Good afternoon Bob,
A determination was made, albeit on a slightly different path, that the City will not require the Port to
post a construction performance bond for the proposed improvements. This decision is based off RCW
35A.21.250. For the purposes of this statute, the Port is considered to be a "unit of local government"
and therefore, a performance bond will not be required.
