This easement is appurtenant to property situated in Snohornisb Cotrrrty, Washington,
described as follows:
The East 380.73 feet of Tract 25 and Tract 26, Moadowdale Beach
SupplttnenW Plat, according to the plat thereof recprded in Volume 5 of Plats
Page 42, Rwards of SnaKomish County, TOGET MR WITH that portion Of
Tract 24, Mcadowdale Beach, according to the plat thereof recorded in Volume
5 of PIELU Page 39, Records of Snohomish County. described as follows-
BEGEININO at the Narthaast corner of Tract 24; Thence South 03*2V East of
164 feet to the TRUE POFNT OF 3'FGDR%-1 Q Thence North 89°57' west
parallel to the North Bouadary of Tract 24 430 feet, mare or lest, to a Point 120
feet East of the East line of the Co,mty load crossing said Tract 24 and I70 feet
distant therefrom 1 DO feet, more or Ins, to the South Boundary of Tract 24;

2_ Caryl also grants to Rumak, and to those acting under Rusnak, a temporary construction
easement of an addhional 10 feet on each side of above described easement.
Said construction easement shall remain in effect during constructiau and until such time as
the Line and appurtenances have been accepted for maintenance and operation by Rusuak,
but shall remain in effect no longer than 180 days from the commencement of construction.
3. Caryl sha]l retain the tight to use the surface of said easement, sa long as the use does not
interfere with the installation., operation, and maintenance of the Lire, and so long as no
permanent buildings or structures are erected on said easement.
This easement is granted with the understanding that the surface will be restored to a
condition substantially equivalent to its original condition capon cempietion of constraction
Rusnak also agrees to indemnify and hold harmless C&-yl fram I -lability arising from the
negligeatce of Ri=ak, and those acting wader Rusnak during the course of construction
contemplated herein.
