Council Member Chen seconded. Motion carried unanimously. Chair Jones discussed the $19,000 professional services charge from the last meeting. Ms. Cain confirmed the charges were for actuarial services. BUSINESS Finance Q&A Council Member Chen asked a question about ending fund balances and how they are determined in regard to the LEOFF and Fire BARS funds. Deputy Director Dunscombe explained how fund balances are determined. WSLEA Conference Recap Chair Jones provided a recap of the recent WSLEA Conference and status of the state retirement funds. Other • 2024 Q3 meeting scheduled for July 22nd at 11:00 a.m. in person. • Board member Jones proposed an escalation clause for reimbursement amounts to be increased annually based on the state cost of living increase. Council member Chen seconded the motion to create a draft policy. Motion passed unanimously. Ms. Derrick will work with legal to provide a draft policy by the next regularly scheduled meeting. The Disability Board, which has previously updated individual Policies to increase annual caps as needed, has determined that it is appropriate to provide for the automatic increase of all reimbursement caps in the Policies on an annual basis. As of the effective date of this Policy, all reimbursement caps provided for in the Policies will increase on April 1 of each year by the COLA percentage established by the Washington State Department of Retirement Systems for LEOFF Plan 1 for the retirement date that is closest to that of the City's last LEOFF 1 retiree's retirement date. Beginning the effective date of this Policy through March 31, 2025, the following Policies' annual reimbursement caps shall be as follows: • Dental Expenses (Policy #02-05) — $738.64 • Vision Services (Policy #03-02) — $237.42 • Payment of Annual Co -Insurance (Policy #09-13) — $1,055.20 • Reimbursement for Prescriptions for Male & Female Sexual Dysfunction (Policy #13- 17) — $263.80 NOTE: This policy will be reviewed by the Disability Board on an annual basis. The request for this new Policy seemed like a simple request until I started drafting it. However, applying this new Policy to the Policies that contain a reimbursement cap created some issues that will need to be addressed. My understanding is that the Board intends to update the reimbursement dollar amounts on April 1 of each year. If that is correct, and the Board intends to continue providing clear information on the amount of these caps, this draft Policy as it relates to the other Policies creates the following issues: 1. There are currently four Policies that include a dollar amount reimbursement cap (Dental, Vision, Annual Co -Pay, and prescriptions for sexual dysfunction medications). As I see it, the Board can take a couple of different approaches to providing LEOFF 1 retirees/the public with clear information on the amount of these annual caps: a. The Board may use the draft Policy as it is currently drafted to specifically call out those four Policies and state the amount they are being updated to in 2024. If the specific amounts are included in the Policy, I would recommend updating this Policy annually to provide transparency on the current caps, as well as revising the four affected Policies to remove the dollar amounts and instead refer to this Policy for the most recent reimbursement cap information. b. The Board may decide to remove that section of the current draft Policy and provide the specifics about these caps in another place that is easily accessible, such as the Disability Board web page on the City website (which will need to be updated annually, as well). If the Board goes this route, I would still recommend revising the four affected Policies to remove the dollar amounts and refer to that source for the most recent reimbursement cap information. 2. Having an "annual" reimbursement amount that runs April 1 to March 31 and Policies that define "annual" as January 1 through December 31 (or "calendar year" as one of these Policies provides) creates confusion about what reimbursement amount applies throughout the year. The Board will need to decide whether to: a. Apply the DRS COLA percentage amount starting April 1 and revise the four Policies to define "annual" as April 1 through March 31; b. Retain the January 1 through December 31 definition of "annual" and either apply the DRS COLA percentage amount starting January 1 of the following year or clarify that two reimbursement caps will apply throughout the calendar year— one from January 1 through March 31 and one from April 1 through December 31. 