The applicant has requested a time extension for the conditional use permit approved
under file number PLN2022-0031.
II. APPLICABLE CODE
Section 20.050.020 ECDC —Conditional Use Permits
C. Time Limit. Unless the owner obtains a building permit or, if no building
permit is required, substantially commences the use allowed within one
year from the date of approval, the conditional use permit shall expire and
be null and void, unless the owner files an application for an extension of
time before the expiration date.
D. Review of Extension Application.
An application for any extension of time shall be reviewed by the planning
and development director as a Type 11 decision.
III. FINDINGS
1. The applicant received approval of a conditional use permit for outdoor storage at
7509 212th Street on March 6, 2023. The outdoor storage use is part of a larger
redevelopment project at the site including new office and shop buildings together
with related site improvements like outdoor storage, parking and landscaping.
2. Per ECDC 20.05.020.C, the outdoor storage permit will expire on March 6, 2024,
unless a building permit is obtained to commence the use.
3. Building permits to implement the redevelopment project have been submitted and
are under review (fill/grade in BLD2022-1556, office in BLD2022-1541, and shop in
BLD2022-1542) or have been issued (demolition of existing buildings in BLD2022-
0634, and related utility permits). However, the challenging post -pandemic financial
environment may necessitate redesign, reconfiguration, or re -sequencing of the
permitting or construction of the proposed buildings and site improvements.
4. The applicant applied for a time extension of the approved conditional use permit
for outdoor storage on January 29, 2024, prior to the expiration date of that permit
on March 6, 2024.
5. The code does not specify the duration for the possible extension; standard practice
is one year, consistent with the original approval duration.
6. This extension request is reviewed as a Type II decision (notice to parties of record).
IV. DECISION ON CONDITIONAL USE PERMIT APPROVAL TIME EXTENSION
The requested extension of the conditional use permit approval for outdoor storage for
Glacier Environmental at 7905 212th Street in permit PLN2022-0031 is APPROVED
subject to the following condition:
A one-year time extension is granted for the conditional use permit approval under
file number PLN2022-0031. The approval will now expire on March 6, 2025, unless a
building permit has been obtained to begin development of the conditionally
permitted outdoor storage use (e.g. fill/grade permit).
