The initial agreement period was 20 years. Staff Recommendation Staff requests moving this agreement to the next general council meeting for consent and mayoral approval. Narrative The license agreement provides for the City of Edmonds to utilize a portion of WSDOT fiber in exchange for right of way access. Amendment 2 extends the license agreement for 5 years. The contract has been reviewed by legal. Attached documents include the initial license agreement and amendement 2. WHEREAS, WSDOT has a requirement, due to Homelm1d Security video surveilla11ce a11d m1ti-te1Torist a11d other priority transportation a11d traffic mm1agement high-speed cmmmmications needs, for a fiber optic com1ection from State Highway 99, approximately 150 feet south of212th Street SW, to the Edmonds FeJTyTerminal; and WHEREAS, WSDOT desires, due to national security urgency of the project m1d limitations of grant ftmding available, to install fiber optic cable on existing poles owned by Snohomish County Public Utility District Number 1 (hereinafter "PUD") a11d/or other utility or com111U11ication service providers located within City right-of- way; a11d WHEREAS, the City anticipates future needs for fiber optic communication connections along the same route as the WSDOT proposed installation of fiber optic cable; NOW, THEREFORE, in consideration of the tenns, conditions, and covena11ts contained herein, the Parties agree as follows: 1. The City will not require the said fiber optic cable to be installed underground where poles owned by the PUD or other utility or communication companies presently exist along the designated route indicated in Exhibit A, a11d will allow WSDOT to install the said fiber optic cable above ground on existing poles to accomplish this requirement to have a high-speed fiber connection as proposed in the drawing at the attached Exhibit A. 2. \VSDOT shall obtain m1d pay the associated fees for all required pennits, including but not limited to PUD m1d other utility m1d communication providers' pole use pem1its and City right-of-way permits. 3. WSDOT shall use the fiber optic cables only for Homela11d Security video surveillance and a11ti-te1Torist m1d/or other priority security m1d transpmiation a11d traffic mm1age111ent high-speed communications pmposes. Any use by WSDOT of the fiber optic cable for purposes other thm1 security or traffic control/management is prohibited by this License Agreement. WSDOT will install and provide the City, at no cost to the City and for the City's exclusive use for City purposes, in coordination with the WSDOT fiber optic cable installation, 24 strands of fiber along this route in consideration for allowing said fiber to be installed on poles currently along the path shown in the attached drawing, Exhibit A. For purposes of this license agreement, the fiber optic cable main trunk line and appurtenances from the Edmonds City limits to the ferry tenninal and to be shared by WSDOT and the City shall hereinafter be refened to as the "System". In addition, provided that the City provides timely notification to WSDOT of its fiber optic requirements at its City facilities, WSDOT will arrange for installation of, in conjunction with WSDOT's installation of the System, fiber optic cable, splice boxes, patch panels and other appurtenances necessary to c01mect City facilities to the System, and the costs incurred by WSDOT for such installation shall be paid by the City. 5. All fiber optic cabling, pole attachments, conduits and other appurtenances comprising-the trunk line from the Edmonds City limits to the feny tenninal and to be shared by WSDOT and the City (the "System") described in Exhibit A which lies within the city right-of-way shall be owned and managed by WSDOT. Conduit and fiber cabling lying within or upon state-owned prope1iy shall be owned by WSDOT. All fiber optic cabling, pole attachments, conduits, and other appmienances from the main trunk line to City facilities to serve City uses only shall be owned by the City. Both parties agree in the event of an outage, or degradation in service, to take all actions in as expeditious a mam1er as possible to repair and restore the System. 6. During the term of this agreement, the City shall be responsible for maintenance, extension, further extended com1ections or repairs required for the 24 strands of fiber allocated to the City. All requests will be made and coordinated with WSDOT and will be at the City's cost. WSDOT shall obtain prior written approval from the City prior to incurring any costs to be paid by the City. 7. In the event of major repair to the System, WSDOT shall share in the costs on a prorated basis (equal to Repair Cost x WSDOT Fibers/Total Fibers), depending on their share of the fibers in the repaired section of cable. For these purposes, the City will assist and when requested provide monitoring and take necessary precautions and actions within its authority to help assure the availability of the System to the locations on the System and for other locations. 8. The City shall provide to WSDOT 24-hour per day, seven day per week response or access at tem1ination points at City facilities for emergency testing and installation/service of all tennination equipment c01mected to the System. To access a tennination point, WSDOT shall first call the appropriate official at the City who will allow WSDOT/contracted persom1el to access the cabinets for the necessary work. After nonnal working hours, WSDOT shall call the City Police Depaiiment to contact the on-call info1mation services teclmician, who shall provide the necessary access as soon as possible. For repmiing of problems by the City on WSDOT owned facilities, the City shall contact WSDOT at phone munbers to be provided by WSDOT. 