The requirement of a pervious trail surface ECDC 23.40.220(C)(7)(a) was noted as a requirement on the May 28, 2024 memo from Tristan Sewell during the permit review process. The Parks Department is requesting an exemption through the ECDC 23.40.230(A) Exemption Request and Review process with director review, for several reasons. Pathway design for a shared use path requires accommodation of pedestrians, bicyclists, skaters and other users. This spur of the Interurban Trail is used for commuting, recreation, as well as an established route to connect to the main Interurban Trail System. To accommodate the trail users, a firm and uniform trail surface provides the safest means of travel on the pathway. ECDC 23.40.230 requires this section of the otherwise paved trail within the critical area be a pervious surface. We understand the intent of the code is to not have paved surfaces on steep slopes, but this short length of trail is a 15% slope. The proposed trail surface is asphalt, providing a smooth surface for pedestrian and wheeled users. The addition of 47 linear feet, or 470 square feet, of pervious material to the pathway would represent less than 3% of the total length of the Interurban Trail Spur. The terminus of this proposed trail intersects with the existing Interurban at both a sharp angle and a drop in topography creates an approach from the east that is not visible until starting down the decline. A trail user would not reasonably expect the change in material for this very short trail section. In addition, the transition from asphalt to pervious back to asphalt creates, depending on material used, seams, settling, and surfaces not friendly to wheeled users on a short and steep section of the trail. The pervious section of the trail would counter our attempt to provide a continuous surface and safe pathway for users. Please see attached exhibit for reference.
