NOTICE OF CIVIL VIOLATION

Code Section(s) Violated: ) Edmonds Community Development Code (ECDC) Chapter 18.70 Street Use
and Encroachment Permits; and Chapter 17.70.040 Bistro and Outdoor Dining. _
Description of Violation: Dining tables and chairs in ROW after permit expired.
Corrective Action Required:
1) Remove tables, chairs, and umbrellas from the City right-of-way immediately.
2) Make payment for September and October rental fees.
Be advised, the person(s) to whom this Notice is issued must correct the violation(s) and shall be assessed a
$100.00 fine. The imposed monetary penalties are immediately due and payable to the City of Edmonds at
121 5th Avenue North, Edmonds, WA 98020 during normal City business hours. The City intends to issue a
new Notice of Violation if the above -referenced violation(s) remain uncorrected, and fines shall continue to
accrue under each Notice of Violation until this matter is resolved to the satisfaction of the City.
Further, if correction is not made by 12:OOPM on October 25, 2023 an abatement notice may be issued warning
of impending City abatement of the violation. Any and all costs, including incidental costs, will be added to the
monetary penalties assessed against the person(s) to whom the Notice is issued.
Note, this decision is appealable to the City of Edmonds Hearing Examiner by filing a complete appeal
application including written notice of appeal with the Development Services Director no later than
October 31, 2023 at 3:00 p.m. The appeal filing fee is $1,108.00 pursuant to Resolution 1192 adopted by
City Council. Each Notice of Violation issued by the City is separately appealable by the deadline indicated
therein. Failure to appeal a Notice of Violation shall waive the right to further challenge the violation
determination and monetary penalties for the period covered by that Notice of Violation.
