hereby grants to
GRANTEE: The City of Edmonds, a municipal corporation.
A natural greenbelt easement for the following purposes is reserved for and granted to the
City of Edmonds and its citizens in order to preserve the physical and aesthetic character of the
City through the prevention of indiscriminate removal or destruction of native vegetative growth
on developed or partially developed property, over and across the following described real
property to -wit:
SEE EXHIBIT "A"
No tree trimming, tree topping, tree cutting or tree removal, nor shrub or brush -cutting, or
removal, nor construction, clearing or alteration activities shall occur within the easement area
without prior written approval from the City of Edmonds. Application for such written approval
to be made to the Edmonds Planning Division which may require inspection of the premises prior
to issuance of the written approval and following completion of the activities. Any person
conducting or authorizing such activity in violation of this paragraph or the terms of any written
approval issued pursuant hereto, shall be subject to the enforcement provisions of Chapter 18.45
of the Edmonds Community Development Code. In such event, the Edmonds Planning Division
may also require within the immediate vicinity of any damaged or fallen vegetation, restoration of
the affected area in accordance with the standards setforth in Edmonds Community Development
Code Section 18.45.075. The Planning Division, also may require that the damaged or fallen
vegetation be removed.
This easement is given to satisfy a condition of a Critical Areas Determination issued
by the City of Edmonds under Edmonds Critical. Areas Determination File No. CA-92-55 for
construction of single-family building permit upon the following described real property:

This easement shall be binding upon the parties hereto, their successors and assigns, and
shall run with the land.

SUBJECT: CRITICAL AREAS STUDY FACTS AND CONDITIONS
CA-55-92 Lot located at 17024 76th Av. W.
Bob and June Drew have submitted critical areas checklist for their property located at 17024 76th Ave.
W. A stream passes along the west end of the subject property. The stream is mapped on the Critical
Areas Map and is labeled as a class 2b stream. The 2b classification requires a twenty five foot buffer
from the top of the bank of the stream and a 15 foot building setback from the edge of the buffer.
Therefore the Planning division required that the applicant provide the City with a critical area study
which delineated the edge of the bank of the stream and showed that the proposed construction would
meet the required stream setbacks.
The applicant provided the City with a site plan drawn by the Applicant's architect, Rick Anderson.
This site plan delineated the edge of the stream, the stream buffer and the building setback. Jeffrey
Wilson of the Planning Division and Don Feine of the Engineering Division inspected the site and agreed
that the information that the applicant provided was sufficient for the study.
Therefore I recommend that the following condition be required with the approval of a building permit
for the subject site:
1. The applicant provide the City with a Native Growth Protection Easement for the portion of the
property within 25-feet of the stream bank. As shown on the study site plan (reviews 6/2/92). This
easement must state that no construction or alteration of the 25 foot stream buffer is allowed. This
easement must be recorded with the Snohomish County Recorder's office prior to the issuance of a
building permit.
2. The applicant must provide the City with an easement stating that no structures are allowed to be
built within 15 feet of the 25 foot stream buffer. This easement must be recorded with the
Snohomish County Recorder's office prior to the issuance of a building permit

Application for the City of Edmonds prior
to his/her submittal of a development permit

The purpose of the Checklist is to enable
City staff to determine whether any potential
Critical Areas are or may be present on the

An applicant, or his/her representative, must
