City of Edmonds
Critical Areas Checklist
The Critical . Areas Checklist contained on
this form is to be filled out by any person
preparing a Development Permit
Application for the City of Edmonds prior
to his/her submittal of a development
permit to the City.
The purpose of the Checklist is to enable
City staff to determine whether any
potential Critical Areas are or may be
present on the subject property. The
information needed to complete the
Checklist should be easily available from
observations of the site or data available at
City Hall (Critical Areas inventories, maps,
or soil surveys).
An applicant, or his/her representative,
must fill out the checklist, sign and date it,
and submit it to the City. The City will
review the checklist, make a precursory site
visit, and make a determination of the
subsequent steps necessary to complete a
development permit, application.
With a signed copy of this form, the
applicant should also submit a vicinity map
or plot plan for individual lots of the parcel
with enough detail that City staff can find
and identify the subject parcel(s). In
addition, the applicant shall include
other pertinent information (e.g. site
plan, topography map, etc.) or studies in
conjunction with this Checklist to assist
staff in completing their preliminary
assessment of the site.
I have completed the attached Critical Area Checklist and attest that the answers provided are
factual, to the best of my knowledge (fill out the appropriate column below).

RE: Critical Areas Determination for 1402 loth Place North
CA-94-100
Dear Mr. Drogin:
LAURA M. HALL
MAYOR
I have reviewed your request for a conditional waiver for the proposed addition as shown on the site plan.
Since the proposed project does not increase the potential impact to the Critical Area or its buffer,
pursuant to Section 20.15B.040A of the Edmonds Community Development Code it is exempt from the
requirement to obtain a Reasonable Use Exception Variance.
Please be advised that work in addition to that which is described for this project in your letter dated June
29, 1994 may require further review to determine if a Reasonable Use Exception Variance is required.
You may now submit your application for a building permit for the proposed project. When submitting
for the subject permit, please bringa copy of this letter with your application for reference.
Should you have any questions, please contact me at 771-0220.
Sincerely,
9-ve &

I am writing to request a conditional waiver for the remodelling project
shown on the plat map and indicated by "proposed project". It is my
understanding that this project would be exempt from critical areas
determination as stated in section 20.1513.040 Subsection A Subparagraph
2 (A)(2), since such a remodelling activity would "not increase the
potential impact to a Critical Area or its buffer". As shown on the plat
map, the existing patio is within 5 feet of the stream and the existing
structure is within 12, 16 or 19 feet, depending on the respective corner.
The proposed addition would be a minimum of 28 feet from the stream.
I have enclosed a general information sheet, (to scale) plot plan, critical
areas checklist and determination. Thank you for your consideration. I
look forward to hearing from you and if you have any questions, please call
me at 266-0748.

Site Location: 1402 loth Place North Property Tax Acct #: 5951-000-007-02-09
Project Description:
Non -Project Specific
Waiver Criteria (all criteria must be found to apply):
XXX There will be no alteration of the Critical Area or its required buffers;
XXX The development proposal will not impact the Critical Area in a manner
contrary to the goals, purposes, objectives and requirements of the
Critical Areas ordinance;
XXX The development proposal meets the minimum standards of the Critical
Areas ordinance;
XXX The above findings are based on the following conditions of approval:
During review and inspection of the subject site on May 24, 1994 it was found that the site
contains a Category 2 stream with salmonoids and a Wildlife Habitat pursuant to Chapter
20.15B of the Edmonds Community Development Code.
Based on these findings, prior to submission of any development permit, you will be required
to submit the following for review by the Planning Department:
Name
1. Submit a site plan prepared by a Licensed Surveyor showing the location of the
Category 2 stream and delineating the required 50-foot buffer and 15-foot
additional building setback. The 50-foot buffer is measured on each side of the
stream from the top of the bank, with the additional building setback line
measured from the edge of the buffer.
2. If the results of the above survey determine the lot unbuildable or that no
addition/alteration may be done due to the buffer/setback area, any development
which is not identified as an exception per ECDC Chapter 20.15B must receive
a Reasonable Use Exception or a Variance pursuant to ECDC 20.15B.180A and
20.15B.040C).
