AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
REPEALING SECTIONS 5.70.010(3) AND 5.70.050 OF THE
EDMONDS CITY CODE, ABOLISHING THE FAIR HOUSING
COMMISSION AND ADDING A NEW SECTION 5.70.050 TO
AUTHORIZE THE CITY COUNCIL TO INVESTIGATE ALLEGED
VIOLATIONS OF CHAPTER 5.70 OF THE EDMONDS CITY CODE
(FAIR HOUSING) AND PROVIDING PROCEDURES THEREFOR.
WHEREAS, since its inception in 1968, the Edmonds Fair
Housing Commission has not received a complaint regarding an
alleged violation of Chapter 5.70 of the Edmonds City Code,
and,
WHEREAS, the City Council can adequately assume the re-
sponsibilities formally exercised by the Fair Housing Commis-
sion, and,
WHEREAS, the City Council finds that this ordinance
will assure citizens of a means of investigating alleged
violations of the City's Fair Housing ordinance, and is in
the best interest of the public health, safety, morals and
general welfare, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 5.70.010(3) of the Edmonds City
Code is hereby repealed and the word "Reserved" substituted
in its place.
Section 2. Section 5.70.050 of the Edmonds City Code
is hereby repealed and a new section 5.70.050 substituted to
read as follows:
"5.70.050 Investigation of Unfair Housing Practices.
1. Complaints Filed. Complaints alleging a vio-
lation of this chapter shall be filed with the de-
partment of community development on forms provided
therefor. The complaint shall set forth the person
allegedly violating the provisions of this chapter and
the specific acts which are alleged to be an unfair
housing practice. The complaint shall be signed under
oath by the complainant. The department of community
development shall promptly furnish a copy of the com-
plaint to the person complained against.
2. Staff Investigation. The City staff shall
conduct such investigation and inquiry it considers
proper to determine whether or not probable cause
exists to believe that an unfair housing practice
has occurred and to dismiss those charges for which
no probable cause is found. In those cases where pro-
bable cause is found to exist, the director of commun-
ity development may request the city council to con-
duct a hearing on the alleged violation, or attempt to
remedy the violation by means of conciliation, persua-
sion and agreement of the parties involved.
3. City Council Hearing. The city council may
conduct a hearing to determine whether an unfair hous-
ing practice has been committed. If an unfair housing
practice is found to have been committed, the city
council may recommend criminal prosecution of the per-
son complained against to the city attorneys office or
take such other action it deems appropriate to correct
the violation.
4. Subpoena Power. In conducting its hearings
and investigations, the city council shall have the
power to issue subpoenas or subpoenas duces tecum
in the name of the city which subpoenas shall be
issued through the Edmonds Municipal Court."
Section 3. This ordinance shall be in full force and
effect five (5) days after passage and publication by the
posting as provided by law.