9. WSDOT will provide such technical assistance as is necessary to assure proper labeling and locating of each end of the fiber cabling that they will be com1ecting to within the City portion of the System. 10. The paiiies agree that in all ways practical, and to the extent that the effmi involved is reasonable, they shall excha11ge data, teclmical support, a11d other goods a11d services on an equitable basis relating to these facilities and services at Exhibit A. This excha11ge shall be on a quid pro quo basis a11d neither paiiy shall be compensated therefore. However, a11y request for significa11t levels of data, technical support, or other goods a11d services not specifically covered under this Agreement shall be by direct invoice of the actual cost in providing said data, suppmi, or other goods a11d services, to be agreed in advance on a case-by case basis. Either paiiy shall obtain prior written approval from the other paiiy prior to incuning ai1y costs to be paid by the other paity. 11. The tenn of this Agreement shall commence on the date of its execution and shall rm1 for a period of twenty (20) years from that date, unless revoked by the City prior to that date. It is intended by the parties that, at the end of twenty years, this Agreement may be renewed with ai1y modifications or cha11ges deemed jointly acceptable, by written agreement of the paiiies. 12. The City may revoke or ca11cel this license agreement at ai1y time by giving written notice to WSDOT. If directed by the City, WSDOT shall immediately remove all facilities comprising the System from the right of way. All System facilities or components remaining upon the right of way 60 days after written notice of cancellation a11d City direction to remove may be removed by the City at the expense ofWSDOT. 13. RECITALS A. WSDOT and the City entered into an interagency agreement entitled Fiber Optic Cable Service Level License Agreement No. DP00994 dated April 8, 2005, (hereinafter referred to as “Agreement”). D. WSDOT and the City desire to amend certain terms in the Agreement. AGREEMENT NOW, THEREFORE, in consideration of the terms, conditions, and covenants contained herein, IT IS MUTUALLY AGREED AS FOLLOWS: 1. Purpose: WSDOT entered into the Agreement with the City on April 8, 2005, to authorize WSDOT to install, operate, and maintain fiber optic cable within the City-owned right of way (on the PUD-owned poles) in exchange for WSDOT providing the City with 24 strands of fiber along the route identified in Exhibit A of the Agreement. 2. Definitions. All capitalized terms used herein but not defined herein have the respective meanings set forth in the Contract or, if not defined in the Contract, have their ordinary and usual meaning. All Section and Exhibit references herein are to the Sections and Exhibits of the Contract unless otherwise stated. 3. Section 11, “Term and Termination” is hereby replaced in its entirety with the following: “The term of this Agreement shall commence on April 8, 2005, and run for a period of twenty-five (25) years from that date, unless (a) revoked by the City prior to that date; (b) terminated by WSDOT with thirty (30) days prior written notice to the City; or (c) upon termination of the PUD License, as provided therein. This Agreement may be renewed with any modifications or changes deemed jointly acceptable, by written agreement of the Parties.” 4. Effective Date. The effective date of this Amendment shall be April 8, 2025, regardless of the date of last signature. 5. Nondiscrimination Requirement. During the term of this Contract, the City, including any subconsultant, shall not discriminate on the bases enumerated at RCW 49.60.530(3). The provisions of the Contract, as modified by this Amendment, shall apply equally to any and all other provisions in the Contract as thought the modified provisions were original, but all of which together shall constitute one and the same instrument. 7. Electronic Signatures. A signed copy of this Contract or any other ancillary agreement transmitted by facsimile, email, or other means of electronic transmission shall be deemed to have the same legal effect as delivery of an original executed copy of this Contract or such other ancillary agreement for all purposes. 8. Counterparts. This Contract may be executed in counterparts or in duplicate originals. Each counterpart or each duplicate shall be deemed an original copy of this Contract signed by each party, for all purposes. Staff Recommendation Approval to hold public hearing before City Council on July 22, 2025. Narrative The City of Edmonds received an Official Street Map Amendment (AMD2024-0007) requesting to remove the required 10-ft street dedication on the west side of 75th Pl W, adjacent to 15730 75th Pl W. The City’s Official Street Map indicates a desired 60-ft right-of-way. The Official Street Map amendment would reduce the potential overall 75th Pl W right-of-way (adjacent to 15730, 15700, and 15604) from 60-ft to 50-ft. The existing 75th Pl W right-of-way at each of these locations is 40-ft in width, 20-feet on each side of the right-of-way centerline. Edmonds Community Development Code (ECDC) Chapter 20.65 requires the Planning Board to review Official Street Map Amendment applications as a Type V decision and make a recommendation to City Council. A