AN`_`ORDINANCE PROVIDING FOR THE LICENSING OF DOGS
AND THE CONTROL OF ANIMALS AT LARGE$, THE RESTRAINT
OF VICIOUS DOGS,*' IMPOUNDING AND REGULATING THE
MANNER OF KEEPING THEREOFS DEFINING OFFENSES*' PRE-
SCRIBING PENALTIES AND AMENDING CERTAIN SECTIONS OF
CHAPTER 4.08 AND CHAPTER 5.04 OF THE EDMONDS CITY CODE.
THE CITY COUNCIL OF THE CITY OF EDMONDS*' WASHINGTONs
DO ORDAIN AS FOLLOWS:
Section 1. Section 4.08.020 of the Edmonds City Code
is amended to read as follows:
"It shall be the duty of the Police Department to issue
licenses to persons applying therefor, upon payment of
the license fee as herein provided. Upon the issuance
of a license, a metal tag, with number corresponding
to the number of the application, shall be furnished
the applicant, who shall cause the same to be attached
or fixed to the dog. Dog tags shall not be transfer-
able from one dog to another."
Section 2. Section 4.08.030 of the Edmonds City Code
is hereby amended to read as follows:
'The following fees shall be paid for licenses hereunder:
All dogs, males and spayed and unspayed females, $2.00
Replacement of metal tags, $ .50"
Section 3. Section 4.08.100 of the Edmonds City Code
is hereby amended to read as follows:
"A. It shall be unlawful for any person, firm or cor-
poration which owns* possesses, harbors, has control
or charge of any dog which is known, or which in the
exercise of reasonable care, should be known to be
:vicious, to allow the same to run at large OR to fail
to restrain such a dog in such a manner that the said
dog is unable to reach those persons, in or on a public
place, or those persons utilizing the normal ingress
and egress to and from the premises or those persons
lawfully in or on the premises where such a dog is main-
tained, or to fail to post signs in two conspicuous
places upon the premises warning those persons who may
come upon the said premises of the existence of said
vicious dog.
"B. Any person, firm or corporation which owns,
possesses, harbors, has control or charge of any dog
which is knowp,or which in the exercise of reasonable
care, should be known to be vicious, who fails to com-
ply with the provisions of this section, upon convic-
tion thereof, shall be guilty of a misdemeanor and shall
be punishable by a fine in a sum not exceeding $500 or
by imprisonment in the City Jail not exceeding a period
of ninety (90) days, or by both such fine and imprison-
ment.
"C. Any such dog which is known, or which in the
exercise of reasonable care, should be known to be
vicious, which is permitted to run at large or is not
restrained in the manner provided for in this section
or if adequate postings of notice of the presence of
such dog has not been so posted, is hereby declared to
be a public nuisance and may be impounded by the City
or its appointee and destroyed after a seventy-two (72)
hour period after being impounded if the person, firm,
or corporation which owns, possesses, harbors, has control
or charge of such a dog does not abate the nuisance within
three (3) days after receipt of written demand to abate
the nuisance by the City or its appointee.
"D. The penalties and procedures provided by this sec-
tion are in addition to those penalties and procedures
provided elsewhere in this Chapter and are in no way to
be construed as limiting the authority of the City or its
appointee to act under the other sections of this Chapter."
Section 4. Section 4.08.150 of the Edmonds City Code is
hereby amended to read as follows:
"Any violation of this chapter shall be deemed a misde-
meanor and shall be punishable by a fine not to exceed
Five Hundred Dollars ($500.00), or imprisonment not to
exceed ninety (90) days in the City Jail, or by both
such fine and imprisonment. "
Section 5. Section 5.04.040 of the Edmonds City Code
is hereby amended to read as follows:
"At the expiration of three (3) days after the::posti1g of
the notice as provided in Section 5.04.030, the Chief
of Police shall sell such animal at public auction,
after due notice of such proposed sale, to consist of
one publication in the official newspaper of the City
of Edmonds, PROVIDED z; however, that the publication of
notice shall not be required for the sale of dogs and
cats, and after deducting the legal fees and costs,
expenses of picking up, keeping and selling, the Chief
of Police shall pay the remainder of the proceeds into
the City Treasury."

Section 6. Section 5.04.070 of the Edmonds City Code
is hereby amended to read as follows:
"If any personsshall wilfully prevent or hinder the
impounding of any animal found running at large in the
said territory. contrary to the provisions of this
chapter, or shall by force or otherwise remove any
animal from the public pound without authority of the
Chief of Police or officer in charge of such pound,
or without paying all lawful charges against said
animals or shall wilfully resist or obstruct the Chief
of Police or other officer*, or person in charge of the
pound in the performance of any official duty., such
person so offending shall be guilty of a misdemeanor.;
and shall be punished by a fine of not more than $500,
or by imprisonment not exceeding ;(90) ninety days. or
by both such fine and imprisonment."
Section 7. Section 5.04.090 of the Edmonds City Code
is hereby amended to read as follows:
"Any owner or person having in charge any animal
described in Section 5.04.010 of this chapter a, who
shall suffer or allow the same to go at large contrary
to the provisions of this chapters, shall be guilty of
a misdemeanor and shall be punished by a fine of not
more than $5001 or by imprisonment not exceeding ninety
,(90) days., or by both such fine and imprisonment."
Section 8. Section 5.04.100 of the Edmonds City Code
is hereby amended to read as follows:
"Fees authorized. The Chief of Police shall be entitled
