Mitchell and Trieu are sometimes referred to each as a "Party" and collectively as the "Parties." O RECITALS WHEREAS, Mitchell owns the parcel of real property having the common street address of 7019 Lake Ballinger Way, Edmonds, WA 98026-8544, tax parcel number 00488800801000, and legally described as: Lot 10, Block 8, Lake Ballinger Land Co.'s Plat Subdivision No. 1, according to the plat thereof recorded in Volume 9 of Plats, pages 57 through 58 inclusive, records of Snohomish County, Washington, except that portion for State Highway 104, and together with the shorelands of the. second class abutting thereon, situated in the County of Snohomish, State of Washington (the "Mitchell Parcel'). WHEREAS, Trieu owns the parcel of real property having the common street address of 7011 Lake Ballinger Way, Edmonds, WA 98026-8544, tax parcel number 00488800801100, and legally described as: Lot 11, Block 8, Lake Ballinger Land Co.'s Plat Subdivision No. 1, according to the plat thereof recorded in Volume 9 of Plats, pages 57 through 58 inclusive, records of Snohomish County, Washington, except that portion for State Highway 104, and together with the shorelands of the second class abutting thereon, situated in the County of Snohomish, State of Washington (the "Trieu Parcel'). Together the Mitchell Parcel and the Trieu Parcel may be referred to herein as the "Parcels," or individually as a "Parcel." WHEREAS, Mitchell and Trieu, through each's respective predecessor -in -interest, are each grantors and grantees under a Deed of Mutual Easement and Agreement executed June 23, 2016 and recorded in Snohomish County records, recording number 201606240383 (the "Easement") regarding a mutual easement for a driveway for ingress and egress of forty-eight (48) feet long, and over five (5) feet of each's respective Parcel, perpendicular to the common boundary line of the Parcels, as more fully and specifically described in the Easement (the "Easement Area"). WHEREAS, the Parties desire to terminate the Easement so that the rights conferred thereunder no longer benefit and burden the Mitchell Parcel and the Trieu Parcel. Termination of Easement. The Parties, each and together, and for themselves and their successors, heirs, and beneficiaries, terminate the Easement, as well as any and all rights, claims, or interests each has or may have, or obtained as grantors or grantees, in the Easement Area and the other's Parcel. 2. Binding Effect. This Termination of Easement shall run with the land and shall be binding upon the successors, assigns, heirs, beneficiaries, and trustees of the Grantors. 3. Severability. If any part, term; or provision of this Termination of -Easement is determined by a court of competent jurisdiction to be invalid or unenforceable, such invalid or unenforceable part, term, or provision will not render the remainder of this Termination of Easement invalid and such part, term, or provision may be severed to the extent so as to make the remainders valid and enforceable.
