INTRODUCTION The applicant proposes removing a hazardous Leyland cypress from a portion of the site containing an erosion hazard with a slope of at least 25% (ECDC 23.10.040(A)(1)). Staff reviews the removal of hazardous trees from critical areas as described by ECDC 23.40.220(C)(8)(b). II. CRITICAL AREAS Developed as a single-family residence and associated improvements, the site contains potential erosion hazard in the southeast portion of the lot (Attachment 4). The proposed work removes only the hazardous Leyland cypress, replacing it with two native trees as required by (ECDC 23.40220(C)(8)(b)(iv). Staff issued a favorable decision for the proposal in Attachment 5. III. FINDINGS AND CONCLUSIONS 1. The site is zoned Single -Family Residential (RS-8) 2. The applicant proposes to replace only the hazardous Leyland cypress. 3. Removal of the hazardous tree requires replacements. ECDC 23.40.220(C)(8)(b)(iv) requires two native trees to be planted in the critical area within a year. These replacements must be six feet tall at planting if evergreen, or 1-2" DBH if deciduous. The applicant proposes compliant replacements. 4. Areas unmodified by this proposal may persist as -is. 5. The replacement plantings must be inspected within a year of approval. Page 1 of 3 IV. DECISION Based on findings, conclusions, and attachments to this report, staff finds that the hazardous tree removal from a critical area for file number PLN2024-0007 is APPROVED with the following conditions: 1. This decision only approves the removal and planting of vegetation in the indicated in the submitted arborist report. Removal of any other vegetation in the critical areas may require separate approval. 2. Replacement plantings shall be consistent with the requirements of ECDC 23.40.220(C)(8)(b)(iv). 3. Trees shall be felled on private property. Unless it poses a risk of disease of pest transmission or would worsen the erosion hazard, the cut vegetation must remain in the critical areas onsite (ECDC 23.40.220(C)(8)(b)(iii)). 4. Vehicles and equipment shall be located on private property. Should it be necessary to utilize any portion of the City right-of-way, including the street or sidewalk, then the contractor must obtain a right-of-way construction permit in advance of starting work. The right-of-way permit application would require a traffic control plan. 5. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 6. Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk, or other public improvements in City right-of-way per City standards that is caused by or occurs during the permitted project. 7. Contractor/owner is responsible for locating all onsite utilities and any utilities on neighboring properties that could be impacted by the proposed work. Thank you for the opportunity to submit a proposal to plant two native trees to replace a recently failed Leyland Cypress. The hazard tree removal to clean up the failed tree is being permitted through the City of Edmonds #PLN2024-007. Two trees need to be replanted per COE code and proof of the planting must be provided within a year of approval. Replacements: The fallen tree came from a critical area and pursuant to ECDC 23.10.040(A)(1) and ECDC 23.40.220(C)(8)(b)(iii) replacement with two native trees is required. This document describes a replacement plan. 1. My first choice for replanting is to use (2) 1-inch caliper Vine Maples, a small native deciduous tree with light green leaves in the spring. These trees would be good in this location because the trees can handle some shade, the trees can sprout from the base and form clumps, and the roots are fibrous which will hold the soil as they grow. The two trees will be planted near the stump of the fallen tree in an area receiving sunlight with no other obstructions. Replanting with smaller statured trees in this location will add to structural diversity and forage opportunities for birds in the future. Note the tree diaper product listed below can help to retain soil moisture for new trees when no irrigation is nearby. (treediaper.com) This is my preferred option for the replanting. a. Driver and Truck, Nursery Selection and Delivery: $250 + tax b. Cost of (2) trees and supplies (soil, tree diaper, mulch, stakes): $125 each x 2 = $250 + tax c. Labor for 2 people to properly plant: Dig holes and amend soil, and install tree diaper, mulch, stake, and water: $650 + tax d. Short letter with pictures to share as proof of planting submitted to COE once planting is completed: $45 + tax e. Subtotal: $1,195 + tax f. If the proposal is approved, then the replanting work can be done on Monday, March 25, 8:30am arrival. Prices listed assume we can access the planting site using the Seto's Licensed, Bonded, Insured. My second choice for replanting would be to use (2) Western Hemlocks, a large native conifer that tolerates shade and dry conditions once established. This tree doesn't have fibrous roots and has the potential to grow into a tall tree at maturity. The one benefit is the coniferous species would provide screen in the winter than a deciduous species that loses its leaves. Tree work services include the hauling of branches, leaving wood cut into 16-18" rounds unless wood haul is requested, and general clean-up of work activities. Any stump -grinding debris is to be left and become the customer's responsibility. Champion Tree Care, LLC cannot be held responsible for damage to underground utility and/or irrigation lines we have not been made aware of prior to starting. The owner, or signing agent, is responsible for knowing of and obtaining all required permits and authorizations. Champion Tree Care, LLC is not responsible for any violation and/or penalties if permits are required and not obtained by the customer. It is the client's responsibility to know the legal boundaries of their site and to have the authority to have the work performed. We reserve the right to cancel this agreement at any time. The subject property is located on the east side of Emerald Hills Drive within the Emerald Hills Planned Residential Development. The site slopes down to the west from the common shared space pathway and down to the north from Main Street at slopes of 20%-49%. The subject site is relatively level in the vicinity of the existing single-family house. Soils on the site are identified as Alderwood Everett Gravelly sandy loams, 25-70% slopes and Alderwood Gravelly sandy loams, 15-25% slopes. With this soil series, slopes in excess of 15% are classified as potential erosion hazards and slopes in excess of 40% are classified as a potential landslide hazard. What does this mean? The critical area regulations are only triggered when an alteration is proposed to a critical area or its buffer. However, once an alteration in or near critical area is proposed, critical area studies and City review and approval may be required. What is an `Alteration'? According to Section 23.40.005 of the Edmonds Community Development Code (ECDC): "Alteration" means any human -induced action which changes the existing conditions of a critical area or its buffer. Alterations include, but are not limited to: grading, filling; dredging; draining; channelizing; cutting, pruning, limbing or topping, clearing, relocating or removing vegetation; applying herbicides or pesticides or any hazardous or toxic substance; discharging pollutants; paving, construction, application of gravel; modifying for surface water management purposes; or any other human activity that changes the existing landforms, vegetation, hydrology, wildlife or wildlife habitat value of critical areas.
