Ordinance 0134ORDIFAICE N0• 134. An Ordinance to license, tax and regulate Auctioneers, hawkers and peddlers. Be it ordained by the Council of the Town of Edmonds. SECTION 1: That every Auctioneer within the Town of Edmond-S shall, prior to erga.ging in such occupation, obtain a license the manner prescribed by this Ordinarce, and pay therefor into the JTCL Town Treasury at the rate of Five ($5.00) Dollars per day; provided, that this Section shall not apply to any public officer, Executor, Administrator, Guardian, or Trustee, who shall sell or offer for sale property at such auction pursuant to legal process; nor to hawkers. SECTIOF 2: That every peddler or hawker within the Town of_ Edmonds shall, prior to engaging in such occupation, obtain a li- cense in the manner, and pay therefor at the rate prescribed in this Ordinance. SECTION 3: That every person who offers to sell goods, ware��GC� or merchandise on orders for future delivery, or otherwise, by traveling from house to house, or from place to place within said Town of Edmonds, shall be regarded as a peddler under this Ordinan- ce. Every person selling or offering for sale any article or thins upon any Street, highway, or public place, who shall make public 14""Ja l' outcry or give any musical or other public entertainment, or make any public speech, drawing custom or attracting notice shall be deemed a hawker under this Ordinance. 2rovided, however, that venders of newspapers and magazines61 and regular commercial travelers employed by wholesale dealers ar-1 selling staple articles and merchandise to merchants and traders of said Town, shall be and they are hereby exempt from the provi sions of this Ordinance; and further provided, that persons peddl- ing fruits, vegetables, berries, butter, eggs, fish, milk, poultry or any farm produce or edibles raised, caught, produced or manu- factured by such person in any place in this State shall be, and they are hereby exempt from the provisions of this Ordinance. SECTION 4: For purposes of license under this Ordinance ped- dlers shall be and they are hereby classified and rated as follows:-P_L�� When traveling with wagon, cart or vehicle drawn by two or more animals, first class. When traveling with wagon, cart or vehicle drawn by one animal, second class. When traveling on foot, third class. 76 SECTION 5: The license fee to be paid by auctioneers, hawk- ers and peddlers shall be as follows: Auctioneers shall pay a license of Five ($5.00) Dollars per day. 3awkers shall pay a license of Ten (10.00) Dollars per day. l ems' ddlers of the first class shall, pay a license of Thirty ($30.00 1llars per year, or Five ($5.00) Dollars per day. 2eddlers of the secordclasshall pay a license of Twenty (t20.00) Dollars per year, or Four ($4.DO) Dollars Der day. Peddlers of the third class shall pay a license of Ter, ($10.00) Dollars per year, or nree .00) per day. ,O! SECTIOL' 6: There are hereby established for the purpose of he license to be issued for peddling, license periods of the dura- ion of twelve months, the first of which shall commence on the - .zirst day of July 1904, and thereafter said license periods shall commence on the first day of July in each year. Every such license issued shall expire at the expiration of the license period for or during which the same shall have been issued; provided, that any license issued after the commencement of a license period shall be paid for in proportion to the number of months remaining of the license period. QW �� SECTIOi. 7: Ary Auctioreer, hawker or peddler desiring to ob- Cain a license in accordance with the provisions of this Ordinance shall make payment therefor in advance to the Town Treasurer at the rates hereinbefore specified, and shall take his receipt therefor, and upor_ cvr, preser_tatior of said receipt to the Town Clerk, said Clerk shall issue a license to the auctioneer, hawker, or peddler in ac- cordance with this Ordinance. J,t&w SECTION 8: Every person who shall engage in the occupation or 14U business of an auctioneer, hawker or the peddler within Town of Edmonds, without first obtairing a license therefor, in accordance with the provisions of this Ordinance shall be deemed guilty of a misdemeanor and on conviction thereof shall be punished by a fire tv in any sum not exceeding One Hundred ($100.00) Dollars or by im- �risorment for a term exceeding thirty days, rot or by both such fine and imprisonment. SECTION 9: That this Ordinance shall take effect and be in ��4�r force from and after its passage and approval. pp SECTIOiT 10: All Ordinances and parts of Ordinances in conflict with this Ordinance are hereby repealed.