public hearing is to be held before City Council with a final decision made by the Council. Initially, the City had received one application to amend the official street map (AMD2024-0007), adjacent to 15730 75th Pl W. This amendment was presented to the Planning Board on May 28, 2025. While the Planning Board minutes for this meeting are not yet available, the recommendation from the board was to amend the official street map to remove the 10-ft right-of-way dedication with potential compensation to be considered by City Council. Following the Planning Board meeting, staff confirmed that city code did not allow for compensation related to removal of a required dedication from the official street map. It was also noted at that time there were two other properties in the vicinity of the subject application that were subject to street dedication per the Official Street Map. The addresses of these two properties are 15730 and 15604 75th Pl W. In an effort to streamline processes, staff recommends including 15730 and 15604 75th Pl W in the decision making process related to AMD2024-0007. Staff’s analysis in review of AMD2024-0007 (15700 75th Pl W) and subsequently 15730 and 15604, has concluded the dedication areas falls entirely within steep slopes and are not needed for the purposes of travel lanes, sidewalk or public utility infrastructure. In addition to the historical actions that support the reduction of the west side right-of-way width along 75th Pl W (in vicinity of all three properties), it should 2.3 Packet Pg. 16 also be noted this area was identified for a city initiated official street map amendment to remove the required dedication. HISTORY/BACKGROUND: Edmonds Community Development Code 18.50.020 states: C. Dedication Presumption and Requirement. Applicants for a subdivision, a planned residential development (PRD), a building permit or other form of development permit shall be presumed to create development impacts upon the street and transportation system of the city, if the applicant’s property abuts street right-of-way which has not been dedicated to public use or otherwise acquired at the width established by the plan lines adopted by the official street map. 1. Such presumed developmental impacts shall, in addition to other mitigation measures which may be required as a result of the SEPA process, conditional use approval or other city review procedures, be mitigated by the dedication of such right-of-way to the city and to public use; provided, however, that the total of all mitigation measures shall not exceed the development impacts of any development. Per the Official Street Map, the proposed right-of-way lines along 75th Pl W, between 156th St SW to the north and North Meadowdale Road to the south, indicate a desired 60- ft right-of-way (Attachment 5). The Official Street Map amendment would reduce the potential overall 75th Pl W right-of-way (adjacent to 15730 75th Pl W) from 60-ft to 50-ft. The existing 75th Pl W right-of-way at this location is 40-feet in width, 20-feet on each side of the right-of-way centerline. 15730 75th Pl W is an existing vacant lot and as a condition of permit approval for any future single-family residence on the lot, a 10-ft street dedication will be required as shown on the City’s Official Street Map. In anticipation of a future building permit submittal, Mr. Altmann submitted a request to remove the required street dedication along the frontage of his property. A notice of completeness was issued February 10, 2025. Additional information was requested of the applicant on April 18, 2025 and the applicant resubmitted application materials on April 24, 2025 (Attachments 2, 3 and 4). Mr. Altmann has requested the 10-ft street dedication requirement be removed and has said the dedication would inhibit development of the site. Zoning regulations require the building setback from the street to be taken from the right-of-way line/property line and moving the right-of-way line further to the west would push the residence further down the existing steep slope. The driveway slope section of code restricts slopes to 14 percent unless a waiver has been approved to allow for up to a 20% slope. In no case shall the driveway slope be in excess of 20%. Approval of the amendment would not guarantee or infer approval of any future building permit applications. IV. SEPA THRESHOLD DETERMINATION: The application for an Official Street Map Amendment does not require SEPA review. Therefore, the Applicant and the City have complied with the requirements of ECDC 20.15.A. V. APPLICATION NOTICE: Notice to all property owners within 300-ft of the site were notified via mail on March 10, 2025. Notice of application was printed in the Everett Daily Herald and posted at public notice locations March 11, 2025. The City has complied with the noticing provisions of ECDC 20.03 (Public Notice Requirements). An Affidavit of Mailing, Affidavit of Posting and an Affidavit of Publication from the Herald Newspaper are included as attachments to this report. All noticing materials are provided in Attachment 8. VI. TECHNICAL REVIEW COMMITTEE: The proposed amendment has been reviewed by the Engineering and Street Divisions of Public Works as well as the Planning and Development Department. The area of what would otherwise be required to be deeded to the City falls entirely within a steep slope and is not needed for the purposes of travel lanes, sidewalk or public utility infrastructure. In addition, the following historical actions support the reduction of the west side right - of-way width along 75th Pl W in vicinity of the subject official street map amendment. A site plan showing the location of each action has been included for reference as Attachment 9. 