Hello Mr. Meinhold,
Thank you for your explanation of the project and your request to treat the replacements as repairs. The City
of Edmonds does not consider the removal and replacement of PTAC units to be a repair, and a permit is
required for this type of work. Our building inspector Eric Carter has been in conversation with Barron this
week and has shared this same message with them as well.

Dear Mr. Bjorback:
Snohomish County has contracted with Barron Heating and Air Conditioning to repair parts of the mechanical systems at
the hotel located at 22721 Highway 99. The mechanical system was damaged by illicit drug activities and must be
repaired to make the building safe for habitation and prevent further degradation of the building interior. We
understand the City's concern about allowing work on the mechanical systems prior to the remodel project that will
potentially change the use of the building. However, as a building owner, we need to make the mechanical system
operational. The County needs to rectify this situation as with all due haste, regardless of the start of the remodel
project or the change of use for the building.
Per Washington State Existing Building Code Chapter 2, repair is the reconstruction, replacement, or renewal of any part
of an existing building for the purpose of its maintenance or to correct damage. Per Washington State Energy Code C202
Repair is the reconstruction or renewal of any part of an existing building. This project is repair of the existing PTAC units
and exhaust fans for the purpose of correcting damage caused by illicit drug contamination.
Per Washington State Existing Building Code Section 407.1, existing mechanical systems undergoing repair shall not
make the building less compliant than it was before the damage occurred. The PTAC units and exhaust fans specified for
this project are more energy efficient than the original PTAC units and exhaust fans from 1996, when the building was
originally constructed. All PTAC units currently on the market are more efficient than the most efficient units that were
manufactured in 1996.
Per Washington State Energy Code Section C504.1, repairs exempt from permit, and abatement of wear due to normal
service conditions shall not be subject to the requirements for repairs in this section. Per the City of Edmonds' published
Work Exempt from a Building Permit Handout permits shall not be required for Item 2) Mechanical (b) Replacement of
any part that does not alter approval of equipment or make such equipment unsafe. The repairs do not alter the
approval of the equipment of make the equipment unsafe. Therefore, the repairs are not subject to WSEC Section
C504.1 or permitting through the City of Edmonds.
Further, we understand Washington State Energy Code Section C505.3 requires spaces undergoing a change in
occupancy alteration shall be brought up to full compliance with this code including space that is converted to a Group R
dwelling unit or portion thereof, from another use or occupancy. For this purpose, we the repair work is utilizing energy
efficient parts compliant with the requirements for new construction under the current energy code.
