Ordinance 538ORDINANCE NO. 538.
AN ORDINANCE relating to the National Defense and providing for
"Black -outs" during the existance of a state of war with any foreign
power; defining offenses, prescribing penalties, and declaring an
emergency.
NOW, THaEREFORE , THE CITY OF FALMONDS DOES 04U� :
SECTION 1: A "Black -out" is hereby defined as any period of time
designated by Federal authorities during the existence of a state
of war with any foreign powers, for extinguishing lights of all
kinds.
The following acts shall be unlawful during such a period:
(1) To congregate in lroups of five or more persons on any public:_
sidewalk, street, alley or place.
(2) to display, or allow to be displayed, any light visible from
out of doors or from any vehicle except lights prescribed for
emergency vehicles and lights deemed necessary by the millitary
authorities and made known by the Mayor.
(3) To drive any emergency vehicle with the lights on unless
shielded according to police regulations, or at a greater speed
than Twenty(27) miles per hour.
(4 To drive any other vehicle or any emergency vehicle with
with lights off at a greater speed than Fifteen (15) miles per
hour.
(5) To sell any intoxicating liquors.
(6)For an unauthorized person to drive an emergency vehicle.
(7) For an authorized person to drive an emergency vehicle
except in an emergency.
Emergency vehicles shall be those desighated as such by the
Mayor, shall exhibit on the front windshield an insignia to be
designated and furnished by him, and all lights thereon shall
be shielded in accordance with rules and regulations prescribed
by him. PROVIDED, that on emergency vehicles which the Mayor
determines clearly by thier appearnee indicate that they are
emergency vehicles no insignia shall br required as in this
paragraph provided.
When deemed necessary for the protection of the publicpeaoe,

health and safety the Mayor shall make rules and regulations
concerning the "Black -out" in addition to those prescribed in
this Ordinance, which shall have the force and effect of law
until repealed bih9ity Council.
Section 2: This 0r6inance shall constitute an exercise by the
City of its governmental functions for the protection of the
public peace, health and safety, and neither the City nor any
individual responding to regulations lawfully proclamed shall
be liable in a suit for damages in connection therewith.
Section 3: Violation of any of the provosions of -this Ordinance
or the failure to comly with any of the rules and regulations
prescribed in connection therewith, pursuant hereto, shall be
punishable by fine not exceeding Three Hundered (300,00) Dollars,
or imprisonment in the City Jail not exceeding Ninety (90) days,
or by both such fine and imprisonment.
Section 4: TIELc�L S, a state of war exists between this Govern-
ment, the Empire of Japan, the German Reich, and the 4ingdom
of Italy; and due to such status there is a nevessity
for the protection of the safety of the public by "Black -out"
regulations, thereby creating a situation constituting ar, emerg-
ency wherein it is necessary fot the immediate preservation of
the public peace, health and safety that this Ordinance shall
become effective without delay;NOW,ETHEAUO.HE,
Section 5: An emergency is declared to exist and this Ordinance
