of a critical area and possibly because of potential soil runoff during our deck replacement.
However, the remedies for these concerns are minimal and easily done:
1) Removal of current deck will not affect ground surface at all. Current deck supports
are concrete blocks setting on the ground, not dug in.
2) The only disturbance for the replacement deck will be digging the 18" or 20"
diameter x 18" deep holes for the replacement deck's footings. If necessary, the dug
out soil can be removed and disposed of. (I like to keep my soil, as much as
possible.)
3) If necessary, a silt fence can be installed around the site.
4) There will be no extensive digging or soil movement and no elevation changes. Upon
completion, our back yard will look unchanged except for the new deck. In addition,
our back yard slopes NW, not SW toward the duck pond and stream.
5) The determination "Critical Area Present" means we cannot change proximity to it.
Rather, we can take steps to ensure we do nothing that affects or endangers it with
our activity. A Waiver is requested for our deck replacement.
