Background/History
On June 26, 2024, Gary Muskett of Northwest Garden & Stone applied for a Conditional Use Permit
(CUP) to allow for outdoor storage associated with a garden and stone store (file number PLN2024-
0054). The applicant proposes outdoor nursery areas and hardscape areas. Nursery areas will contain
potted plants, pots, and fountains for sale. Hardscape areas will contain pavers, stones, wall blocks, and
flagstone for sale stored on pallets.
The site is located within the Neighborhood Business (BN) zone. The BN zone conditionally permits
outdoor storage as a secondary use, incidental to a permitted or conditional use (ECDC 16.45.010(D)(1)).
The associated retail store is a permitted primary use in the BN zone (ECDC 16.45.010(A)(2). ECDC
20.01.003 categorizes CUPS as Type III-B decisions made by the Hearing Examiner following a public
hearing.
Staff Recommendation
Staff recommends that the Hearing Examiner approve the requested Conditional Use Permit with the
conditions listed in Section IX of the attached Staff Report.
Narrative
The Staff Report and Attachments 1-13 provide an analysis of the project proposal and staff
recommendation.

SUMMARY OF PROPOSED ACTION
Gary Muskett of Northwest Garden & Stone applied for a Conditional Use Permit (CUP)
to allow for outdoor storage associated with a garden and stone store. The applicant
proposes outdoor nursery areas and hardscape areas. Nursery areas will contain potted
plants, pots, and fountains for sale. Hardscape areas will contain pavers, stones, wall

S. Zoning: The site is zoned Neighborhood Business (BN).
6. Request: The applicant seeks a CUP to store and display plants, pots, fountains,
garden art, and hardscape goods outdoors, pursuant to ECDC 16.45.010(D)(1).
7. Review Process: PLN2024-0054 is a Type III-B permit. For CUP applications that
require a public hearing (Type III-B decision), staff reviews the proposal and makes a
recommendation to the Hearing Examiner on whether the proposal is consistent
with the CUP criteria of ECDC 20.05.010, zoning ordinance, and the City's
Comprehensive Plan. Following a public hearing, the Hearing Examiner makes the
final decision on the CUP.
8. Lot Size: The subject lot is 19,602sf (0.45 acres).
9. Existing Use: The current use is a garden and stone retail store (indoor only).
10. Proposed Use: The applicant proposes outdoor storage associated with a garden and
stone retail store.
APPLICATION SUBMITTAL
The City received the land use application for PLN2024-0054 on June 26, 2024
(Attachment 2). The applicant also submitted a site plan and criteria compliance letter.
Upon request from the Planning Division, the applicant submitted an updated criteria
statement on July 3, 2024 (Attachment 3). Staff deemed the application complete
pursuant to ECDC 20.02.003 on July 9, 2024 (Attachment 4).
After initial review of the application material, staff provided corrections on August 9,
2024, with comments from the Planning, Building, Engineering Divisions (Attachment 5).
The applicant provided corrections on August 14, 2024, including a response letter
(Attachment 6), updated site plan (Attachment 7), and example picture (Attachment 8).
SEPA THRESHOLD DETERMINATION
Review under the State Environmental Policy Act (SEPA) is not required with this
application. WAC 197-11-800(6) categorically exempts land use decisions from threshold
determination and EIS requirements.
III. PUBLIC NOTICE AND COMMENTS
In accordance with ECDC 20.03, staff mailed a Notice of Application dated July 11, 2024,
with a comment period ending on July 25, 2024, to property owners and taxpayers
within 300 feet of the subject site using a staff -generated mailing list. Staff posted the
Notice online on the City's website, in The Everett Herald newspaper, and at the subject
site, the Public Safety Complex, and the Planning and Development Department on July
11, 2024. The Notice of Application and associated documentation of compliance with
the public notice requirements is included as Attachment 9.

