Introduction The design review application was submitted by Scott Andersen on behalf of Grow With Us Preschool. The request is for a modification to the existing landscaping at the multi- family property addressed 665 Edmonds Way. The proposal is for the removal of one existing tree located along the north side of Edmonds Way adjacent to the building. Replacement landscaping is required for removal of the trees/vegetation. Page I of 3 File No. PLN2022-0091 Grow With Us Preschool Landscaping Revision Administrative Design Review The subject site is located within the Planned Business, BP, zone (see inset -zoning map above). As such, the proposal is subject to the General Design Review requirements of ECDC Chapter 20.11. Pursuant to ECDC 20.11.010, since the proposal does not require a SEPA threshold determination, staff may review the proposal as an administrative Type I decision, subject to the requirements of ECDC 20.01 and 20.02. The applicant submitted a land use application (Attachment 1), cover letter (Attachment 2), a site plan (Attachment 3) and photo (Attachment 4). The application is procedurally complete pursuant to ECDC 20.02.002. C. Criteria and Comprehensive Plan Compliance The subject site is located within the "Planned -Neighborhood" designation of the Comprehensive Plan. Nothing in this proposal appears to be in conflict with the goals and policies of the Comprehensive Plan. D. Public Comments Pursuant to ECDC 20.01.003(C), public notice is not required for Type I decisions. Thus, public notice was not required for the subject application. As such, no public comments have been received in response to the proposal. E. Findings and Conclusions a. The subject site is located within the Planned Business, BP zone (Attachment 5). The properties located to the north and south are also in the BP zone. The properties located to the east of the subject property are zoned Single -Family Residential, RS-6. Properties surrounding the subject site are developed with commercial and residential uses. b. Current landscaping requirements are contained within ECDC Chapter 20.13. Although the current landscaping requirements are different from the landscaping requirements that may have been in place at the time of original development of the site, any proposed changes to existing landscaping are subject to the current code requirements of ECDC 20.13. Thus, any proposed changes to existing landscaping must strive towards bringing the site closer into compliance with current landscaping requirements. c. The proposal includes the removal of a dead/dying Douglas Fir, along the north side of Edmonds Way adjacent to the building. Per the cover letter and picture provided the tree is clearly hazardous (Attachment 2 & 4). d. In accordance with ECDC 20.13.030, Type V landscaping is appropriate in the vicinity of the parking lot and is intended to provide visual relief and shade in parking areas. e. In order to comply with the landscape requirements, the applicant has proposed to relace the tree with a Japanese Maple. f. Minimum sizes of plants at installation are provided within ECDC 20.13.015 and ECDC 20.13.030.E.2.a. This requirement has been added within the conditions of approval. Decision Based on the facts, conclusions, and attachments to this report, staff finds that the design review for file number PLN2022-0091 is APPROVED with the following conditions: a. Individual elements of this project are required to meet all applicable city codes, and it is the responsibility of the applicant to apply for and obtain all necessary permits. b. Only the identified tree (Douglas Fir) as shown in (Attachments 2, 3 & 4) may be removed. Removal of any other trees/vegetation requires separate approval. c. The replacement tree must meet the minimum size requirements as outline in Chapter 20.13 ECDC. d. Trees shall be fell onto private property. e. Vehicles and equipment shall be located on private property. Should it be necessary to utilize any portion of the City right-of-way, including the street or sidewalk, to perform any of this work then the contractor shall apply for and obtain a right-of-way construction permit in advance of starting work. A traffic control plan will be required as part of the right-of-way permit application. f. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. g. Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk or other public improvements in City right-of-way per City standards that is caused by or occurs during the permitted project. h. Contractor/owner is responsible for locating all on -site utilities and any utilities on neighboring properties that could be impacted by the tree removal. Appeals Staff design review is a Type I decision which pursuant to ECDC 20.01.003.13 is subject to judicial appeal. Type I decisions may be appealed by a party of record with standing to file a land use petition in Snohomish County superior court. Such petition must be filed within 21 days after issuance of the decision, as provided in Chapter 36.70C RCW.
