CUPS are Type III-B decisions under ECDC 20.01.003, with the decision made by the Hearing Examiner following a public hearing. ECP has also applied for a joint -use parking agreement (PLN2023-0067) with Edmonds Presbyterian Church. The joint -parking agreement is a Type II -A permit (per ECDC 20.30) that is being reviewed under a consolidated process with PLN2023-0052 at the request of the applicant, per ECDC 20.01.002 (Optional Consolidated Permit Processing). The applicant has also applied for a change -of -use building permit for the preschool in permit BLD2023- 1407, which is being reviewed concurrently by staff. Staff Recommendation Staff recommends that the Hearing Examiner approve the requested conditional use permit (File No. PLN2023-0052) and joint use of parking agreement (File No. PLN2023-0067) with the conditions included in the attached staff report because the proposal is consistent with the community facilities criteria listed in ECDC 17.100.020, CUP criteria listed in 20.05.010, the joint use parking criteria in ECDC 20.30.030, the Comprehensive Plan, and the zoning ordinance. Zoning: The site is zoned single-family residential (RS-8). 6. Request: The applicant is seeking a CUP for a preschool and joint use parking with the primary occupant. 7. Review Process: PLN2023-0052 is a Type III-B permit. For CUP applications that require a public hearing, staff reviews the proposal and makes a recommendation to the Hearing Examiner on whether the proposal is consistent with the CUP criteria of ECDC 20.05.010, zoning ordinance, and the City's Comprehensive Plan. Following a public hearing, the Hearing Examiner makes the final decision on the CUP. PLN2023-0067 is a Type II -A permit, which is typically reviewed through an administrative process where the director makes a decision based on standards and clearly identified criteria, but where public notice is required (ECDC 20.01.001(A)). Since the applicant chose to consolidate review, PLN2023-0067 will be processed alongside PLN2023-0052 as a Type III-B permit. 8. Compliance Review: a. Compliance with ECDC 16.20 Single-family Residential b. Compliance with ECDC 17.50 Off Street Parking Regulations c. Compliance with ECDC 17.100 Community Facilities d. Compliance with ECDC 20.05 Conditional Use Permits e. Compliance with ECDC 20.30 Joint Use of Parking Lot Size: Edmonds Presbyterian Church owns two adjoining parcels totaling 138,521 square feet (3.18 acres). The church facility that will house the proposed preschool is located on a lot that is approximately 78,408 square feet (1.8 acres per Snohomish County Assessor's records). The undeveloped lot adjoining the subject lot is 60,113 square feet (1.38 acres per Snohomish County Assessor's records). 10. Existing Use: The current building's primary function is as a church with associated activities. 11. Proposed Use: The applicant is proposing a preschool facility within a portion of the existing building. The majority of the building will continue to function as a church with associated programming. II. APPLICATION SUBMITTAL PLN2023-0052 was submitted by the applicant on August 4, 2023 and was accepted by the City on August 23, 2023 when the application fees were paid (Attachment 2). The ECP Conditional Use Permit File No. PLN2023-0052 & -0067 — 22600 96" Ave. W Packet Pg. 5 3.A.a applicant also submitted the criteria statement (Attachment 3), and a document that included a site plan, property description, and floor plan (Attachment 4). Upon request from the Planning Department, the applicant submitted an updated floor plan on September 15, 2023 (Attachment 5) and an updated schedule on September 18, 2023 (Attachment 6). The application was determined to be complete on September 25, 2023 (Attachment 7). Planning staff received and formally accepted the land use application for PLN2023- 0067 (Joint Use Parking Agreement) on September 25, 2023 (Attachment 8), along with a criteria statement (Attachment 9), and site plan (Attachment 10). Planning staff deemed the application complete on October 2, 2023 (Attachment 11). III. SEPA THRESHOLD DETERMINATION CUPS and similar land use decisions are categorically exempt from a threshold determination pursuant to WAC 197-11-800(6). IV. PUBLIC NOTICE AND COMMENTS Per the consolidated review process in accordance with ECDC 20.01.002(B), the Notice of Application for PLN2023-0052 and PLN2023-0067 were noticed together. A Notice of Application dated October 10, 2023 was published in the Everett Herald Newspaper, and posted at the subject site, Public Safety Complex and the Planning and Development Department on October 10, 2023. The notice was not posted at the Edmonds Library due to ongoing construction attributed to flooding in summer of 2022. The notice was also mailed to property owners within 300 feet of the site on October 10, 2023, using a staff generated mailing list. See Attachment 12 for the Notice of Application and associated documentation of compliance with the public notice requirements. The Notice of Public Hearing, dated October 26, 2023 was published in the Everett Herald Newspaper, and posted at the subject site, Public Safety Complex and the Planning and Development Department on October 26, 2023. The notice was not posted at the Edmonds Library due to ongoing construction attributed