Planning staff received one comment. Christa and Todd Johnson expressed concern over
the potential noise generated from the proposed use. See Attachment 10 for the
unabridged comment.
Staff response: Noise is regulated in Chapter 5.30 of the Edmonds City Code (ECC) and
the property performance standards in ECDC 17.60. Refer to the 'Not Detrimental'
criterion on page 10 of the staff report for further analysis.
The Notice of Public Hearing, dated September 26, 2024, was published in The Everett
Herald newspaper, and posted at the subject site, Public Safety Complex, and the
Planning and Development Department. The notice was also posted on the City's
website and mailed to property owners on September 26, 2024, using a staff -generated
mailing list. The Notice of Application and associated documentation of compliance with
the public notice requirements is included as Attachment 11.
IV. TECHNICAL COMMITTEE
The City's Building and Engineering Divisions, and South County Fire evaluated this
application.
The Building Division required the applicant to apply for a building permit for any new
striping associated with the parking area proposed. See Attachment 12 for the memo
from the Building Division. The City has received the parking lot permit (BLD2024-1148)
on September 6, 2024, and is processing the application.
The Engineering Division determined that the proposal is consistent with engineering
standards in Title 18 ECDC and provided two conditions. See Attachment 13 for the
Engineering Compliance Memo.
South County Fire approved the proposal with no conditions.

1. Critical Areas: A critical area determination is not required in association with this
land use permit. Any changes to the site proposed in the future that require ground -
disturbing work would require a critical area determination for the site.
2. Shoreline: The subject property is not located within shoreline jurisdiction.

VI. NEIGHBORHOOD CHARACTERISTICS
The subject site is zoned Neighborhood Business (BN) and is developed with a 1,204 sq.
ft. commercial structure and an 875 sq.ft. carport. The subject property is located on the
corner of 242nd St. SW and 761" Ave. W. East of the property, across 76t" Ave. W, and
north of the property, across 242nd St. SW, are zoned Single -Family Residential (RS-8)
and are developed with single-family homes. Adjacent parcels to the west and south are
zoned Neighborhood Business (BN) and are developed with a church and associated
improvements.
The Comprehensive Plan designates this site Neighborhood Commercial. The
Comprehensive Plan contains the following goals and policies applicable to this
proposal:
Commercial Development Goal A. Commercial development in Edmonds shall be
located to take advantage of its unique locational opportunities while being consistent
and compatible with the character of its surrounding neighborhood. All commercial
development should be designed and located so that it is economically feasible to
operate a business and provide goods and services to Edmonds residents and tourists in
a safe, convenient and attractive manner, in accordance with the following policies:
A.1 A sufficient number of sites suited for a variety of commercial uses should
be identified and reserved for these purposes. The great majority of such
sites should be selected from parcels of land already identified in the
comprehensive plan for commercial use and/or zoned for such use.
A.2 Parcels of land previously planned or zoned for commercial use but which
are now or will be identified as unnecessary, or inappropriate for such use
by additional analysis, should be reclassified for other uses.
A.3 The proliferation of strip commercial areas along Edmonds streets and
highways and the development of commercial uses poorly related to
surrounding land uses should be strongly discouraged.
A.4 The design and location of all commercial sites should provide for
convenient and safe access for customers, employees and suppliers.
A.5 All commercial developments should be carefully located and designed to
eliminate or minimize the adverse impacts of heavy traffic volume and
other related problems on surrounding land uses

A.6 Special consideration should be given to major land use decisions made in
relation to downtown Edmonds.
Commercial Development Goal C. Neighborhood Commercial areas are intended to
provide a mix of services, shopping, gathering places, office space, and housing for local
neighborhoods. The scale of development and intensity of uses should provide a middle
ground between the more intense commercial uses of the Highway 99 Corridor/ Medical
area and the Downtown Activity Area.
Historically, many of the neighborhood commercial areas in Edmonds have developed as
classically auto -oriented commercial "strip malls" with one- and two-story developments
primarily including retail and service uses. Throughout the region, neighborhood
commercial areas are departing from this historical model by being redeveloped as
appealing mixed -use clusters, providing attractive new pedestrian -oriented development
that expands the uses and services available to local residents.
C.1 Neighborhood commercial development should be located at major arterial
intersections and should be designed to minimize interference with through
traffic.
C.2 Permit uses in neighborhood commercial areas that are intended to serve
the local neighborhood. Mixed use development should be encouraged
within neighborhood commercial areas.
C.3 Provide for transit and pedestrian access, with the provision of facilities for
local automobile traffic. Provide for pedestrian connections to nearby
residential neighborhoods.
C.4 Allow a variety of architectural styles while encouraging public art and
sustainable development practices that support pedestrian activity and
provide for appealing gathering places.
C.5 Significant attention should be paid to the design of ground level
commercial spaces, which must accommodate a variety of commercial
uses, have street -level entrances, and storefront facades that are
dominated by transparent windows.
Staff Analysis: The City considered the goals and policies of the Comprehensive Plan
when crafting the allowed uses and standards for the BN zone listed in Chapter 16.45
ECDC. Accordingly, the uses permitted in the BN zone reflect the above listed

