OFFICIAL STREET MAP ORDINANCE
AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF AN OFFICIAL
MAP PROVIDING FOR AN AFFIRMATION THAT THE CITY OF EDMONDS IS
IN COMPLIANCE WITH THE GENERAL PROVISIONS OF RCW 35. 63. 110
( SECTION 6, CHAPTER 44, LAWS, 1935, REM. REV. STAT. ( 9322-6); THAT
EDMONDS HAS PREPARED A COMPREHENSIVE PLAN AND MAJOR THOROUGH-
FARE PLAN UPON WHICH THE OFFICIAL MAP IS A PRECISE PART THEREOF;
PROVIDING FOR THE SIZE, AREA, AND SHAPE OF LAND THEREIN INCLUDED;
PROVIDING FOR THE REGULATION OF THE USE OF THE LAND, AND THE
LOCATION AND USE OF, AND THE ERECTION, CONSTRUCTION, RECON-
STRUCTI ON, ALTERATIONS, AND REPAIR OF 13UILDINGS AND/OR STRUC-
TURES, AND THEIR DESIGN, SIZE, HEIGHT, AND NUMBER OF STORIES;
PROVIDING FOR PROCEDURE FOR MUNICIPAL APPROVAL OR DISAPPROVAL
OF USES OF LAND IN THE AREAS INCLUDED IN THE OFiICIAL MAP; PRO-
VIDING FOR A BOARD OF ADJUSTMENT; PROVIDING FOR STREETS; PRO-
VIDING FOR THE GRANTING OF VARIANCES, PROVIDING A PENALTY FOR A
VIOLATION THEREOF; PROVIDING FOR THE INTERPRETATION OF THIS ORD-
INANCE IN CONJUNCTION WITH THE BUILDING CODE, AND ZONING ORDIN-
ANCE; AND PROVIDING FOR THE EFFECTIVE AND TERMINATION DATE OF
THE APPLICATION OF THE CERTAIN PROVISIONS THEREIN CONTAINED:
THE CITY COUNCIL OF THE CITY OF EDMONDS DOES ORDAIN AS
FOLLOWS:
SECTION 1. DEFINITIONS
"Official Map" means certain maps so designated showing location, size
and dimension, together with reports relating thereto; of land areas deemed to be
necessary for future public street use; and is a precision of certain provisions of
the comprehensive plan or portions thereof, by establishing the limits and outside
lines of land areas and permitted uses of areas of land being contemplated for use
as sites for such future public improvements.
"Plot Plans" mean scale drawings, showing the actual dimensions of
the lot to be built upon and showing the size, the use, and location of existing and
proposed buildings to be c •ected thereon.
SECTION 2. COMPREHENSIVE PLAN OF MAJOR THOROUGHFARES
The City Planning Commission, in compliance with the provisions of
RCW 35.63. 110 (See. 6, Laws, 1935, Rem. Rev. Stat. Sec 9322-6) has prepared
a Comprehensive Plan and major thoroughfare plan upon which the provisions,
• dimensions, size, area, and other standards are based.
SECTION 3. ENFORCEMENT AND ADMINISTRATION
It shall be the duty of the City Engineer and/or Building Inspector to
interpret, administer, and enforce the provisions of this ordinance, issue per-
mits for the use of the land, and/or structure or part thereof; he shall require
that each application for a building permit shall include a plot plan of the land;
specifications for, and intended use of the proposed building; he shall issue
permits for such uses that he finds conform in all respects with the provisions
of this ordinance; and he shall keep careful record of such applications, and plot
plans, in the office of the City Engineer and/or Building Inspector.
SECTION 4. EFFECZ IVE AREA
• The limits and outside lines of the land areas for various future public
street developments included and provided in the official map shall be within the
municipality of Edmonds; Provided, that showing such limits and related lines
and data on the official map shall not in and of itself constitute or be deemed to
constitute the acquisition or opening of any street or the taking or acceptance of
any land for any of the purposes herein stated or implied.
SECTION 5. MUNICIPAL PROCEDURE
Any person, firm, or corporation, proposing to erect, construct, re-
construct, alter, repair, or use any location, site, parcel of land, buildings
and/or structures, shall make application to the City Engineer and/or Building
Inspector for a building permit, and such proposed use shall be in accordance
with the provisions herein contained.
SECTION 6. STREET CLASSIFICATION STANDARDS
The dimensions, size, location, area, and standards for the class-
ification of streets, (and other areas of land for future contemplated public land
development, ) are as shown in the comprehensive plan dated May, 1963, pre-
pared by Clark, Coleman and Rupeiks, Inc., and adopted as the official Com-
prehensive Plan for the City of Edmonds by Resolution Number 85 of said City,
passed by the City Council on July 23, 1963 PROVIDED, that this plan shall not
apply to that portion of 76th Ave. W. lying between Highway 99 and 244th St. S.W.
SECTION 7. PERMITTED USES.
In the certain land areas as specified and shown on the official map as
designated streets and thoroughfares which are made a part of this ordinance,
no building and/or structure or land shall be used and no building and/or struc-
ture shall be hereafter erected or structurally altered, unless the Board of
Adiustment determines otherwise, except for one or more of the following tem-
porary uses enumerated herein:
1. Sheds for storage
2. Land for growing crops or grazing
• 3. Trailer parks
4. Structures for festivals or similar entertainments
5. Other "open -area" use not requiring substantial private investment
in structures.
SECTION 8. BOARD OF ADJUSTMENT
The Board of Adjustment established by the zoning ordinance of the
City of Edmonds shall perform its duties in accordance with the provisions and
procedures of the ordinance which established it, and shall have the same
jurisdiction in the administration and enforcement of the official map ordinance
as designated in Section 7 thereof, in respect to review of the deci cion and in-
terpretation of the official map ordinance made by the City Engineer and/or
• the Building Inspector, the granting of special property uses, and the deter-
mination of variances based upon the finding of fact that hardship exists.
SECTION 9. PENALTIES
Whenever any person or persons, firm or firms, or one or more
corporations have violated or failed to comply with the provision herein con-
tained, they shall be subject to a fine in any sum not to exceed $300. 00, or
imprisonment in the City Jail for a period not to exceed 90 days, or both such
fine and imprisonment in the discretion of the Court for each day of each vio-
lation, for such offense or failure to comply with the provisions of this ordinance.
SECTION 10. CONFLICT
The provisions of this ordinance shall prevail in the event they conflict
with the provisions of the City Zoning Ordinance, and shall not prevail when in
conflict with the provisions of the City Building Code.
SECTION 11. VALIDITY
In the event any section, subsection paragraph, sentence, clause, or
phrase of this ordinance is declared unconstitutional or invalid for any reasons,
such decision shall not affect the validity of the remaining portions of this
ordinance.
SECTION 12. EFFECTIVE DATE
The provisions of this Ordinance shall be in full force and effect five
days from and after its passage, approval, and legal publication for each devel-
opment plan map, which is made a part of this ordinance now or henceforth, as
provided by law, and shall continue in full force and effect for a period of four
years from such date.
SECTION 13. SHORT TITLE OF ORDINANCE
This ordinance shall include the development plans as defined herein,
shall hereafter be loiown as the "Official Street Map Ordinance".
