Ili AN ORDINANCE AMENDING SECTION 12.16.170 OF THE CITY CODE OF THE CITY OP EDMONDS, WASHINGTON REGARDING AMENDMENTS TO THE OFFICIAL ZONING ORDINANCE OF SAID CITY BY PROVIDING FOR TEN DAY POSTING OF NOTICE OF AMENDMENTS; BY ELIMINATING THE QUARTERLY PUBLIC HEARINGS OF REZONES; PRO- VIDING THAT APPLICATIONS FOR REZONES SHALL NOT BE REPEATED WITHIN 180 DAYS OF THE PUBLIC HEAR- ING FOR THE SAME PROPERTY; PROVIDING THAT APPLI- CATION TO THE CITY COUNCIL BE MADE WITHIN 30 DAYS OF THE PUBLIC HEARING BEFORE THE PLANNING COM- MISSION; AND PROVIDING THAT ACTIONS IN THE SUPERIOR COURT BE BROUGHT WITHIN 30 DAYS OF THE PUBLIC SHEARING BEFORE THE CITY COUNCIL. WHEREAS, the Panning Commission of the City of Edmonds Washington, has conducted a public hearing for the purpose of making recommendation concerning amendments to the Official Zoning Ordinance of the City of Edmonds, and has by Resolution No. 131 recommended that the City Council of the City of Edmonds amend the Official Zoning Ordinance as set forth here- inafter, and WHEREAS, the City Council of the City of Edmonds have called a public hearing pursuant to said Resolution, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS DO ORDAIN AS FOLLOWS: Section 1. The Edmonds City Code, Section 12.16.170 is hereby amended to read as follows: "Section 12.16.170 Amendments. A. Proposed amendments, supplementations, or modifi- cations of the text of this Ordinance, or the Official Zoning Map made a part hereof, shall first be heard by the Planning Commission and the decision shall be made and reported by resolution by the Planning Com- mission within 90 days of the time that the proposed amendments, supplementations, or modifications were made. Proposed amendments, supplementations, or modifications may be initiated as follows: 1. By motion of the City Council or the Planning Commission. 2. By any interested party by making application to the Planning Commission on forms prescribed by said Commission, accompanied by the appropriate filing fee prescribed in Chapter 12.01 of the Edmunds City Code. C. Upon the initiation of the proposed amendment, supplementation or modification the Planning Commission shall give proper notice and hold a public ,searing at the time and date set forth in the notice. Proper notice of a hearing before the Planning Commission shall be: 1. Onepublication in the official newspaper of the City of Edmonds at least 10 days prior to the date of the hearing. 2. Posting of copies of the Notice of Hearing at least 10 days prior to the date of the hearing in (1) the Civic Center of the City of Edmonds, (2) the United States Post Office in the City of Edmonds, and, in the event the proposed amendment, supplementation, or modification involves a change in of the Official Zoning Map, (3) posting notices thereof along every road or street abutting the land as proposed to be changed. D. No person, persons, organization or organizations, other than the Planning Commission or City Council, shall be permitted to again apply for an amendment, supplementation or modification of the Official Zoning Map within 180 days following the public hearing of an application by the same person or organization to rezone the same property, or portion thereof. E. The City Council, pursuant to public hearing called by them upon written application therefor by any interested party or upon their own order, may affirm, modify or disaffirm any decision of the Planning Commission. Such written application to the City Council by any party, other than the Planning Commission, must be made within 30 Jays of the public hearing before the Planning Commission. F. The determination of the City Council shall be final unless an action is commenced in the Superior Court of Snohomish County within 30 days of the public hearing before the City Cuuncil." Section 2.