Comprehensive Plan goals and policies related to providing opportunities for safe and
convenient commercial spaces to provide goods and services for the community.
The applicant proposes to serve the community by providing a variety of home and
garden goods for purchase. The proposal reestablishes a commercial use on a property
zoned for commercial development without rezoning or major redevelopment.
No significant adverse traffic impacts are expected to the surrounding area. The
applicant anticipates no more than 25 vehicle trips in the peak drive hours and the City's
Engineering Division required no traffic study.
Based on the above analysis, staff finds that the proposal is a compatible land use with
the referenced Comprehensive Plan policies and the Neighborhood Commercial
Comprehensive Plan designation.
Vill. APPLICABLE CODES
1. ECDC 16.45 (Neighborhood Business, BN zone)
ECDC 16.45 establishes the allowed uses and site development standards
applicable to the Neighborhood Business zone.
Staff Analysis: Neighborhood -oriented retail uses, like the associated garden
and stone store, are primary permitted uses in the BN zone. Outdoor
storage, such as the proposed outdoor storage, is a permitted secondary use
requiring a conditional use permit.
Staff finds that the proposal is consistent with the BN zoning and site
development standards.
2. ECDC 17.50 Off Street Parking Regulations
ECDC 17.50 establishes off-street parking requirements.
Staff Analysis: Per ECDC 17.50.020(B)(1), retail stores require a minimum of
one parking space per 300 square feet. Additionally, per ECDC
17.50.020(B)(12), outdoor retail areas for plant nurseries require a minimum
of one space per 500 square feet of outdoor retail area. The indoor retail
store is 687.5 sq. ft., which requires two spaces. The proposed outdoor retail
area is 3,015 sq. ft., which requires six spaces. Code thereby requires eight
spaces for the proposed use. The site plan submitted with the CUP
application and the parking lot permit shows 15 spaces, including one ADA
stall.
Staff finds that the proposal is consistent with ECDC 17.50.
3. ECDC 17.65 Limited Outdoor Disolav of Merchandise
ECDC 17.65 establishes limits on the outdoor display of merchandise in
conjunction with a legally operating business. Pursuant to ECDC 17.65.010,

outdoor display of merchandise must adhere to the standards listed below.
These standards will continue to apply as long as the use is active, and any
later noncompliance may lead to enforcement action.
A. The limited outdoor display of merchandise shall only be permitted in
conjunction with an existing permitted use which occupies the subject
property. Display items shall be limited to merchandise sold by the
business or decorative items which relate to or complement the business.
Display items shall not include signage which would otherwise require a
sign permit under Chapter 20.60 ECDC.
Staff Analysis: The proposed outdoor display of merchandise is in
conjunction with a permitted use on the subject property. The applicant
has not proposed to display items beyond merchandise sold by the
business or decorative items related to the business. Staff finds the
proposal is consistent with this standard.
B. An outdoor display or merchandise shall:
a. Permit free access to all buildings and comply with access
requirements imposed by the State Building Code as the same
exists or is hereafter amended including, but not limited to, the
Uniform Fire, Building and Barrier Free Codes; and
b. Not to be placed in or on street furniture, parking meters, public
signage, planter boxes, turf, dirt or landscaped areas nor beyond
the edge of the business' street frontage.
Staff Analysis: Staff review found the proposal does not conflict with
access requirements. Staff finds the proposal is consistent with this
standard.
C. Displays within the public right-of-way shall require an encroachment
permit under Chapter 18.70 ECDC and shall comply with all conditions
applicable to such a permit. When located within the public right-of-way,
display items shall be placed adjacent to the building and may encroach
onto a maximum of two feet of the public sidewalk, except, however, that
all clear zones identified as part of the encroachment permit shall be
maintained. The outside area should be continuously supervised by the
business to ensure that all clear zones are maintained.
Staff Analysis: The applicant proposed no displays within the public right-
of-way. This standard is therefore not applicable.
D. All sales transactions shall occur inside the building.

