AN ORDINANCE PROVIDING FOR THE ACQUISITION AND TAKING OF CER-
TAIN LANDS AND PROPERTY WITHIN THE CITY OF EDMONDS FOR PUBLIC
PARK PURPOSES BY CONDEMNATION PURSUANT TO TIE LAWS OF THE
STATE OF WASHINGTON AS SET FORTH IN R_C, C.W. 8,
WHEREAS, after due consideration and in conformity with the recom-
mendations of the City's Professional Planner, the City Council of the City of
• Edmonds has found that it is necessary and proper to acquire certain lands to
provide a more adequate park and recreational program in the City, and
WH EREAS, it appears that condemnation may be necessary to acquire
said lands,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS
DOES ORDAIN AS FOLLOWS:
Section 1, That it is necessary, and in the best interest of the general
health, safety and welfare of the citizens of the City of Edmonds to acquire for
public park purposes the following described property, situate in the County of
Snohomish, State of Washington, to -wit:
That part of Tideland Lot 1 in front of upland at 1, described as follows:
• Beginning at the meander corner common to section 23 and 24, township 27
North, Range 3 East, W. M., thence south 89042' west 924.24 feet; thence
south 24011' west 481. 15 feet; thence south 61008' east 608. 49 feet; thence
north 39028' east 864.96 feet; thence north 28042' east 86. 22 feet to point
of beginning, LESS Great Northern right of way; Section 23, Township 27
North, Range 3 EWM, as set forth in vol. 432, Page 148, records of the
County of Snohomish, State of Washington

Section 2. That the Edmonds City Attorney be and he is hereby autho-
rized and directed to initiate and prosecute all necessary acts and proceedings
in the manner required by law to purchase, condemn, take, damage and ap-
propriate said land as necessary to carry out the provisions of this Ordinance.
• Section 3. That for the purpose of mi^imizing initial capital outlay
on the part of the City of Edmonds, said City Attorney is hereby authorized,
in his discretion, to acquire the vendeets interest, if any, only, in said land,
subject, then, to the City of Edmonds assuming the obligation of said vendee,
if any, to pay the balance due thereon.
Section 4. That in assuming a contractual oblig: ion for the purchase
of said land, if tho sane be necessary, the total indebtedness of the City of
Edmonds will not be increased to an excess of one and one-half (1-1/2%) per
cent of the taxable property of the City of Edmonds.
Section 5. That the funds for compensating the owner or owners of
such property shall be drawn from the General Fund of the City of Edmonds.
• Section 6. That this ordinance shall take effect and be in force upon
its passage and publication in accordance with law.
