ORDINANCE NO. 4404
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, RELATING TO THE IMPOSITION OF A
PUBLIC SAFETY SALES AND USE TAX FOR CRIMINAL
JUSTICE PURPOSES

WHEREAS, pursuant to House Bill 2015, by June 30, 2028, the legislative authority of a qualified
city or county may authorize, by resolution or ordinance, a sales and use tax; and
WHEREAS, to impose the tax authorized by HB 2015, the city must meet the requirements to
receive the public safety grant under HB 2015 and issue and implement policies and practices as required
under section 101(3) and (4) of HB 2015; and
WHEREAS, the City of Edmonds will submit documentation to the criminal justice and training
commission, concurrent with the adoption of this ordinance, demonstrating that it has met the requirements
imposed by HB 2015 to impose the tax; and
WHEREAS, the tax authorized is in addition to any other taxes authorized by law and must be
collected from those persons who are taxable by the state pursuant to chapters 82.08 and 82.12 RCW upon
the occurrence of any taxable event within such city or county; and
WHEREAS, the rate of tax under this section equals 0.1 percent of the selling price, in the case of
sales tax, or value of the article used, in the case of a use tax; and
WHEREAS, moneys received from the tax imposed must be expended for criminal justice
purposes, meaning activities that substantially assist the criminal justice system, which may include
circumstances where ancillary benefit to the civil justice and behavioral health system occurs, which
includes domestic violence services, staffing adequate public defenders, diversion programs, reentry work
for inmates, reducing homelessness or improving behavioral health, community placements for juvenile
offenders, and community outreach and assistance programs; and
WHEREAS, cities imposing the tax shall within one calendar year of imposition of the tax, and
annually thereafter, make a report to the association of Washington cities on how the moneys received from
the tax were expended;
WHEREAS, the City Council of Edmonds seeks to impose a public safety sales and use tax for
criminal justice purposes as authorized by HB 2015 to be collected on January 1, 2026;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. A new chapter of the Edmonds City Code, Chapter 3.110 entitled “Public Safety
Sales and Use Tax” is hereby added to read as set forth in Attachment A hereto, which is incorporated
herein by this reference as if set forth in full. Notwithstanding ECC 3.110, the Public Safety Sales and Use
Tax shall not be collected until January 1, 2026.
Section 2. Use of Funds. Tax revenues collected shall be utilized for criminal justice purposes
meaning activities that substantially assist the criminal justice system, which may include circumstances
where ancillary benefit to the civil justice and behavioral health system occurs, which includes domestic
violence services, staffing adequate public defenders, diversion programs, reentry work for inmates,
reducing homelessness or improving behavioral health, community placements for juvenile offenders, and
community outreach and assistance programs or in any other manner in compliance with HB 2015.
Section 3. Severability. If any section, subsection, clause, sentence, or phrase of this
ordinance should be held invalid or unconstitutional, such decision shall not affect the validity of the
remaining portions of this ordinance.
Section 4. Effective Date. This ordinance, being exempt under RCW 35A.11.090, is not
subject to referendum and shall take effect five (5) days after passage and publication of an approved
summary thereof consisting of the title.

3.110.010 Public Safety Sales and Use Tax – Imposition
Pursuant to 82.14 RCW, there is authorized, fixed and imposed a public safety sales and use tax
on every taxable event within City of Edmonds. The tax shall be imposed upon and collected
from those persons from whom the state sales or use tax is collected pursuant to Chapters 82.08
and 82.12 RCW.
3.110.020 Public Safety Sales and Use Tax – Rate
The rate of tax imposed by ECC 3.110.010 shall be one-tenth of one percent of the selling price in
the case of a sales tax, or value of the article used, in the case of a use tax.
3.110.030 Public Safety Sales and Use Tax – Expiration
The tax imposed by this Chapter does not expire.
