria as described in Section C, staff finds that the proposal complies with the purposes of the single-family zone. C. COMPLIANCE WITH ECDC CHAPTER 20.21 Section 20.21.030 of the Edmonds Community Development Code (ECDC) provides the review criteria for Accessory Dwelling Units (ADUs). For the permit to be approved, applications must meet all the criteria. The criteria for approval are as follows: (1) Land Use Permit; (2) Number of Units; (3) Size; (4) Location and Appearance; (5) Parking; (6) Occupancy; and (7) Safety, Light, Ventilation, Floor Area, and Similar Factors. The City crafted its ADU criteria to ensure that ADUs would comply with Chapter 16.20 of the Edmonds Community Development Code. Detailed explanations of staffs review of each criteria follows. File No. PLN2023-0004 Samanian ADU Page 2 of 5 1. Land Use Permit Required ECDC 20.21.030(A) requires a land use permit for approval of an attached ADU. Badressadat Samanian applied for a land use permit for the subject ADU on January 26th, 2022. Refer to Attachments 1 and 2 - site plan and floor plan. The submittal also included an ADU owner occupancy affidavit (Attachment 3). Lacking a staff determination of completeness within 28 days, per ECDC 20.02.003(E), Planning staff deemed the application complete on February 23ra 2023. A letter requesting additional information was sent on March 15th, 2023. The applicant submitted a response on March 18th, 2023. 2. Number of Units The proposal will result in only one ADU. This complies with the number of units allowed per ECDC 20.21.030(B). 3. Size According to ECDC 20.21.030(C), "In no case shall an accessory dwelling unit be (1) larger than 40 percent of the livable floor area of the principal dwelling, (2) nor more than 800 square feet, (3) nor have more than two bedrooms; provided, if the accessory dwelling unit is completely located on a single floor, the planning manager may allow increased size up to 50 percent of the floor area of the principal dwelling in order to efficiently use all floor area, so long as all other standards set forth in this chapter are met." The following table describes both the maximum allowed Accessory Dwelling Unit size and the proposed size for this application: Maximum Allowed Proposed 40% for new construction, 50% for existing spaces livable area of the primary dwelling* 49.6% of livable area of the primary dwelling 2 bedrooms 1 bedroom 800 square feet* 1,012 square feet *ECDC 20.21.030.0 allows ADUs up to 50% of the floor area of the principal dwelling to efficiently use all floor area. Attachment 2 includes the ADU on the first floor and the upper as -built floor. The application proposes an ADU encompassing approximately 1,012 square feet subordinate to the primary residence of approximately 1,032 square feet. This proposal yields a total livable area of 2,036 square feet. The proposed ADU would comprise 49.6% of livable floor area relative to the primary dwelling. Staff finds the unit size criteria of ECDC 20.21.030(C) thereby satisfied. 4. Location and Appearance According to Chapter 20.21.030(D) of the Edmonds Community Development Code: The single-family appearance and character of the residence shall be maintained when viewed from the surrounding neighborhood. The design of the accessory dwelling unit shall be incorporated into the design of the principal dwelling unit and shall be designed to maintain the architectural design, style, appearance, and character of the main building as a single- family residence using matching materials, colors, window style, and roof design. The primary entrance to the accessory dwelling unit shall be located in such a manner as to be unobtrusive when viewed from the street. Whenever possible, new entrances should be placed at the side or rear of the building. Only one electric, one gas meter, and one water meter shall be allowed File No. PLN2023-0004 Samanian ADU Page 3 of 5 for the entire building, serving both the primary residence and the accessory dwelling unit. Accessory dwelling units must be located within or attached to single-family dwelling units. The proposed ADU will occupy most of the ground floor of the existing single-family residence. The proposed main entry into the ADU will be via a door on the east face of the building. The front door of the existing residence is located on the west, facing 1001h Ave. W. Staff finds that with the conditions of approval, the proposed ADU will provide cohesive architectural design, style, appearance, and character of the existing building and would not compromise the single-family appearance of the residence; therefore, the subject application complies with the location and appearance criteria. 5. Parking ECDC 20.21.030(E) requires one more off-street parking space for the ADU in addition to the two off-street parking spaces normally required for a single-family residence for a total of three on -site parking spaces. The minimum parking space size is 8.5 feet wide by 16.5 feet long (ECDC 18.95.020(A)(1)(a)). Pursuant to ECDC 18.95.030(B), one tandem space may be provided to meet the minimum required parking on RS-zoned lots. As depicted on the site plan and floor plan, four parking spaces are available onsite — two in the garage, and two in tandem to the garage in the driveway. Thus, the proposal complies with onsite parking requirements of ECDC 17.50.020(A)(1) and ECDC 20.21.030(E). 6. Occupancy Per ECDC 20.21.030(F), as a condition of approval, the homeowner must sign an affidavit before a notary regarding their occupancy of one of the units for a minimum of six months of each calendar year. The owner(s) shall not rent any portion of the owner -occupied residence either during their occupancy or while absent from the owner -occupied unit for any period, and in no event shall the occupants of the lot exceed one family as defined in ECDC 21.30.010. The property owner submitted a notarized affidavit to the City affirming that they will reside in the primary residence or ADU for more than six months of every year (Attachment 3). As a condition of approval, the owner/applicant must also file the required covenant with the County Auditor following approval of the ADU. This covenant will be provided to the applicant for a signature and recording during the required building/compliance permit application review and is thereby a condition of approval for this conditional use permit. 