Ordinance 584428 0RD11 NCE TTO. 584 MT ORDINLITCE relating to and regulating and requiring license and the payment of a fee for the use and operation of punch boards and certain trade stimulators, defining offenses, prescribing penalties, and repealing a portion of Ordinance TTo. 47, passed June 7, 1895, defining gambling. Section 1: That eaeh and every person, firm or corporation owning or operating or exposing for the use of the public within the City of o�pe'r ecY, = used, disP an exp oed 7 t� =i� TtjYN' in the�G�y of Edmonds, which license fees shall be paid in the form of stamps purchased from the City Treasurer of the City of Edmonds, and used as hereinafter designated. To every "trade stimulator" or punch board or similar device used, displayed or exposed to the public within the City of Edmonds, there shall, at the time such device is displayed, be attached stamps, purchased from the City treasurer of the City of Edmonds, in such amounts as are hereinafter provided. Section w: The stamps to be affixed to said devices shall be de- termined and measured by the gross value or amount of the face thereof multiplied by the rate of three per cent (3), and every such device displayed for the use of the public within the City of. 14dmond8 shall have affixed to it, stamps in an amouuit equal to three per cent (3%) of the face value of such device. The ,"face value" of such device shall be determined, by multiplying the- number of tickets used in or on such "trade stimulator" or punch board by the money purchase price of each ticket irrespective of the method of attachment of each ticket to the trade stimulator or punch board. Where the tickets used on any device are of unfixed or indeterminate price, the gross "face value" fo such device shall be determined by the manufacturer's statement of such face value. It shall be the duty of any person, firm or corporation owning or operating or ex- posing for the use of the public any trade stimulating device or punch board on which the tickets are of unfixed or indeterminate value, to furnish, upon_ request, to the City Treasurer or any police officer of the City of Edmonds, an authentic bill or statement of the manufact- urer of such device showing the actual gross face value thereof. Section 3: It shall be the duty of any distributor or owner of any such device, and the one offering such device for display, to affix such stamp or stamps to any such device before the same is distributed or displayed for public use. Such distributor or owner shall also place on said stamp the date of such distribution or display, and shall mark the same "cancelled" and shall initial same and write thereon the number or the license held by him, as such distributor or owner of trade stimulating" devices or punch boards. It shall be the duty of any person using such stamp to destroy the same after the "trade stimulating" device or punch board2.has been removed from public display. No stamp shall be used more than once on any such device, and no stamp shall be transferred from one device to another. Section 4: Stamps for use under the terms of this ordinance shall be provided by the City Treasurer of the City of Edmonds in such denomin- ations and in such form a: shall seem to him right and proper, and shall be sold only to those persons holding license hereunder, in such quantities as said Treasurer shall determine. ( I Section 5: It shall be the duty of the Chief of Police and the r police officers of the City of Edmonds, as well as of the City Treasurer and the License Colleertor, to examine, from time to time, all "trade stimulating" devices and pinch boards displayed within the City of Edmonds, to determine whether such devices are being operated and displayed by a person duly licensed hereunder so to do, and whether such sevices have affixed thereto the necessary and proper amount of stamps as required by this ordinance. In addition to any other penalties herein provided, the proper officers of the City of Edmonds shall, if any such devices are found to be unlicensed, or if an in- sufficient amount of stamp taxes be affixed thereto, stize such devices and all merchandise displayed thereon or in connection therewith. ■: 1 All sums of money received by the City of Edmonds from the sale or dis- posal of such devices, or the merchandise seized and confiscated in connection therewith, shall be paid into the General Fund of the City of Edmonds. Section u p brtt� gaWst purl d0h- 0n���n ror r siini er evi PPm �. any minor to purchase tickets or chances or) any such device shall be posted against use by minors, and it shall be unlawful for any minor to play or otherwise purchase any tickets or chances or any punch board, "trade stimulator" or similar device. Section 7: It shall be unlawful to operate any punch board, "trade stimulator" or similar device without first procuring from the Clerk of the City of Edmonds a license, for which license there shall be no fee other than as hereinabove set forth. Section8: This ordinance shall become effective immediately after its passage and publication as provided for by law. PROVIDED, HOWEVER, the within ordinance shall be inoperative until January 1, 1949, as to all persons, firms or corporations holding existing licenses expiring December 31, 1948, heretofore issued under Ordinance. No. 5b6. Section 9: The license fees imposed under the terms of the within ordinance shall constitute the total license fee for "trade stimulators" punch boards and similar devices, and all ordinances or parts of ord- inances inconsistent herewith are hereby repealed as of the effective date of this ordinance. Section 10: Any person or persons failing to comply with any of the terms of this ordinance, or violating any of the terms thereof. shall be guilty of a misdemeanor and upon conviction thereof shall be punish- able by a fine of not to exceed Three Hundred and no1100 Dollars ($300.00) or by imprisionment in the City Jail for a term of not exceed- ing Ninety (90) days, or by both such fine and imprisonment. Section 11: Insofar as Ordinance No. 48, passed June 7th, 1895, is applicable to or covers the operation of "trade stimulators" or punch boards said ordinances as to the particular items in this paragraph mentioned is hereby repealed.
