D. 31) An Ordinance ordering the improvement of the following described sewer course: From the mar -hole or the Trunk sewer in Dayton Street between Third and Fourth Streets, southerly a distance of Two Hun- dred Forty (240) feet, in the followirg manner; By constructing a lateral sewer system in, over and upon said sewer course in the City of Edmords, Washington; also by constructing 338 thereon inlets, catch -basins -,man -holes, lempholes, and doing such other work as may be recessary in correction therewith, all in accordance with and pursuant to 8esolutlor of Intention Fo. 39, passed by the City Council of the City of Maords on the eighteenth day of April 922• cr ating a Local Improvement District for said impro� e$f fi"The -payment thereof shall be by the Payment by Bond plan Be it ordained by the City Council of the City of Edmonds, Snohomish County, State of- Washington, as follows; SECTION 1: That the following described sewer course from the man -hole in the trunk sewer in Dayton Street between Third and Fourth Streets, southerly a distance of Two Hundred Forty (240) feet, be improved by constructing thereon a lateral sewer system; also by constructing thereon inlets, catch -basins, lamp - holes, man -holes, and doirg such other work as may be necessary in connection therewith, in accordance with plans and speeifioa- tions now on file it the office of the City 03:erk ©f the City of Edmonds, said plans and specifications having been approved by the City goureil of the City of Edmonds on the thirteenth day Of Jura, 1922, and pursuant to Resolution of Intertion Lo.39 , passed by the City Council of the City of Edmonds on the eigh- teenth day of April, 1922. That said improvement will be made along and in front of the following described property which will be affected by said im- provement and which will be included Within the improvement dis- trict herein created and limited to such property for the purpose of assessment as hereinafter provided, towit: Beginning at the Southwest corner of Dayton and Fourth Streets in the City of Edmonds; thence West 162 feet; thence South 120 feet; thence East 162 feet; thence Forth 120 feet to poirt of beginning. Beginning 120 feet South of the Southwest corner of Dayton and Fourth Streets it the City of Edmonds; thence South 94 feet; thence West 120 feet; thence North 94 feet; thence East 120 feet to the point of beginning. Beginning 162 feet West of Southwest corner of Dayton and Fourth Streets in the City of Edmonds; thence South 120 feet; thence West 120 feet more or less to Third Street; theme Beth 120 feet; thence East to point of beginning. Beginning 162 feet west and 120 feet South of Southwest corner of Dajttorl and Fourth Streets in the City of Edmonds;- thence South 120 feet; thence West 120 feet more or -less to Thtrd Street;thenoe North 120 feet; thence East to point of beginning. All of the above property being situated and lying within the City of Edmonds, Snohomish County, State of Washington. SECTION 3: That the cost of said improvement on said sewex course-hereirabove described shall be assessed against the property above described and against all lots, tracts and- parcels of pro-- perty lying and being within the improvement district herein- after created in proportion to the benefits derived therefrom as provided by the Ordirarees of the City of Edmonds, and the laws of the State of Washington. SEOTION 4: That the mode of payment shall be under the "Pay- ment by Bond" plan, by which plar Bonds of said'district shall be issued payable in ten (10) equal annual payments or install- memts with interest at the rate of eight (8%) percert. per arum. SECTION 5: Tha the estimated cost of said im rovemert is the sum of Six Hundr d and Eighty-two and 50/100, (1682.50) Dollars. SECTIOI. 6: That there is hereby created a Local Improvement District to be designated and krotun as Local Improvement District Fo.31, and there is further hereby created a Local Improvement Fund to be knowr as Local Improvement Fund No.31. 339 SECTIOL, 7: That said improvement shall be made under the direction of the City Council and the City Engineer, and in ae- eord.ance with the plans and specifieatiors now on file with the City Clerk. SECTIOL 8: The Bonds to be issued as hereinbefore provided may be sold and delivered to the Contractor doing the work of such improvement in payment of his services or they may be sold by the City Clerk at private sale, provided however, that the returns from the sale of said Bonds must net the par value of the same plus accrued interest and the proceeds thereof shall be applied in payment of t 1ze costs and expenses of said improvement. SBCTI01 9: That the special assessments to be levied as hereinbefore described shall be payable in ter (10) equal annual installments with interest at the rate of eight (8%) percent. per arum, and such installments shall be collected in the manner provided by law. SECTIOF 10; This Ordinance shall take effect and be in full force and effect from and after its passage by the City Council of the City of Edmonds, its approval by the Mayor and its publi- cation according to law6 passed by the City Council in regular session this 13th day of June, 1922, and approved by me the same date.