7. Safety, Light, Ventilation, Floor Area, and Similar Factors ECDC Chapter 20.21.030(G) states that as a condition of approval, the applicant must apply for a Compliance Permit and inspection by a City Building Inspector to ensure that the Accessory Dwelling Unit meets the requirements of all life -safety codes and standards. The Building Compliance Permit associated with this ADU is BLD2023-0454. Any conditions or corrections resulting from the inspection and/or building permit must be complied with per code requirements. Any approval of an ADU shall be conditioned to require compliance with the Building Division's inspection requirements. This is a condition of approval for this conditional use permit. D. TECHNICAL REVIEW The Building Division, Engineering Division, and Snohomish County Fire District No. 1 reviewed the subject application for approval. Compliance with all applicable building codes will be assessed during review of the associated building permit(s) and is a condition of approval. The Engineering Division provided a memorandum confirming that the application is consistent with Title 18 ECDC Engineering standards, which includes parking requirements. Compliance with applicable File No. PLN2023-0004 Samanian ADU Page 4 of 5 Engineering codes and construction standards will be reviewed with the building permit(s) application and has been included as a condition of approval. Snohomish County Fire District No. 1 had no comments on the proposal and the Building Division has provided review comments on and since approved the associated building permit. As always, any affected divisions/departments may have comments related to the proposal as part of their respective reviews of any associated building permit application(s). E. PUBLIC COMMENTS In accordance with ECDC 20.03, a "Notice of Application" dated March 24th, 2023, with a comment period ending on April loth, 2023, was mailed to property owners and taxpayers within 300 feet of the subject site based on the adjacent property owners' list prepared by staff and was posted onsite, at the Public Safety Complex, Development Services Department, and the City website March 201, 2023. The notice of application was also published in the Everett Herald on March 24th, 2023. All public notice materials, including the notice, declarations of mailing and posting, and an affidavit of publication are included as Attachment 4. On March 291h, staff received questions via email about the nature of the application and where the proposed ADU would be on the lot from Janice Emery. She wanted to know if the proposed ADU would be in the existing accessory structure, about permitting an existing unpermitted ADU, and about the Type II -A permit and application process. She received answers to these and follow-up questions via email by April 41h F. DECISION Based on statements of fact, conclusions, and attachments in this report, the application for a Conditional Use Permit for an Accessory Dwelling Unit at 22425 100th Ave. W is GRANTED, subject to the following conditions: 1. A building permit(s) must be obtained from the Building Division for the proposed ADU, final inspection completed, and occupancy approval granted by the City Building Inspector prior to the area being used as an ADU. Compliance with applicable standards will be verified by the Building Division during their review of the associated building permit application(s). 2. Compliance with all applicable divisions/departments will be required with any associated building permit application(s). An associated building permit for the ADU may not be granted if the ADU is substantially altered and thus no longer in conformance with the plans and drawings reviewed and approved in this report. 4. This permit shall expire automatically if any of the following issues arise: a. The Accessory Dwelling Unit is substantially altered and is thus no longer in conformance with the plans and drawings reviewed and approved by the permitting authority and Building Official. b. The subject site ceases to maintain the required number of parking spaces. c. The property owner ceases to reside in either the primary residence or the Accessory Dwelling Unit, the owner -occupied unit is rented, or the current (or future) owner fails to file the affidavit required under ECDC 20.21.025(A)(1). 5. The Accessory Dwelling Unit Covenant must be filed with the Snohomish County Auditor. This covenant may be obtained from the Planning Division during the associated building/compliance File No. PLN2023-0004 Samanian AD Page 5 of 5 permit application review. Prior to occupancy of the Accessory Dwelling Unit, the applicant must either (fees stated below are based on current fees and are subject to change): a. Provide the City processing fee ($110) plus the County recording fee (currently $203.50 for one page plus $1 for each additional page), and the City will record the covenant for you; OR b. Take the covenant to the County and record it for the County's recording fee (currently $203.50 for one page plus $1 for each additional page) and return a copy of the recorded covenant to the Edmonds Planning Division with the Auditor's recording sticker on the copy. 6. The Accessory Dwelling Unit permit shall not be transferable to any site other than the subject site described in the application. The Accessory Dwelling Unit permit is transferable to new owners of the subject property unless there is a violation of any conditions of approval listed above.