to flooding in Summer of 2022. The notice was also mailed to property owners within 300 feet of the site on October 26, 2023, using a staff generated mailing list. See Attachment 13 for the Notice of Public Hearing and associated documentation of compliance with the public notice requirements. Due to an error with the mailed notice on October 26, the public hearing had to be rescheduled to allow for proper noticing. A second Notice of Public Hearing, dated November 9, 2023 was published in the Everett Herald Newspaper, posted at the subject site, Public Safety Complex and the Planning and Development Department, and was mailed to property owners within 300 feet of the site on November 9, 2023 using an updated mailing list. See Attachment 14 for the updated Notice of Public Hearing and associated documentation in compliance with the public notice requirements. TECHNICAL COMMITTEE This application was also evaluated by the City's Engineering Division. They determined that the project is consistent with engineering standards in Title 18 ECDC, specific compliance with which will be reviewed with building permit. See Attachment 15 for the Engineering Compliance Memorandum. The required associated building permit for change of use will also be evaluated by South County Fire, the Building Division, the Engineering Division, and the Planning Division. VI. NATURAL ENVIRONMENT 1. Critical Areas: A critical area determination is not required at this time since the proposed use will be located within the existing building and thus does not trigger critical area review under ECDC Chapter 23.40. Any changes to the site proposed in the future that require disturbing the ground will require a critical area determination for the site. 2. Shoreline: The subject property is not located within shoreline jurisdiction. VI 1. NEIGHBORHOOD CHARACTERISTICS The subject site is located within the single-family residential (RS-8) zone. Refer to Attachment 1 for a zoning and vicinity map. The properties north, east, south, and west of the subject site are all zoned RS-8 and contain single-family homes. VIII. COMPREHENSIVE PLAN The Comprehensive Plan designation for the site and surrounding properties is Single Family Urban 1. The Comprehensive Plan is largely silent on churches and preschools but the following policies from the Residential Development Goals are related: A.5 Protect residential areas from incompatible land uses through the careful control of other types of development and expansion based upon the following principles: A.S.a Residential privacy is a fundamental protection to be upheld by local government. A.S.b Traffic not directly accessing residences in a neighborhood must be discouraged. A.S.c Stable property values must not be threatened by view, traffic or land use encroachments. A.S.d Private property must be protected from adverse environmental impacts of development including noise, drainage, traffic, slides, etc. ECP Conditional Use Permit File No. PLN2023-0052 & -0067 — 22600 96t' Ave. W Packet Pg. 7 3.A.a (2020 Comprehensive Plan, page 67) The proposed preschool is a compatible land use given the site's Comprehensive Plan designation. The proposed use of a preschool is an allowed use, with a CUP in the RS-8 zone. At this time, no changes are proposed to the existing vehicular access to the site, which provides access directly off of 96t" Ave W. Sharing the existing parking lot is also compatible with the Comprehensive Plan since the uses do not overlap to a substantial extent. The joint use parking agreement will also allow the use to conform to the standards in ECDC Chapter 17.50. Based on the above analysis, staff finds that the proposal is compatible with the referenced Comprehensive Plan policies. IX. APPLICABLE CODES 1. ECDC 16.20 (Single Family Residential, RS-8 zone) Chapter 16.20 ECDC establishes the allowed uses and site development standards applicable to the single-family residential zone. Neighborhood churches like Edmonds Presbyterian are primary permitted uses in the RS-8 zone subject to the requirements of ECDC 17.100.020. Preschools, such as Edmonds Cooperative Preschool, are a secondary use requiring a conditional use permit. Staff finds that with the recommended conditions of approval, the proposal is consistent with the RS zoning and site development standards. 2. ECDC 17.50 Off Street Parking Regulations According to ECDC 17.50.020(C)(3), churches require a minimum of one parking space per four seats or one parking space per 40 square feet of assembly area, whichever is greater. The associated building permit application (BLD2023-1407) shows that the sanctuary at Edmonds Presbyterian has 116 seats (requiring 29 stalls) and 2,119 sq. ft. of assembly area, which includes sanctuary open space, sanctuary seating, and sanctuary stage. The total parking requirement based on square footage of assembly area is 53 stalls. The site contains 65 parking stalls. See pages G101, A100, and A200 of the Architectural and Floor Plans BLD2023-1407 (Attachment 16). ECDC 17.50.020(C)(8) requires one space for 300 square feet, or one per employee, plus one per five students, whichever is larger. The preschool use would occur within 770 sf (Attachment 5), which would require 3 parking spaces. However, as indicated in Attachments 3 and 6, the