Ordinance 4415ORDINANCE NO.4415 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, TEMPORARILY AMENDING SOME OF THE UTILITY TAX RATES IN ECC 3.20.050. WHEREAS, the 2025-2026 biennial budget was premised upon the city receiving at least $6 million in new tax revenue through a levy lid lift or some other means; and WHEREAS, the voters rejected a $14.5 million levy lid lift in November of 2025; and WHEREAS, the city needs a temporary revenue source to get it through the 2025-2026 biennium without having to make the significant cuts contemplated in Resolution 1570; and WHEREAS, the city council wants to temporarily increase the utility tax as contemplated herein as a means of completing the biennium on budget while also giving it additional time to evaluate and pursue longer term budget solutions; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. ECC 3.20.050, entitled "Occupations subject to tax — Amounts," is hereby amended to read as follows (new text is shown in underline; deleted text is shown in 13.20.050 Occupations subject to tax — Amounts. Sellers of electricity, gas, water, sewer, cable television and telephone services shall be subject to the taxes imposed by this chapter. There are levied upon, and shall be collected from, every person, firm, corporation or other entity on account of the business activities, license and occupation taxes in the amounts to be determined by the application of the rates against aross income as follows: A. Public Utility Districts. Upon every person, firm, corporation or other entity engaged in or carrying on the business of selling or furnishing electrical energy and power a tax equal to six percent is levied upon the total gross income from the sale of electricity within the corporate limits of the c �t during and for the term for which the occupation license is required; provided, however, that there shall be no tax or fee upon revenues derived from the sale of electricity for the purposes of resale. B. Natural or Manufactured Gas and Service. Upon every person, firm, corporation or other entity engaged in or carrying on the business of transmitting, distributing, selling and furnishing natural and/or manufactured gas, a tax equal to six percent of the total .gross income from the sale of gas within the corporate limits of the icjduring and for the term for which the occupation license is required. C. Brokered Natural Gas - Use Tax in Lieu of Occupations Tax. There is imposed under the authority of RCW 35.21.870 a use tax on the consumers of brokered natural gas. Such tax shall be in lieu of the tax imposed by subsection © of this section when consumers receive natural gas directly from a producer of manufactured natural gas outside of the state of Washington. Such tax shall be the same as that imposed on a natural manufactured gas utility by subsection © of this section, equal to six percent of the customer's monthly purchases or other use charge by the broker of out-of-state natural gas. D. Telephone Business. A tax equal to six percent of the gross subscribers' exchange monthly service charges billed to business and residence customers located within the corporate limits of the ci , together with six percent of gross income derived from intrastate toll service provided to business and residential customers located within the corporate limits of the city. E. Cable Television. Pursuant to Chapter © ECC, community antenna television systems, commonly known as cable television franchisees, are hereby levied a franchise fee of five percent, as authorized by 47 U.S.C. Section 542(a) and RCW B-5—.2-1-16-A on all gross revenues derived from any source of revenue by cable television franchisees from their cable television operations in the cj of Edmonds. In addition thereto, a business license tax, as authorized in part by 47 U.S.C. Section 542(g)(2)(A), is hereby levied equal to six percent on all gross revenues derived from any source of revenue by cable television franchisees from their cable television operations in the c� of Edmonds. F. City Sewer Utility. The c� of Edmonds, as a seller of sewer services, shall be subject to the tax imposed by this chapter. The sewer utility shall pay a license fee or tax equal to 4-8 20 percent of the gross income from the �Lty's sewer utility. G. Solid Waste Haulers. Any solid waste hauler shall be subject to the tax imposed by this chapter. The solid waste hauler shall' pay a tax equal to six percent of the total gross income from the charges derived from solid waste disposal services within the corporate limits of the city during and for the term for which the occupation license is required. H. City Water Utility. The OAt of Edmonds, as the seller of water services, shall be subject to the tax imposed by this chapter. The water utility shall pay a license tax or fee equal to 20 percent on the gross income from the c�'s water utility: I. City Stormwater Utility. The LLty of Edmonds, as the seller of stormwater services, shal I be subject to the tax imposed by this chapter. The stormwater utility shall pay a license tax or fee equal to 4-0 20 percent on the gross income from the city's stormwater utility. Section 2. Sunset. This ordinance shall cease to have effect on July 1, 2027, at which point the tax rates set forth herein shall return to those that were in effect when this ordinance was adopted, absent subsequent legislative action. Section 3. Severability. If any section, subsection, clause, sentence, or phrase of this ordinance should be held invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. Section 4. Effective Date. This ordinance is subject to referendum as set forth in RCW 35.21.706. Any person may file a referendum petition with the Deputy City Clerk within seven (7) days after the passage of this ordinance. In the event that such a petition is filed, the Deputy City Clerk shall, within ten (10) days, confer with the petitioner regarding the form and style of the petition, secure an accurate, concise, and positive ballot title from the City Attorney, and assign an identification number to the petition. The petitioner shall have thirty days in which to secure the signatures of not less than fifteen percent of the registered voters of the city, as of the last municipal general election, upon petition forms which contain the ballot title and the full text of the measure to be referred. This ordinance shall take effect on January 1, 2026, unless a timely referendum petition is filed, in which case the effective date shall be suspended until the referendum petition is found to be insufficient or the ordinance is approved by the voters at an election.
