AN ORDINANCE OF THE CITY OF EDMONDSg AMENDING THE
BUILDING CODE FOR SAID CITY BY THE ADOPTION OF THE
1967 EDITION OF THE UNIFORM BUILDING CODES VOLUME I
(SPECIFICALLY INCLUDING THE APPENDICEES)z VOLUME III
(SPECIFICALLY INCLUDING THE APPENDICEES)m AND THE
STANDARDS VOLUME. BY AMENDING CHAPTER 11.02 OF THE
EDMONDS CITY CODE. PROHIBITING BUILDING PERMITS IN
CERTAIN ZONES DUE TO INADEQUATE UTILITIES® DRAINAGE
AND STREET IMPROVEMENTS; REGULATING MAXIMUM BUILDING
HEIGHT; PROVIDING FOR PERMIT FEES; AND PROVIDING
PENALTIES,
THE CITY COUNCIL OF THE CITY OF EDMONDS.® WASHINGTONO
DO ORDAIN AS FOLLOWS:
Section to The Edmonds City Code, Section 11.02.010,
is hereby amended to read as follows:
"11.02.0? 0 Uniform Building Code adopted by
reference. That certain printed coder three copies
of which are and have been on file in the office of the
City Clerk of the City of Edmonds, for use and exam-
ination of the public, being marked, printed and
designated as the Uniform Building Code, 1967 Edition,
Volumes I (specifically including Appendices) and ]III,
Housing (specifically including Appendices), and that
Volume entitled "Standards," all copyrighted 1967
by the International Conference of Building Officials,
is hereby adopted by reference and incorporated here-
with as if fully set forth within this chapter, as
the Building Code of the City of Edmonds, subject to
the modifications and amendments hereinafter set
forth, and the said code as adopted shall regulate
the erection, construction, enlargement, alteration,
repair, moving, removal, conversion, demolition,. oc-
cupancy, equipment, use, height, area and maintenance
of buildings or structures in the City of Edmonds;
and further provides for the issuance of permits and
collection of fees therefor; providing penalties for
the violation of such code; and each and all of the
regulations, provisions, penalties, conditions and
terms of such Uniform Building Code herein mentioned
and as amended and on file in the office of the City
Clerk is hereby established, pursuant to the laws of
the State of Washington as set forth under RCW 35.21.

Section 2. The Edmonds City Code, Section 11.02.030,,.
is hereby amended to read as follows:
"Section 11.02.030 Building Permit Fees - Section
303 (a} of Uniform Building Code. Section 303 (a) of
the Uniform Building Code as hereinabove adopted, be
and the same hereby is set forth as amended:
"Sec. 303. (a) Building Permit Fees. A fee for
each building permit shall be paid to the Building
Official as set forth in Table No. 3-A.
"The determination of value or valuation under any
of the provisions of this Code shall be made by the
Building Official.
"Where work for which a permit is required by this
Code is started or proceeded with prior to obtaining
said permit, the fees above specified shall be doubled,
but the payment of such double fee shall not relieve
any persons from fully complying with the requirements
of this Code in the execution of the work nor from any
other penalties prescribed herein.

"Provided, however, any building built or erected
by the City of Edmont shall be exempt from any of the
fees herein set forth."
Section 3. The Edmonds City Coder Section 11.02.035,
is hereby amended to read as follows:
"11.02.035 Height of Buildings -- Section 507 of
Uniform Building Code. Section 507 of the Uniform
Building Code as adopted by reference under Section
11.02.010 of this chapter is hereby amended and set
forth as follows:

"The maximum height of every building shall
not exceed a height of three stoxiEs or in any
case 35 feet in height."
Section 4. There is hereby added two new sub -sections
to Section 11.02.025 of the Edmonds City Code reading as
follows:
" f Utilities and Street Improvements. No build-
ing permit shall be issued for the construction of
any building or structure of any kind or description
unless the plans and specifications include the con-
struction for curbs, gutters, sidewalks, paved streets,
necessary water lines, sewer lines, and storm drainage
necessitated by the new construction or improvement,
to be built to applicable city standards, provided,
however, if found by the City Engineer to be impracti
cal to construct at the time of application for said
building permit, construction may be waived by the City
Engineer and in lieu thereof a performance bond filed
with said engineer to cover the estimated cost of con-
struction to City standards for said improvements,
provided further, in areas zoned single family residen-
tial at the time of said application for building permit
in which the applicant has received final approval for a
plat or sub -division and has complied with requirements
therein compliance with this subsection shall be deemed
by compliance with the sub -division or plat requirements.
"(g) Building, grading and excavation permits for
construction on Land which the City Engineer -finds to be
unsuitable for improvement due to flooding, inadequate
drainage, excessively steep slopes, unsatisfactory
foundation support, stability or topography for the
plan submitted, shall be denied. In making this deter-
mination the City Engineer shall consider not only the
land which is the subject of the application but in
addition the surrounding areas which would be adversely
affected if such permit were granted."
Section 5. The Edmonds City Coder Section 11.02.070,
is hereby amended to read as follows:
"11.02.07 Penalty for Violations. It shall be un-
lawful for any person, firm or corporation to erect,
construct, enlarge, alter, repair, move, improve,
remove, convert or demolish, equip, usep occupy or
maintain any building or structure in the City of
Edmonds, or cause the same to be done, contrary to
or in violation of any of the provisions of this Chapter.

"Any personz firm or corporation violating any of
the provisions of the Uniform Building Code as adopt—
ed herein, or other provision of this chapter, shall
be guilty of a misdemeanor, and each such person shall
be deemed guilty of a separate offense for each and
every day or portion thereof during which any viola-
tion of any of the provisions of this chapter or the
Uniform Building Code adopted herein is committed,
continued or permitted, and upon the conviction of
such violation, and each violation thereof, such
person, firm or corporation, and the officers; direc—
tors and managers thereof, shall be punishable by a
fine of not more than $500, or by imprisonment for
not more than 90 days, or by both xuch fine and im—
prisonment."
