Although no landscaping requirements are required for single-family properties, landscaping requirements and design review are required for properties in commercial or multi -family zoned sites subject to Edmonds Community Development Code (ECDC) Chapter 20.13. The subject application does not trigger SEPA review; therefore, the proposal may be approved as a Type I staff decision subject to the requirements of ECDC 20.01.003. I. FINDINGS AND CONCLUSIONS 1. The site is zoned Downtown Business (BD-2). 2. The applicant is proposing to remove one pine tree and replace with 9 arbor vitae. Attachment 1 is the Land Use Application. Attachment 2 is applicant's narrative. Attachment 3 is the site plan indicating the vicinity of removal and replacement. Attachment 4 are photos of the proposed removal. 3. Arborist report indicates the size and nuisance of the proposed tree subject to removal (Attachment 5). 4. Removal of trees triggers the need for replacement landscaping. Type III landscaping is appropriate for the northeast property line per ECDC 20.13.030. Landscaping site plan as shown in Attachment 3 and Attachment 4 meets the intent of Type III landscaping along the northeast property line. S. Proposed replacement trees (arbor vitae) are compatible with the climate of the Pacific Northwest per ECDC 20.13.020(H). II. DECISION Based on findings, conclusions, and attachments to this report, staff finds that the design review for file number PLN2023-0032 is APPROVED with the following conditions: 1. This approval is valid only for the single pine tree depicted in the photo and site plan. Removal of any other trees requires a separate permit. 2. Replacement tree size shall be consistent with ECDC 20.13.015(B), which are: a. one -and -one-half inch caliper deciduous trees; b. eight feet minimum height — vine maples and other multi -stemmed trees; c. six feet minimum height — evergreen trees. d. eighteen inches minimum height for medium and tall shrubs — more than 6-feet tall at maturity. 3. Replacement trees shall be planted in the general vicinity of the trees to be removed on the NE corner of the parcel. 4. Separate building permit will be required if removing and replacing entire parking lot or modifying striping. 5. Trees shall be felled on private property. 6. Vehicles and equipment shall be located on private property. Should it be necessary to utilize any portion of the City right-of-way, including the street or sidewalk, to perform any of this work then the contractor shall apply for and obtain a right-of-way construction permit in advance of starting work. A traffic control plan will be required as part of the right-of-way permit application. 7. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 8. Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk or other public improvements in City right-of-way per City standards that is caused by or occurs during the permitted project. Page 2 of 3 9. Contractor/owner is responsible for locating all on -site utilities and any utilities on neighboring properties that could be impacted by the tree removal. The water utility purveyor for this site is Olympic View Water and Sewer District and for sewer the purveyor is the City of Edmonds. Our organization believes that the removal of this tree is necessary due to several reasons. The existing pine tree poses significant concerns that affect both the safety and the structural integrity of our parking lot. Firstly, the tree exhibits a noticeable lean, which has raised considerable worries about its stability. As it stands in front of our three main parking stalls, the leaning tree presents a potential hazard to our employees and customers who use these parking spaces daily. Secondly, the pine tree's trunk is seeping pitch, suggesting the presence of disease or decay within the tree. This condition compromises the overall health and longevity of the tree. Thirdly, the root system of the pine tree has begun to cause significant damage to our parking lot. It has destroyed the pavement, resulting in cracks and uneven surfaces that pose tripping hazards. Finally, the encroachment of the roots on the parking spaces makes it increasingly challenging for vehicles to maneuver safely within the area. Our proposal involves planting nine arborvitaes along the fence line in the same area. Arborvitaes are known for their ability to grow upright and provide an aesthetically pleasing green barrier. By planting these arborvitaes, we aim to maintain a visually appealing landscape while simultaneously resolving the safety and structural concerns associated with the existing pine tree. We recognize and appreciate the City of Edmonds' commitment to environmental conservation and tree preservation. As responsible members of the community, we are dedicated to upholding these principles while also ensuring the safety and well-being of all individuals utilizing our commercial building and parking lot.
