AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
ADDING A NEW SECTION 11.02.021 TO THE EDMONDS
CITY CODE PROVIDING FOR AN APPEAL PERIOD FROM
DECISIONS OF THE BOARD OF APPEALS TO SUPERIOR
COURT; AND ADDING A NEW SECTION 10.04.095 TO THE
EDMONDS CITY CODE PROVIDING THAT THE BOARD OF
APPEALS CREATED UNDER THE UNIFORM FIRE CODE SHALL
BE THE SAME BOARD OF APPEALS AS CREATED UNDER THE
UNIFORM BUILDING CODE.
WHEREAS, the State Uniform Building Code presently does
not specify a period within which appeals may be taken from
the decisions of the Board of Appeals, and
WHEREAS, the City Council finds that ten (10) days is
a reasonable period within which such appeals should be per-
fected and said appeal period corresponds with the time to
perfect appeals from decisions of the Board of Adjustment
which performs a function similar to the Board of Appeals,
and
WHEREAS, the Uniform Fire Code provides in Section 1.215
of said Code for the creation of a Board of Appeals to
provide for, among other things, reasonable interpretation
of the provisions of said fire code and
WHEREAS, it is in the interests of proper administration
of the codes that the Board of Appeals created by the Uniform
Fire Code and by the Uniform Building Code be one and the same
body, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. A new section 11.02.021 is hereby added
to the Edmonds City Code to read as follows:
"11.02.021 Appea�s.
All appeals from any decision from the Board of Appeals
shall be by petition for a Writ of Certiorari or Writ
of Review to the Snohomish County Superior Court within
ten (10) days from the date of the Board of Appeals
decision. The official minutes of the meeting as
approved by the Board of Appeals shall constitute the
official record for all purposes on appeal. The
appellant shall bear all costs of preparation of the
record on appeal."
Section 2. A new section 10.04.095 is hereby added
to the Edmonds City Code to read as follows:
"10.04.095 Uniform Fire Code Board of Appeals
shall be cLoverned by the provisions of Chapter
11.02.
The Board of Appeals created pursuant to the
current edition of the Uniform Fire Code adopted
in this chapter and as referred to in this title
shall be construed to be the Board of Appeals as
created under Chapter 11.02 of the Edmonds City
Code."