preschool classes are proposed to be staggered by student age (2-year olds, 3-year olds, 4-year olds) during weekdays with one class in the morning and another in the afternoon. Classes range from 16 children and 8 adults (2-year old classes), 18 children and 6 adults (3-year old classes, and 18 children and 4 adults (4- ECP Conditional Use Permit File No. PLN2023-0052 & -0067 — 22600 96t' Ave. W Packet Pg. 8 3.A.a year old classes). Therefore, the maximum parking required per each class is 11 parking spaces per the 2-year olds, 9 parking spaces per the 3-year olds, and 8 parking spaces per the 4-year olds. Since the classes are staggered, 11 parking spaces would be required. While the religious use of the site is primarily on weekends and the preschool use will be Monday — Friday during the school year, a joint use parking agreement is therefore required in accordance ECDC 20.30 prior to beginning the preschool use at the site. 3. ECDC 17.100 — Community Facilities Section 17.100.020(C) ECDC indicates that churches must meet the parking requirements of ECDC Chapter 17.50 but allows for joint use parking arrangements per ECDC 20.30. Section 17.100.020(I) ECDC indicates that a conditional use permit is required for secondary uses within a church property, and that the use is considered secondary with respect to the majority of the criteria in ECDC 17.100.020(I)(3). Staff finds that the preschool use is secondary to the church use in terms of the amount of space allocated for use and the duration of use. The preschool use will take place within 770 sf of the existing church footprint of 7,735 sf (See Attachment 5) and the duration of use will occur during the day M-F during the school year and further defined in Attachments 3 and 6. 4. ECDC 20.05 — Conditional Use Permits Pursuant to ECDC 20.05.010, no CUP may be approved unless all of the following findings can be made: A. Comprehensive Plan. That the proposed use is consistent with the Comprehensive Plan. Refer to Section VII of this report for a discussion on consistency with the Comprehensive Plan. The proposed preschool facility will be located within an existing church and will be consistent and compatible with its surrounding neighborhood. Additionally, the proposed use will provide a service to the local neighborhood and should not cause an increase in traffic along the neighborhood streets as the site is already developed. B. Zoning Ordinance. That the proposed use, and its location, is consistent with the purposes of the zoning ordinance and the purposes of the zone district in which the use is to be located, and that the proposed use will meet all applicable requirements of the zoning ordinance. The preschool will be within the RS-8 zone, which is an allowed use in an existing church as a secondary use requiring a conditional use permit. Therefore, if the subject application is approved, the proposed use will be consistent with the requirements of the zoning ordinance. Furthermore, ECP Conditional Use Permit File No. PLN2023-0052 & -0067 — 22600 96t' Ave. W Packet Pg. 9 3.A.a ECDC 16.20.000(B), states that one of the purposes of the RS zone is, "To provide for those additional nonresidential uses which complement and are compatible with single-family dwelling use." If approved, this proposed land use within the existing developed structure/site would be consistent with the purposes of the RS zone. C. Not Detrimental. That the use, as approved or conditionally approved, will not be significantly detrimental to the public health, safety and welfare, and to nearby private property or improvements unless the use is a public necessity. The proposed preschool center should not be significantly detrimental to the public health, safety and welfare and to nearby private property or improvements. A recommended condition of approval states that the applicant must apply for and obtain all necessary building permits and that the application is subject to the applicable requirements in the Edmonds Community Development Code. This recommended condition ensures that any proposed revisions to the site will be reviewed for compliance with applicable site development standards at the time of the associated building permit application. The applicant will be required to meet applicable zoning standards through BLD2023-1407. Staff finds that the proposal to allow for a preschool does not appear to be detrimental to the public health, safety and welfare, or to nearby property owners. D. Transferability. The hearing examiner shall determine wither the conditional use permit shall run with the land or shall be personal. If it runs with the land and the hearing examiner finds it in the public interest, the hearing examiner may require that it be recorded in the form of a covenant with the Snohomish County auditor. The Hearing Examiner may also determine whether the conditional use permit may or may not be used by a subsequent user of the same property. The applicant did not initially indicate the desire for the requested CUP be transferable and run with the land, but requested transferability via email on November 6, 2023 (Attachment 17) 5. ECDC 20.30 - Joint Use of Parking Chapter 20.30 ECDC establishes a procedure and standards for review of applications for joint use of off-street parking facilities. Per