Staff Analysis: The applicant proposed no exterior sales transactions. This
standard is not applicable.
4. ECDC 17.60 — Property Performance Standards
ECDC 17.60 establishes reasonable limits on property performance standards
(such as noise, dust, vibration, and other similar emissions) produced by a
given use which are evident at the exterior of the site.
Staff Analysis: ECDC 17.60.030 lists the specific standards. The subject
property, like all properties within the City of Edmonds, must comply with
these standards. These standards will continue to apply as long as the use is
active, and any noncompliance may lead to enforcement action.
Of particular relevance to this proposal is ECDC 17.60.030(H) Open Storage,
which requires that all open storage shall be located in the side or rear yard
and screened by a solid fence or vegetative barrier of at least five feet in
height. Yard refers to the area within a setback. As a corner lot, the property
has street setbacks from 242nd St. SW and 76t" Ave. W and side setbacks off
the western and southern property lines (ECDC 16.45.020). Corner lots have
no rear setback (ECDC 21.15.100).
Per ECDC 16.45.020(A), the street setback for the BN zone is 20'. Therefore,
no open storage is allowed within 20' of the property lines along 242nd St. SW
and 76t" Ave. W. Per ECDC 16.45.020(A), there is no side setback for the BN
zone. As a result, open storage can be located up to the southern and
western property lines. Solid screening along the southern and western
property lines is included as a condition of approval for compliance with

With storage not to be located within the street setback areas and screening
along the southern and western property lines required as a condition of
approval, staff finds that the proposal is consistent with ECDC 17.60.
5. ECDC 20.05 — Conditional Use Permits
Pursuant to ECDC 20.05.010, no CUP may be approved unless all the
following findings can be made:
A. Comprehensive Plan. That the proposed use is consistent with the
Comprehensive Plan.

Staff Analysis: Staff finds that the proposal is consistent with the
Comprehensive Plan. Please refer to Section VII of this report for further
discussion on consistency with the Comprehensive Plan.
B. Zoning Ordinance. That the proposed use, and its location, is consistent
with the purposes of the zoning ordinance and the purposes of the zone
district in which the use is to be located, and that the proposed use will
meet all applicable requirements of the zoning ordinance.
Staff Analysis: The proposed primary use is a garden and stone store, which
is a permitted primary use in the BN zone. The proposed outdoor storage is
allowed as a secondary use and requires a Conditional Use Permit. Therefore,
if approved, this proposed land use within the existing developed
structure/site would be consistent with the purposes of the BN zone.
C. Not Detrimental. That the use, as approved or conditionally approved,
will not be significantly detrimental to the public health, safety and
welfare, and to nearby private property or improvements unless the use is
a public necessity.
Staff Analysis: The proposed outdoor storage should not significantly impact
the public health, safety and welfare, and to nearby private property or
improvements. The associated primary use is permitted outright, and the
proposed outdoor storage is permitted as a secondary use with a Conditional
Use Permit. The proposed outdoor storage, as well the primary retail use, is
required to comply with all the City's property performance standards listed
in ECDC 17.60, as well as the City's maximum permissible sound levels
established in ECC 5.30. Additionally, the proposed outdoor storage will need
to comply with all standards for outdoor display of merchandise listed in
ECDC 17.65.010 to ensure it creates no public health or safety hazard nor
public nuisance.
Staff finds that the proposal to allow for outdoor storage, as conditioned
below, is not detrimental to the public health, safety and welfare, or to
nearby property owners.
D. Transferability. The hearing examiner shall determine wither the
conditional use permit shall run with the land or shall be personal. If it
runs with the land and the hearing examiner finds it in the public interest,
the hearing examiner may require that it be recorded in the form of a
covenant with the Snohomish County auditor. The Hearing Examiner may
also determine whether the conditional use permit may or may not be
used by a subsequent user of the some property.
Staff Analysis: The applicant did not request the CUP to be transferable and
run with the land. This criterion is not applicable.

