AN ORDINANCE ADDING A NEW CHAPTER TO T:IE EDMONDS
CITY CODE, CHAPTER 5.52, RELATING TO AND REGULATING
THE OPERATION OF WATER CRAFT UPON WATERS WITHIN
THE CITY OF EDMONDS AS EXTENDED BY RCW 35.21.1601
• PROVIDING FOR CONPROL THEREOF, DEFINING OFFENSES
AND PROVIDING PENALTIES.
THE. CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON
DO ORDAIN AS FOLLOWS:
Section 1. There shall be added to the Edmonds City
Code a new chapter entitled chapter 5.52, Boating Code, and
which shall read as follows:
"5.52.010 The City of Edmonds in the exercise of its
police power, hereby assumes control and jurisdictisa
over all waters within its limits as extended by Laws
1965 Ch. 7, RCW 35.21.160."
"5.52.020 Definitions:
"'Water craft' means any contrivance used or capable
of being used as a means of transportation on water."
"5.52.030 Application and Justification: The provi-
sions of this chapter shall be applicable to all water
craft, and shall be construed to supplement United States
Laws and State Laws and Regulations when not expressly
inconsistent therewith.
"5.52.040 Negligent Operation: 1,: shall be unlawful
for any person to negligently operate any water craft,
meaning in a manner so as to endanger or be likely to
endanger any person or property or at a rate of speed
greater than will permit him in the exercise of reason-
able care, to bring the water craft to a stop within
the assured clear distance ahead.
• "5.52.050 Reckless Operation: It shall be unlawful
for any person to operate any water craft in a reck-
less manner, meaning in a manner as to indicate either
a wilful or wanton disregard fo,-• the safety of persons
or property.
"5.52.060 Intoxication:
(a) It shall be unlawful to any person who is under
the influence of intoxicating liquor or of narcotic
or habit forming drugs to operate or be in actual
"physical control of any water craft.
(b) It shall be unlawful for the owner of any water
craft or any person having such in charge or in control
to authorize'or knowingly permit the same to be oper-
ated by any person who is under she influence of in-
toxicating liquor or of narcotic or habit forming drugs."
"5.52.070 Accidents: The operator of any water craft
involved in an accident resulting in injury or death
to any person or in damage to property shall immediately
stop such water craft at the scene of such accident and
shall give his name, addr^ss, and name and/or number of
his water craft, and the name and address of the owner,
to the persons struck or the operator or occupants of
the vessel and water craft collided with or property
damaged, and shall render to any person injured in such
an accident reasonable assistance."
"5.52.090 Penalty: violation of any of the provi-
sions of this chapter shall be a misdemeanor and shall
be punished by a fine of not more than Five Hundred
Dollars ($500.00) or by imprisonment for not more than
ninety (90) days or by both such fine and imprisonment."
_.52.100 Effect of Partial Invalidity: If any part
or parts of this chapter are for any reason held to be
invalid, such decision shall not affect the validity
of the remaining portions of this chapter.