ECDC 20.30.010, in addition to information required by ECDC 20.02.002, the applicant must provide written consent of all owners of the affected land. Per ECDC 20.30.030(F), the off-street parking facilities to be used jointly shall be located within 500 feet of the use which they are to serve. ECP Conditional Use Permit File No. PLN2023-0052 & -0067 — 22600 96t' Ave. W Packet Pg. 10 3.A.a The applicant has provided the required site plan (Attachment 10), which shows that the joint parking will be less than 500 feet from the proposed use. Per ECDC 20.30.040, prior to final approval, the applicant must provide to the City a covenant conveying a nonrevocable parking easement for the life of the applicant's use and record the covenant with the Snohomish County auditor. X. STAFF RECOMMENDATION Based on the analysis within and the attachments included with this report, staff finds the proposal is consistent with the community facilities criteria listed in ECDC 17.100.020, CUP criteria for approval listed in 20.05.010, the joint use parking approval criteria in ECDC 20.30.030, the Comprehensive Plan, and the Zoning Ordinance. Staff recommends that the Hearing Examiner APPROVE the requested conditional use permit (File No. PLN2023-0052) and joint use of parking agreement (File No. PLN2023-0067) with the following conditions: 1. The applicant must apply for and obtain all necessary building permits which are subject to the applicable requirements in the Edmonds Community Development Code. It is the responsibility of the applicant to ensure compliance with the various provisions contained in the ordinances. 2. The applicant is responsible for seeking and obtaining all required local, state and/or federal permits or approvals applicable to the proposal. 3. The applicant must provide the City with a covenant conveying a nonrevocable parking easement with Edmonds Presbyterian Church for the life of the applicant's use and record the covenant with the Snohomish County Auditor. 4. The CUP should be transferrable and run with the land. According to ECDC 20.06.140, a party of record may submit a request to reconsider a Type III-B decision to the Development Services Director within 10 days after the date of issuance of the decision. The request must be made in writing and include all required information stated in ECDC 20.06.140(D) as well as the applicable fee. XII. APPEAL Pursuant to ECDC 20.06.030, a party of record may submit a written appeal of a Type III- B decision to the Development Services Director within 14 days after the date of issuance of the decision. The appeal shall be made in writing and shall include all required information stated in ECDC 20.06.030(D) as well as the applicable fee. The appeal would be heard at a closed record hearing before the City Council according to the requirements of ECDC Chapter 20.06.120. XIII. Unless the owner obtains a building permit or, if no building permit is required, substantially commences the use allowed within one year from the date of approval, the CUP shall expire and be null and void, unless the owner files an application for an extension of time before the expiration date. (ECDC 20.05.020.(C)) An application for any extension of time shall be reviewed by the community development director as a Type II decision. It works to educate children ages 2-5 years and their parents in conjunction with the Family Life Education Department at Edmonds College. We provide low-cost preschool for children to learn social, academic, and life skills, while also supporting and educating their parents to support their children at home as they grow. We are a non-profit organization and our number is 23-7327831. We are in the process of applying for an Edmonds business license because we were previously in unincorporated Snohomish county when we met at Alderwood Early Childhood Center. We now hope to operate our preschool at Edmonds Presbyterian Church. Because of budget cuts in the Edmonds school district and their need to consolidate and start a different preschool program, they needed us to find a new location after over 20 years of being at the AECC. Our new proposed location is similar to our sister cooperative preschools that also run in conjunction with the Edmonds College such as West Edmonds Cooperative Preschool that meets in St. Albus Episcopal Church. We will use four of the classrooms at the church for our children to have class (two classes combine into one classroom and the other two classrooms have a large open walkway between them, effectively making this two larger classrooms), as well as their bathroom and occasional use of the fellowship hall and minimal use of the kitchen by an adult for food or activity preparation. Children will be in class from 9:30-11:30 on M and W mornings, 9:15-11:30 on T and Th mornings, and then in the afternoons from 12-2:30 M-Th. Teachers and parents will arrive around 10-30min early to set up and stay 10-30min after for clean up, though we have arranged with the church to have access to the church from 8am-4pm in the case of more set up and clean up by the teachers or parents. The 2s class which meets M and W mornings has a maximum of 16 students per class. The 3s class which meets T, Th, and Fr mornings has a maximum of 18 students. The 4s class which meets M-Th afternoon