AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 12.20.070 OF THE EDMONDS CITY
CODE AND ESTABLISHING PROCEDURES FOR APPEALING
DECISIONS OF THE CITY AMENITIES DESIGN BOARD
PURSUANT TO PLANNING COMMISSION RESOLUTION
NO. 582
WHEREAS, pursuant to Planning Commission Resolution
No. 582, the City Council of the City of Edmonds, Washington,
called a public hearing and during this hearing having
determined it to be in the best interests of the public
health, safety and general welfare to amend the Edmonds
Zoning Ordinance as set forth below and having determined
that there will be no significant adverse environmental
impacts, all in accordance with Planning Commission Resolution
No. 582, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 12.20.070 of the Edmonds City Code is
hereby amended to read as follows:
"12.20.070 Appeals.
1. Any person feeling aggreived by an action
of the City Amenities Design Board may appeal to
the City Council by filing, within ten (10) days
of the final action of the Board, a written Notice
of Appeal with the City Clerk setting forth the
reasons for the appeal. The filing of the written
Notice of Appeal shall suspend the issuance of any
building or other required city permit until the
City Council has taken final action on the appeal.
The City Council shall set a date for public
hearing and shall take final action within thirty
(30) days of the filing of the Notice of Appeal.
2. On appeal, the City Council may consider
the written minutes of the City Amenities Design
Board meeting and any of its recommendations or
findings. The Council may also take additional
evidence from the applicant or any member of the
public. In reaching its decision, the City Council
shall follow the criteria as set forth in Section
12.20.050 of the Edmonds City Code and shall set
forth the reasons for its decision in the motion
or council discussion.
3. The City Council may affirm, modify or
reverse the decision of the City Amenities Design
Board or may remand the matter to the Board for
further proceedings. In the case of a remand, the
Board shall reach a final decision of the matter
within thirty (30) days following the action of
the City Council.
4. Appeal of any decision by the City Council
shall be made within ten (10) days of the date of
such decision by commencing an action in Snohomish
County Superior Court for a Writ of Certiorari or
review.