1) 1990 – Ord. 2799 vacation 75th Pl W, south of North Meadowdale Rd (Attachment 10) 2) 1990 – 10-ft street dedication (15706 and 15714 75th Pl W) (Attachment 11) 3) 1993 – Ord. 2957 vacating ROW deeded to the City in 1990 (Attachment 12) 4) 1998 – Ord. 3206 vacating 158th St SW right-of-way, maintaining a 20-ft half width ROW along the westerly side 75th Pl W (Attachment 13). 5) 2004 – Subdivision of south property with no dedication requirement (Attachment 14) VII. CRITICAL AREAS: An initial critical areas determination was completed on the subject property in 1996 (CRA1996-0154). A steep slope was identified, requiring further study. However, critical areas determinations remain valid for only five years, thus the property lacks a valid determination. Prior to development, an updated critical area would be required. Furthermore, development within the improved right-of-way are allowed without a critical areas report (ECDC 23.40.220(C)(5)). VIII. PUBLIC COMMENTS: To date, no public comments have been received on the subject proposal. IX. APPLICABLE CODES: A. ECDC 16.20 (Single Family Residential Zone) The subject property and surrounding properties are located within the Single Family Residential (RS-12 and RS-20) zones. These properties appear to have been developed with uses consistent with the residential zoning. The proposed Official Street Map amendment will not impact the current zoning or use of the properties in the neighborhood. The applicant submitted a surveyed site plan depicting the existing 20-ft westerly half of 75th Pl W right-of-way and proposed location of the future single-family residence with 25-ft building setback line (Attachment 2). B. ECDC 20.65 (Street Map Changes) This code section establishes the criteria and process by which Street Map changes will be reviewed. The criteria are as follows: Compliance with the purposes of the Comprehensive Plan (addressed in section IX.C of this report), compliance with the purposes of the Comprehensive Street Plan (addressed in section IX.D of this report), and compliance with the purposes of the Official Street Map (addressed in section IX.E. of this report). The proposed amendment will be heard by the Planning Board who will make a recommendation to the City Council. The City Council will, following a public hearing, make a final decision. C. ECDC 15.05 (Comprehensive Plan - Purposes) The current comprehensive plan designation of the subject property and surrounding properties is Low Density Residential 2. The 2024 Comprehensive Plan lists the following goals and policies for Residential Neighborhoods: Goal LU-15 Ensure the availability of quality housing to all sections of the community, accommodating the spectrum of housing needs and preferences. Policy LU-15.1 Apply contextually appropriate standards and regulations in updating the development code to enable walkability. vibrant public realm and urban character between different land use areas. The subject proposal appears to be consistent with the above as it allows for adequate right-of-way width along 75th Pl W for purposes of utilities and transportation needs, including emergency services. D. ECDC 15.40 (Comprehensive Street Plan – Purposes) The Transportation Element of the 2024 Comprehensive Plan includes the following goals and policies, in addition to the general purpose of the comprehensive plan: Goal T-1 Create a complete and connected system that offers efficient transportation options to implement the regional transportation plan. Goal T-4 Develop the City’s transportation system to serve existing and future land uses and promote economic growth. Policy 4.1 Encourage the efficient movement of people and goods through an effective and interconnected transportation network that includes collector and arterial streets, trails, bike paths, public transit, and other transportation facilities. Goal T-5 Minimize the adverse impacts of transportation facility improvements on the natural environment both in established neighborhoods and undeveloped areas. The reduction in right-of-way width at the subject location would not negatively affect the City’s ability to complete future right-of-way/transportation improvements and would be consistent with the above goals and policies. E. ECDC 18.50 (Official Street Map – Purposes) The Purposes of the Official Street Map as stated in ECDC Chapter 18.50 are as follows: A. Implement the comprehensive street plan. B. Regulate the construction of improvements which could prevent the implementation of the comprehensive street plan. X. During my conversa$ons with the City Engineer, I was informed that the City of Edmonds had previously determined the ROW dedica$on at my property was not needed. The city, however, never completed the process to remove the dedica$on due to staffing challenges. This Official Street Map Amendment request meets the purposes of the following: •City of Edmonds Comprehensive Plan – 2024 o The amendment will maintain Edmonds commitment to well-designed streets that are safe, welcoming, and accessible for all residents regardless of age, ability, or mode of transporta$on. •Comprehensive Street Plan - Edmonds Community Development Code Chapter 15.40 o The amendment will not disrupt the coordinated street plan, primarily because this segment of 75th Place W is not a thoroughfare. To