IX. STAFF RECOMMENDATION
Based on the analysis within and the attachments included with this report, staff finds
the proposal is consistent with the CUP criteria for approval listed in 20.05.010, the
Comprehensive Plan, and the Zoning Ordinance. Staff recommends that the Hearing
Examiner APPROVE the requested Conditional Use Permit (File No. PLN2024-0054) with
the following conditions:
1. The applicant must apply for and obtain all necessary building permits which are
subject to the applicable requirements in the Edmonds Community Development
Code. It is the responsibility of the applicant to ensure compliance with the various
provisions contained in the ordinances.
2. The applicant is responsible for seeking and obtaining all required local, state and/or
federal permits or approvals applicable to the proposal.
No outdoor storage is to be located within 20' of the property lines adjacent to 242nd
St. SW and 761h Ave. W.
4. Solid screening must be installed on the southern and western property lines prior
to the outdoor storage commencing. This could include solid or slatted fencing,
vegetative screening, or a similar screening technique.
5. Outdoor storage must not reduce drive aisle widths below 24-ft or create sight
distance issues when exiting the site on 242nd St. SW.
6. Outdoor storage must comply with all standards listed in ECDC 17.65.010 for
outdoor display of merchandise.
7. The CUP is personal to Northwest Garden and Stone.
X. RECONSIDERATION
According to ECDC 20.06.140, a party of record may submit a request to reconsider a
Type III-B decision to the Planning and Development Director within 10 days after the
date of issuance of the decision. The request must be made in writing and include all
required information stated in ECDC 20.06.140(D) as well as the applicable fee.
XI. APPEAL
Pursuant to ECDC 20.06.030, a party of record may submit a written appeal of a Type III-
B decision to the Planning and Development Director within 14 days after the date of
issuance of the decision. The appeal shall be made in writing and shall include all
required information stated in ECDC 20.06.030(D) as well as the applicable fee. The
appeal would be heard at a closed record hearing before the City Council according to
the requirements of ECDC Chapter 20.06.120.
XII. TIME LIMIT AND EXTENSION

Unless the owner obtains a building permit or, if no building permit is required,
substantially commences the use allowed within one year from the date of approval, the
CUP shall expire and be null and void, unless the owner files an application for an
extension of time before the expiration date. (ECDC 20.05.020.(C))
An application for any extension of time shall be reviewed by the community
development director as a Type II decision. (ECDC 20.05.020(D))

Outdoor Retail Area:
Thank you for submitting a site plan showing the proposed nursery area and customer parking. To
ensure compliance with ECDC 17.50.020, please update the site plan to show the size of the
proposed outdoor storage/retail area. Per ECDC 17.50.020(B)(12), one parking space per 500
square feet of outdoor retail area is required. This is in addition to the one required parking space
per 300 square feet of indoor retail space per 17.50.020(B)(1).
2. Please provide a brief description of the proposed `Hardscape Areas' and `Nursery Areas' shown
on the site plan. Do they contain they goods to be sold? If so, what kinds of goods? Are they
landscaped areas with no goods for sale? If so, what types of trees and plants?
Please submit the above information through the MyBuildin Pg ermit portal as soon as possible so that
staff may continue processing your application. According to ECDC 20.02.003.D the above requested

1. Show the area with dimensions and property lines on the plans. Please note that no
more than 50% of the frontage can be parking/driveway.
2. Please show the access point(s) and the width of each, parking spaces at standard
size (8.5x16.5). Note that the required number of parking spaces will be able to be
provided on the site.
3. Show the travel path of vehicles through the site (one way aisles, two way entrance
or exit, etc.)
4. Will this use of the property increase trips more than 25 in the peak drive hours?
If so, a traffic study may be required. Please see the Transportation Impact
Handout for more information. Our transportation engineer, Bertrand Hauss, will
determine whether there is a need for that once he reviews your next submittal.

plans that were submitted under the referenced application number and have the following
comments.
1. The site plan provided in the proposal indicates a new customer parking area is proposed
on the south edge of the property. We are unable to locate records showing parking in
this area, thus a parking lot permit (building permit) will be required for any new striping,
including that for accessibility purposes.

Engineering has reviewed the subject application and found the information provided is
consistent with Title 18 Edmonds Community Development Code & Engineering standards.
Compliance with Engineering codes and construction standards will be reviewed with any
future building permit application for development on the site.
Outdoor storage areas shall not reduce drive aisle widths below 24-ft or create sight distance
issues when exiting the site onto 242nd St SW. Parking lot layout to be reviewed under
separate parking lot striping plan (BLD2024-1148).
