RFA Annexation Consideration Update Packet Pg. 2 2.2 City Council Agenda Item Meeting Date: 10/15/2024 Green Building Incentives Staff Lead: Green Building Incentives Code Amendments Department: Planning & Development Preparer: Tristan Sewell Background Edmonds' 2020 Comprehensive Plan identified green building incentives as necessary to achieve the climate change goals. Implementing this, Edmonds' 2023 Climate Action Plan reaffirms that an incentive program is necessary to achieve climate neutrality. The Climate Action Plan aims to restrict the global average temperature increase to +1.5°C by Edmonds achieving climate neutrality by 2050. Over half of Edmonds' local climate pollution stems from buildings. Of those, two-thirds come from residences. Staff began the legislative process with the proposed code amendments in January 2024. Please refer to previous agenda memoranda and meeting materials for greater details. At this Special Meeting, staff will provide more illustrative analysis of the proposed incentives. Staff previously prepared 3D models of the existing baseline regulation to illustrate the changes proposed by the tiered residential incentives for both single- and multifamily development. Staff will explain the limitations and assumptions made when formulating these illustrations. Planning Board Recommendation The Planning Board recommends the attached draft code amendments to Council after a vote in favor at their July 24, 2024, meeting. See the attached memo addressing this recommendation. Climate Protection Committee Recommendation The Mayors' Climate Protection Committee recommends the attached draft code amendments to Council after a vote in favor at their October 3rd, 2024, meeting. See the attached memo addressing this recommendation. Narrative Market conditions perpetuate inefficient, unsustainable land use, design, and construction in Edmonds. 'Green' building practices can conserve resources, improve quality of life and health outcomes, reduce total cost of ownership. However, costs often outweigh these benefits, so by offering valuable incentives, Edmonds would encourage patterns of development more compatible with climate neutrality that would not occur under standard market conditions. Proposed incentives include expedited permit review, increased building heights and density, reduced parking requirements and setback distances. The current development code includes some 'green' building land use incentives, such as increased building height, in limited instances. The proposed amendments learned from these often -overlooked incentives as examples of insufficient tradeoffs for the requested level of certification. Packet Pg. 3 2.2 The use of the proposed third -party certifications reduces staff workload and improves compatibility with other local 'green' building programs. The proposed incentives should enable 'greener' development not otherwise achievable with standard regulations in exchange for increased value to property owners, whether financial or based in the intangibles. The proposed certifications' point -based nature and holistic approach to sustainability enables each development to pursue a unique path to certification best fit for its specifics. This was intended to address the fact that Edmonds' buildings produce a third of greenhouse gas emissions within Edmonds. m (Edmonds 2017 GHG Inventory, p. 12). Green buildings reduce those greenhouse gas emissions as a� well as reduce electricity consumption. The program discussed in this memo implements action BE-2.2 of the Climate Action Plan. _ The Proposed Green Building Program The proposed Green Building Program provides developers incentives if they construct buildings that meet the requirements for a Built Green 4-star certification, and obtain that certification. Incentives The proposed incentives for the program include: • Expedited permit review • Additional 5 feet in height • Smaller setbacks, matching the setbacks of the next smallest zone (for example, an RS-12 site would have to meet RS-10 setbacks) • Reduced parking requirement to 1 space per unit • Additional 5% of structural lot coverage for ADUs Penalties If a developer participated in the program by constructing a building and received the incentives, but failed to obtain a certification, the builder would be penalized in the form of forfeiting to the City of Edmonds bonds equaling: • 50% of the building permit fee, and • 5% of the project valuation Planning Board Review and Public Comment The Planning Board met with staff from the Planning and Development Department on four separate occasions between January and July 2024 to discuss a staff proposal for a new Green Packet Pg. 26 2.2.c Building Incentives program. These Planning Board meetings included a public hearing held on June 12. Staff shared the objectives, proposed methods and desired outcomes of the program in presentations to the Board members. The Planning Board members discussed the program following the staff presentations. While Planning Board members thought staff performed sufficient research and outreach and involved the appropriate stakeholders, there was much discussion about the incentives and penalties proposed for the program. Staff provided refinements to the proposed penalties as a result of Planning Board input to have penalties that are appropriately scaled.