the north of Meadowdale Beach Rd, 75th Pl W is no longer classified and a Collector Street, but rather a Local Street. Furthermore, 75th Pl W has no outlet to the north of N Meadowdale Rd. Therefore, expanding the current street width into the ROW would not increase the u$lity of this roadway. •Official Street Map - Edmonds Community Development Code Chapter 18.50 o The amendment will not have an adverse effect on the Official Street Map. The city had previously determined that dedica$on of the ROW for addi$onal road width would not be pursued. If the ROW dedica$on is not removed, however, it will inhibit development of the site. This analysis provides a summary of financial activity through May 31st. The total fund balance has increased by $7.9m as of May 31st. In the 2025 budget the City is projected to see a decrease in fund balance of $8.2m (adjusted for the May budget amendment). Looking at the “All Funds Financial” summary statement you can see that the most significant reasons for this current difference can be found in the General Fund ($3m) and Enterprise Funds ($5.3m). Single significant impacts are seen in interfund loan proceeds of $6m & the May receipt of property taxes ($1.1m). The “All Revenue Summary” shows that the City of Edmonds is over budget in revenues received by almost 3%. Though the City is struggling with some understaffed departments (finance/police/parks/facilities/public works) we, the staff have been able to positively manage the 2025 budget as the “All Expenditure Summary” shows coming in at 1% under budget. The following comments highlight other significant activity in 2025: • Interest Income continues to grow as the year-to-date amount of $1,151,607 is an increase of 7.4% from last year at this time. • Labor costs as of May 31st YTD (year to date) are tracking down from last year (6.5% or $1.1m) and this is most likely due to the staff cuts implemented at year end with a smaller impact for in year staff reductions as well. This gap should increase as the year progresses due to the cumulative trend of these budget cuts. • Revenues & Expenditures are trending in a positive manner, early (42% of the year). This is impacted by the interfund loan (General & Utility Funds) & property taxes received in mostly April & May. Remember that the interfund loan impacts both revenue (General Fund) and expenditures (Water and Storm). Another significant impact is the annual payment to WCIA of $2.4m in January. Considering these impacts, the fact that total expenditure is 1% under budget (in the General Fund and almost 8% overall) represents how well City Staff are managing their budgets. • Significant revenue trends are provided in the trend analysis reports that we have included with the main revenue/expenses budget in the actual report. The main revenues that we have prepared for these trend analyses reports for include: (1) property taxes (2.1% growth); (2) sales taxes (2.8% growth); (3) real estate excise taxes (up 1%); (4) Utilities taxes are up by (Water 7.3%) and (Sewer 9.6%); (5) Charges for services are up by 12.6%. These trends are trending up from last month which is a solid economic indicator almost midway into 2025. • These financial reports reflect the changes addressed in the May Budget Amendment approved by City Council on May 6th. While the focus has been on the General Fund and understandably so, the fund is trending well (up from April) in the significant indicators (major revenues are up 2.9% from 2024, and expenditures are .5% under budget). There are still many unknowns such as the impact of additional staffing reductions that made up much of the May budget amendment. Another unknown that some council members have requested projections on is the General Fund 2025 estimated year-end balance. The General Fund is budgeted in 2025 to have a positive yearend balance of just over $1.4m. All City funds have a positive cash balance and finance staff have reconciled the total fund balance of almost $79m to the penny confirming the cash fund balances accuracy. Finally, you might notice that there are multiple funds that are under budget on the revenue side. Any percentages that are over 10% will be reviewed at the mid-year review. For expenditures I do the same, but at 5% over. Currently there is only one such fund on the expenditures side, the Equipment Rental Fund at 8%. I am not concerned with how many funds are under budget for expenditures as that is related to three possible causes: (1) capital projects lack of activity; (2) Debt service payments not yet made as they usually process in June and December & (3) over budgeted which does get addressed in the second half budget amendment. In order to meet this total budget of $12,577,229, we will have to see sales tax revenues increase by 7.22% from last year’s total collection of $11,729,781. We are currently trending 2.8% over 2024 for sales collections through May. • Real Personal/Property Tax revenues are up $129,936 from this point in time last year, and EMS Property Tax revenues are up $49,123 from this point in time last year. This is due to the 1% increase in taxes from 2024 to 2025. • Real Estate Excise Tax is up $12,652 from this point last year. • Gas Utility Tax is up $107,826 from this point last year; this is not the result of a timing difference. • General Fund Interfund Loan – All $6M of the approved $6M interfund loan from the Utilities to the General Fund has been utilized. Interest to be charged to the General Fund for this loan in 2025 totals $109,304 to date.