from 12-2:30 has a maximum of 18 students. Each class also has a teacher and parent volunteers in class with a requirement of a ratio in each class (adult to child 2s: 1:2, 3s: 1:3, 4s 1:5). Classes are held indoors for most of the day except for a 30 minute recess for the morning class and another 30 minute recess for the afternoon class. They will use the church outdoor areas for this time unless the weather is bad and they will stay inside in the fellowship hall area. Parents will use the parking lot of Edmonds Presbyterian Church for pick up and drop off or while staying and working in class, which has ample space and we won't need to use the street for parking. We may add a sign for our preschool to the church's existing sign per their permission or we may use a sandwich board near the street to signal to parents where the preschool is and to invite other community members to join. We will not be using a vehicle for our preschool. We do not need state licensing because our children are at school less than four hours a day. If the church agrees, we may install a playground at sometime in the future as a donation to the church for Packet Pg. 16 Attachment 3 their purposes as well as potentially sharing with the community. We also may install a storage shed on their property to store our preschool supplies with the permission and direction of the church, which will be in addition to the sheds they already have on their property. Both of these would be in a location that is convenient and visually appealing to the church and the neighborhood. Description of How Proposed Use Meets Applicable Codes: A. Comprehensive Plan: I believe the proposed use of the church building is consistent with the comprehensive plan, as the use will comply with the City Code. B. Zoning: The proposed use, and its location, is consistent with the purposes of the City of Edmonds' zoning ordinances. Under 16.0.010.D.1, the church is zoned as a single family residential zone and preschools are a secondary use which requires a conditional use permit. I understand the use of a church for a preschool is allowed if all of the City Code requirements are met. Under code 17.200.010, the use of the preschool is subordinate to the primary use of worship at the church, which we are following, as we are not meeting at the same time as their use of the building, we are using space that is of secondary use to them, and sharing that space with them when they need it outside of our hours. We will share the use of four of their existing classrooms and add to the function of their childcare room with furniture we will share. Our main functions will be in the wing with the classrooms and bathrooms and only use the fellowship hall area if indoor recess is needed or for a parent to make preparations in the kitchen. The amount of people during preschool use will be less than that of the main church services. We are making our plans with the church in order to amplify its connection and service to the community and in no way hinder its primary use. We will submit to their uses first and only use the building at times that doesn't interfere with their use. We hope to serve the people of the church, the neighborhood and our preschool greater together than we would separately, by augmenting each other's programs and bringing more people together. C. Not Detrimental. The use of Edmonds Presbyterian Church for hosting Edmonds Cooperative Preschool will not be significantly detrimental to the public health, safety and welfare, or to nearby private properties. The preschool will not provide pollution that is not consistent with a residential area and its usual function. We will dispose of our trash, compost, and recycling in their receptacles or our own, clean up the indoor and outdoor areas daily after our use. The noise of our small classroom for a short period will not be dissimilar to a neighborhood playground or field for children to play in. The church already functions as a community center of sorts for the neighborhood, by hosting neighborhood events and allowing people free and respectful use of their grounds for exercise and recreation, and hosting our preschool will amplify that by creating more venues for the public to engage with this beautiful property, as well as more hands and bodies to bring life to the property. D. Transferability. I understand and acknowledge that any Conditional Use Permit shall be personal to Edmonds Presbyterian Church, as present owner of the property, and may not be transferred or assigned. I have a couple of clarifying questions for you prior to my required submittal (tomorrow 11/2): 1. Transferability: You indicate in your initial criteria statement that the preschool use will be non -transferable. I just want to double check if this is the true intent of Edmonds Presbyterian Church. This use may "run with the land", which would then allow a preschool use as an outright permitted use (without having to apply for another Conditional Use Permit in the future). The church may want to choose for the permit to be transferrable so future preschool uses would not have to go through the same process that you did. 2. Number of "seats in the assembly area" of the church —this is used to determine required parking and needs to be addressed in my report. Thankyou!
