AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING SECTIONS 12.13.220
THROUGH 12. 13. 250 OF THE EDMONDS CITY CODE
TO MODIFY THE WATERFRONT COMMERCIAL (CW)
DISTRICT IN RESPECT TO ITS INTENT, PERMITTED
USES, LIMITATIONS ON USES, AND BULK AND DIM-
ENSIONAL REGULATIONS IN SAID CW DISTRICT
PURSUANT TO PLANNING COMMISSION RESOLUTION
NO. 600.
WHEREAS, the City Council of the City of Edmonds, Wash-
ington, having called a series of public hearings pursuant to Plan-
ning Commission Resolution No. 600, and having heard substantial
comment .from the community at large, including the Shorelines
Advisory Committee, and having determined it to be in the best
interests of the public health, safety and general welfare to amend
the Edmonds City Code as set forth below in modification of said
Planning Commission Resolution No. 600, and having determined
that there will be no significant adverse environmental impacts,
now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASH-
INGTON, DO ORDAIN AS FOLLOWS:
Section 1. Section 12.13.220 of the Edmonds City Code is
hereby amended to read as follows:
12. 13. 220 Intent in CW, waterfront commercial district.
To preserve and enhance the natural features of the water-
front .for the use and enjoyment of the public. The CW
zone provides a location for water dependent uses and for
those which encourage full use of the waterfront by the
public. All activity and development will be evaluated
according to the physical and visual access to the water-
front that is provided to the public. Uses which are prim-
arily auto oriented are discouraged in the CW zone because
of their conflict with pedestrian use. To promote coordin-
ated development and high quality design, development in
the CW zone shall meet the design criteria in Section 208
of the Policy Plan.
Section 2. Section 12. 13. 230 of the Edmonds City Code is
hereby amended to read as follows:
12. 13. 230 Permitted uses in CW district. Permitted
uses are those which encourage pedestrian use of the water-
front and which are water oriented. The following uses are
permitted in the CW zone:
(a) Retail enterprises dispensing commodities,
and marine oriented services, excluding enterprises dis-
pensing commodities to occupants of automobiles;
(b) Storage (either land or water moorage), re-
pair, sale and limited building of boats;
(c) Yacht or boat clubs .featuring pleasure boat-
ing, fishing or waterfront activities;
(d) Governmental, educational and recreational
uses, including aquarium;
(e) Water dependent petroleum products storage
and distribution; and
(f) Offices.
Section 3. Section 12. 13.240 of the Edmonds City Code is
hereby amended to read as follows:

12. 13. 240 Limitations on uses in CW district. The
permitted uses in the CW zone shall be subject to the
following conditions and limitations:
(a) All uses shall conform to the general pro-
visions of this code including, but not limited to, Parking
and Performance Standards in Chapter 12. 14, and Signage
in Chapter 20. 10, provided further:
(1) No parking is permitted within 60
feet of bulkheads.
(b) All uses shall be conducted wholly within an
entirely enclosed building except:
(1) Storage and distribution of petroleum
products;
(2) Sales, storage, repair and limited
building of boats; and
(3) Places of public assembly.
Section 4. Section 12.13.250 of the Edmonds City Code is
hereby amended to read as follows:
12. 13.250 Bulk and dimensional regulations in CW
district.
(a) MINIMUM LOT AREA: None specified
(b) LOT WIDTH: None specified
(c) MINIMUM SETBACK REQUIREMENTS: 15
feet minimum on the landward side of existing bulkhead
(d) MAXIMUM BUILDING HEIGHT: 35 feet
Section 5. This ordinance shall be in full force and effect

by law.
