Ordinance 017997 ORDIL Z CE L 0. 179. An Ordinance grartir_g to the Edmords Independent Telephone Company the right to erect poles and thereon to faster, wires in the Streets of the City of Edmonds, and to construct conduits under ground alor_g the streets and alleys of the City of Edmonds. The Council of the City of Edmonds do ordain as follows: SECTION 1: That there be and hereby is granted unto the EdA- ,&I '{_ monds Irdependent Telephone Company, its successors or assigns, the right, privilege and authority to locate, erect, place, maintain t� and use the streets and alleys within the Cit7 of Edmox_ds, poles and thereon to faster wires and to stretch said wires through said streets and alleys, for the purpose of placing, constructing and maintairirg telephones and telephone statiors in the different buildings and sections of said city. SECTIOI 2: That there be,and hereby is,grarted unto said Ed- aGto morels Independent Telephone Company, its successors and assigns, the right, pprivile e and authority to locate, place, construct, maintain ar�d operafe conduits for the conveyance of said wires under- ground, or the streets of said GCity, in accordance with the provi- sions and restrictions, underneath the surface of the streets of the City of Edmonds. SEC,'ION 3: Before said.Grartee, its successors or assigns, shall begin the corstructior of said conduits along underneath the��-G° said @fte -ts and alleys, it or they shall file with the City Clerk of Edmonds, detailed plans and profiles of said conduits as intended to be laid down along underneath said street or alley, the distance from the curb that said conduits are to be laid, the size of the con- duits and the depth from the official grade or surface of said street or alley. The said Grantee shall amend said plans ir. accordance with the directions of the City Council. SECTIM, 4: The construction of Sal co3 diZit3 shall -ot be be g r until the City Council shall approve said plans so filed with the City Clerk, as provided in Section Three of this Ordirance. r� SECTION 5: The said Grantee, its successors ar_d assigns, shall, at its or their expense, restore each and every street and alley to�� as good a condition as it was before seid street or alley was Curbed for the purpose of putting down said coriuits; and in case said Grantee shall refuse or neglect to restore said streets ands alleys, as herein specified, the Street- Commissiorer shall cause the same to be done at the cost and expense of said Grartee, its successors and assigns, and under no circumstar_ces shall any conduits be constructed over and above water pipes; and the said Grartee, its successors and assigns, during the corstructior, of said conduits, shall save the City of Edmor_ds harmless and free from any cost and expense-beeause_of any'damage allowed to_have'been caused by reason of the construction and maintainance of said conduits. SECTION 6: The rights herein granted to said dmord-s Irdepend � ert Telephone Company, its successors ar,d assigns, shall not be cow- � strued so as to deprive the City of Edrnor.ds of any of its powers to regulate the use and control 'of the streets ank. alleys within said City, or to hinder or delay the City or Edmor:ds from i roving said streets or alleys as provided by the laws of the State of Washington. SECTIOL 7: Poles and wires not to obstruct streets. The poles shall be not less than thirty feet long and placed ir_ them vourd rot less than five feet, and shell be so placed ar.d erected in such manner as may be designated by the Street Committee of the - �' City Council. The wires shall be carefully connected and fastened ry so as not to come in contact with ar_y object, and shall be stretched so as rot to interfere with the free use of said Streets and alleys, arad at such a height as may be desigrated by said Street Committee, unless otherwise ordered by the City Council. M ■ (J SECTION 8: Sidewalk and ground to be replaced. �That when it shall become necessary to take up sidewalks or dig up the ground in the erection of said poles, the said Grantee, its successors and assigns, shall, after said poles are erected, without delay, replace said walk and remove all surplus dirt, earth or other rubbish, and place said street or alley in as good condition as it was before it was taker. up, subject to the approval of the Street Committee. SECTION 9: Position of Poles may be changed. The City of Edmonds reserves the right to order the change of posi- tion of any such poles whenever in the judgment of the City Council such change is necessary for the public good, having due regard, however, for the vested rights of the parties. SECTIOh 10: Term of Frar_ehise. Xit't a.11 the privileges hereir conferred u on and ranted to said � p g �+fer Edmonds Independent Telephone Company, its successors and assigns, shall continue nor twenty-five years from and after the time this Ordinance goes into effect; provided, that said Company shall,with- in thirty days from the passage hereof,file with the City Clerk its acceptance of the Franchise herein granted, subject to the condi- tions herein. Jothing herein shall be construed to give said Com- pany the exclusive right to maintain and operate the telephone system of the City of Edmonds. SECTIOE 11: Exehangee. C 0 IV-4 aid Edmonds Independent Telephone Comp�..-_.--, its successors or as- signs, shall not charge more than Four ti'.00) Dollars for main �line business service per month, Three ;�Z.00) Dollars for residence main line per month,.Two ($2.00; J+ollarf four party business lime per month, One Dollar and L01.50) � f for four party line residence per month, One (01.00,) Dollar for extension telephone, One ($1-00) Dollar for each removal and Twenty-five (25V) Cents bell extension; but they shall be allowed to collect for three months rertal for each instrument in advance. Provided that there shall be ro,cha,rge for permanent removal. u'�4r Provided, that said Edmonds Independent Telephone Company L� shall furnish, for the use of the City of Edmonds, three telephones `RSA to be placed and. installed under the direction of �he City Council, —and also ring the fire alarm free of charge. e�the SECTION 12: A failure of the Edmonds Independent Telephone pany to comply with the provisions of this Ordinance shall, at option of the Council, work a forfeiture of its rights and privileges hereby granted.
