This letter is in response to that request. Shell Creek and the associated wetland on the eastern portion of your property constitute a critical area pursuant to Edmonds Community Development Code (ECDC) Chapters 23.40, 23.50, and 23.90. Removal of trees or vegetation within a critical area or critical area buffer is only an allowed activity when eliminating invasive species or hazardous trees, pursuant to ECDC 23.40.220(C)(8)(b). Removal of nuisance trees is not an allowed activity under the critical areas ordinance. Removal of trees #24 would constitute an alteration to a critical area and therefore requires application for a tree removal permit. As part of that application, a critical areas report compliant with ECDC 23.40.090, 23.50.030, and 23.90.020 would be required. The proposal would be reviewed under the criteria of ECDC 23.40.160. The submitted arborist report and Tree Risk Assessment Qualification form by a certified arborist satisfy the requirement of ECDC 23.40.220(C)(8)(b)(i) for the removal of hazardous trees, #1 and #5. As such, the removal of these trees #1 and #5 is approved, with the following conditions pursuant to ECDC 23.40.220(C)(8)(b): iii. All cut vegetation shall be kept within the critical area unless doing so poses a risk of pest or disease transmission. iv. Four replacement native trees shall be planted within the critical area within a year. Replacement deciduous trees shall be 1-2" DBH and conifers 6' tall. Replacement plantings are subject to inspection. See the Urban Forst Management Plan for an incomplete list of species native to Edmonds.
