This letter is to provide you with an explanation of the scope of work under this permit and provide information to assist you in complying with the City's requirements for development. In keeping with the court order of May 14, 2021 we have limited the scope of this permit to the demolition of the retaining walls and other encroachments that occur on the right of way land adjacent to your property. Unfortunately, the City has not received from you all of the required documentation by which we might have been able to include in this permit your other site improvements such as the new patios, pond and shed; thus, we have separated the work done on your property from the work done in the right of way into two separate permits in order to ensure that you may meet the deadline to obtain the permit as per the court order. Please review all of the city -approved plans, conditions and other documents issued with your permit. You will notice that on -site monitoring by Nelson Geotechnical is required for all aspects of the work, including the demolition methods, removal and replacement of undocumented fill and restoration of the landscaping. Also, please schedule a pre -construction inspection as soon as possible, which is an on - site meeting with City inspectors designed to assist you in understanding the inspection process and other City development requirements. Please plan to have a representative from Nelson Geotechnical in attendance as well as yourself or your project representative if you have one. Please note that the court order requires that the work under the permit must be completed and approved by the City within 60 days after obtaining the permit, which effectively is September 13, 2021. Failure to obtain final City approval by that date will constitute a violation of the court order and will result in further enforcement action by the City. As stated above, you still need to provide additional documentation before we can issue a permit for the other site improvements on your property such as the new patios, pond and shed. Specifically, the following comments have been provided from the Planning Division, and still need to be addressed: • Incorporated August 11, 1890 • Sister City - Hekirmn, Japan As noted on during review of the demolition permit for the retaining, other unpermitted improvements on the property were identified. These include a hardscape patio, trellis, shed and pond. Attached are the site plan and landscape plan from building permit BLD19910617 which show the extent of permitted improvements. Two aerial photos are attached with the 2013 aerial photo showing the original permitted improvements and the 2020 aerial photo showing the unpermitted activity. Also attached is a site plan from the demolition permit with the unpermitted improvements highlighted in red. Pursuant to ECDC 16.20.040.C, uncovered and unenclosed porches, steps, patios, and decks may project into a required setback not more than one-third of the required setback, or four feet, whichever is less, provided, that they are no more than 30 inches above ground level at any point. The property is located in the RS-12 zone which has a 25 foot rear setback. All of the lower patio area is located within 21 feet of the property line and thus not compliant with ECDC 16.20.040.C, as a result the patio must be removed. The shed is less than 600 square feet, so it may be located within 5 feet of the rear property line. The pond may be retained as a landscape feature, however, there were some recommendations in the geotechnical report related to drainage around the pond. Page 4 of the Nelson Geotechnical Associates October 15, 2020 report noted: Significant seepage was encountered below the rockery, which is below the pond and shed. The soils above the pond on the slope were dry to moist, with no perched water. As a result we recommend that the drainage practices around the pond be investigated and improved. This could entail installing a level spreader to help disperse runoff over a larger area. Under no circumstances should water be allowed to flow freely over and concentrate on the site slopes. If the pond is to be retained these recommendations must be addressed. Note the October 22, 2020 comment letter also provided if the pond will remain, more information is needed as to the water supply. Indicate on the site plan how the pond is filled (via garden hose and yard facet, or plumbing with a direction connection, etc.) and drained. Indicate any other built systems serving the pond such as recirculation, filtering, heating, etc. In addition, to the above comments from the Planning Division, please also respond to the attached plan review comment letter from the Engineering Division dated November 24, 2020. Comment number 1 within the letter is specific to work within BNSF right-of-way; however, the remainder of the comments will need to be addressed with the required second permit. The scope of work for improvements covered under the second permit will be included in permit number BLD2021-0939 (already established by the most recent submittal.) In order to avoid enforcement action by the City, please provide the requested information to the City no later than July 27, 2021. Then, once the submittal is approved, you will need to pay for and obtain the second permit within one week of notification by the City, and then complete the work and receive final inspections and approvals by the City no later than September 30, 2021.