3. Because this Policy is being adopted mid -calendar year 2024, these increased caps will only apply to "annual" reimbursements that members apply for July -December 2024 unless the Board decides to make this Policy retroactive to January 1, 2024 or to apply a hybrid cap for 2024 (e.g., apply an average of the two caps for the whole calendar year, or apply the earlier cap to reimbursements for goods/services received January 1 through March 31 and the revised cap for reimbursements for goods/services received April 1 through December 31). This could create additional reimbursement work for requests that have already been submitted this year. I should point out that the Board may choose to avoid all of the above issues and instead consider adopting one of the following alternative courses of action: 1. Update each of these four Policies annually to increase the caps by the appropriate DRS COLA percentage amount. 2. Since all other Policies addressing reimbursement determine the appropriate amount by some other method (Costco price (hearing aids); Social Security Administration benefit statement (Medicare premium reimbursement); case -by -case based on quotes (long-term care) or actual costs (medical services & equipment); and generic drug prices (prescription co -payments), the Board could instead decide to adopt a similar type of non -dollar -amount reimbursement system for these four Policies, as well, which would eliminate the need for any annual updates to reimbursement caps. Finally, I included a note in draft Policy to refer to this email for an explanation as to why I drafted some of the Policy language the way I did. Here is that explanation: The Department of Retirement Services website (see https://www.drs.wa.gov/life/retired/cola/) includes a table for the COLA percentages for LEOFF Plan 1 that are updated April 1 st of each year. This table (see below) lists different COLA adjustments depending on retirement date: COLA percentages for LEOFF Plan 1 (effective April 1, 2024) April 2, 2023 - March 31, 2024 0.00% January 1, 2023 - April 1, 2023 5.52% April 2, 2022 - December 31, 2022 14.81 % Prior to April 2, 2022 5.52% LEOFF Plan 1 COLAs are effective April 1 and included with April 30 benefit payments. My understanding is that all of the City's LEOFF 1 retirees retired many years ago, so the only COLA percentage that would apply to the City's retirees would be the last one on the list. This is why I included language in the policy to clarify that it is the COLA percentage relating to the last retirement date in this table that will be used ("the retirement date closest to that of the City's last LEOFF 1 retiree's retirement date"). I would recommend following up with the Department of Retirement Systems (DRS) regarding exactly how the funding of liabilities for the LEOFF 1 plan works in practice. My understanding (see attached RCW 41.26.080) is that the City's funding of LEOFF 1 ended in June 2000. However, if the LEOFF 1 plan has unfunded liabilities, this statute states that they will be funded as provided in Chapter 41.45 RCW. That statute addresses how those liabilities will be funded (see attached RCW 41.45.010 regarding the statute's intent and goal) but the information provided is dense and is likely clarified by internal DRS rules that I haven't been able to locate. However, I believe that whether the City may be absolved of further funding of its fire retirees' disability liabilities by the City having the Regional Fire Authority take over its fire protection services may depend on how unfunded liabilities (if there are any) are funded. If they are funded by employer contributions, Edmonds' responsibility for funding LEOFF 1 Disability liabilities would depend on whether the firefighters protecting the Citywould be considered the employees of the City or the RFA. 2. The Disability Board would not be dissolved whether the City's decision to join the RFA would absolve it of funding LEOFF 1 fire retirees' liabilities or not. RCW 41.26.110 (copy attached) requires all cities having a population of 20,000 or more to establish a LEOFF 1 disability board. All counties must establish a LEOFF 1 disability board for the employees of all cities under that population. These boards are required to carry out all of the responsibilities of Chapter 41.26 RCW for LEOFF retirement plan members. 3. The City is legally required to maintain its LEOFF 1 Disability Board whether it represents Law Enforcement and Fire or just Law Enforcement pursuant to RCW 41.26.110. 4. The attached RCWs should help clarify the need for the City to maintain its Disability Board, and to start to explain how LEOFF 1 plan liabilities are funded. The Board recently approved that any current policies that have reimbursement caps (i.e. Dental, Long - Term Care, Medical Services, Hearing Aids, etc) to have an escalation factor that reimbursement would be increased annually based on the State COLA (this is determined by DRS every April 1). This would go into effect once the Board approves the language of the policy at the next meeting (which is scheduled for July 22nd — so no rush on this).
