Ar Ordinance providing for the improvement of Fifth Street
in the City of Edmonds from DaytonStreet South a distance of
Ore Thousand Three Hur.dred Seventy-five,(1375) feet, more or less,
to the center line of Howell Way and Walnut Street from Fifth
Street East Five Hundred Twenty-five,(525) feet, by the construc-
tion on Fifth Street of a ten inch (10") concrete Sewer and. on
Walnut Street of an eight inch (8") concrete sewer together with
the recessary manholes, catch basins and other appurterances
necessary to make a complete improvement, all in accordance with
Resolution 1o.102 of the City of Edmonds; creating an Assessment
District; creating a Local Improvement District Fund therefor,
and providing that p ymert for such improvemert be made by special
assessment on said I)strict under the mode of "Paymert by Bonds".
WHEREAS, by Resolution 1:o.102 of the City of Edmonds, the
City Council of said City has declared its intertior to order
the improvement as above outlined and doing all other work
recessary in connection therewith to make a complete improvement
in accordarce with the plans and specifications prepared by the
City Ergireer.
IOW THEREFORE, _ the City of Edmonds does ordain:
SECTIOL 1: That Fifth Street it the City of Edmords from
Dayton Street South a distance of Ore Thousard Three Hundred

Seventy-five (1375) feet, more or less, to the center lire of
Howell Way and 1alrut Street from Fifth Street East Five Hurdred
Twenty-five (525) feet, by the construction or Fifth Street of a
ter inch (10") concrete Sewer and or Walnut Street of an eight
inch (8") concrete Sewer together with the reeessary manholes,
catch basins and other appurtenances necessary to make a com-
plete improvement, all ir accordance with the plans and specifi-
cations prepared under the direction of the City Engineer, which
plans and specifications are hereby adopted and approved.
SECTIOI. 2 - That the costs atd expenses of such improvement
shall be borre and assessed against the property included it the
Assessment Li.strict herein created it accordance with law.
SECTI01 3: There is hereby established a Local Improvement
District to be called Local Improvement District Lo.48, which
district shall include the following described property, towit:
Beginning at the irtersection of the center line of Fifth
Street and Dayton Street in the Plat of the City of Edmonds;
thence South thirty (30) feet; thence East Thirty (30) feet to
the Lorthwest corner of Block 121, in the Plat of the City of
Edmonds; thence continuing East for Three Hundred (300) feet
along the 1<orth line of said Block 121 to the Lortheast corner
of Lot Ten (10), said Block 121; thence South along the East line
of Lots Ten (10) and Thirty-one (31) of said Block 121, Lots Ten
(10) ard Thirty-one (31), Block 122, of said Plat and Lot Ter (10)
Block 123 of said Plat for Six Hurdred iinety-seven and Five
T e n t'h s(697.5) feet, to the center lire of the Alley in Block
123 of said Plat; thence East along center line of said Alley for
Two Hurdred Ten (210) feet; thence South Seven and Five -tenths
(7.5) feet to the northeast corner of Lot 24, Block 123, said Plat;
thence South along the East lire of Lot 24, said Block 123 and
Lot 17, Block 124, said Plat, for T.wo Hundred Eighty (280) feet
to the Southeast corner of Lot 17, said Block 124; thence West
Two Hurdred Ten (210) feet to the Southeast corner of Lot Ter (10)
said Block 124;thence South Three Hurdred Thirty (330) feet, more
or less to an irtersection with the center lire of Howell Way
produced Easterly; thence West along said center lire produced for
Three Hundred Thirty (330) feet to the center line of Fifth Street;
thence S:orth along said center line of Fifth Street for One Thous-
and Three Hundred Fifty-five (1355) feet, more or less, to the
point of beginning.
SECTIOL 4: A special fund is hereby created to be called
Local Improvement District Fund io.48, which shall corsist ir the
aggregate of the several amounts assessed, levied and collected
on the several lots and parcels of land in said Local Improve-
ment District and the proceeds of the sale of the Bonds of the
said District for the purpose of defraying the costs and expenses
of such improvement. Out of said fund shall be paid the Bonds,
the interest thereon, and the entire cost of such improvement,
except the cost of labor, as hereinafter provided.
SECTIOL 5: The costs and expenses of such improvement shall
be defrayed by special assessments payable in ten (10) equal an-
nual irstallments with interest thereon at the rate of Five (5)
percent per annum under the mode of "Payment by Bonds", as pro-
vided by law and the Ordinances of said City.
. Bonds bearirg irterest at the rate of five (5%) percent per
annum, payable on or before twelve_(12) years from date of issue,
shall be issued inpa.nent of the costs and experses of such im-
provement, or the City of Edmonds may, at its election, sell
said Bonds and make payment in cash in the marrer provided by
the Ordinances of said City.
SECTI01 6: That the costs and experses of said improvement
to be borne by and assessed against the property of the said
assessment district, and for which Bonds of said district are to
be issued, shall rot include the cost of labor upon said im-
provement, which labor is to be furnished by Federal Funds under
the WPA plan of Federal Government.
