Ordinance 2043ORDINANCE NO. 2043 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTIONS 12.13.010, 12.13.130(a) AND (g) OF THE EDMONDS CITY CODE TO ESTABLISH A NEW ZONING CLASSIFICATION DESIGNATED AS MULTIPLE -FAMILY DOWNTOWN (RMD); SETTING FORTH THE BULK AND DIMEN- SIONAL REQUIREMENTS THEREFOR; MODIFYING THE MAXI- MUM LOT COVERAGE AND MAXIMUM BUILDING HEIGHT ALLOWED IN THE RML AND RMH ZONING CLASSIFICATIONS; AND AMENDING SECTION 12.13.190(a) OF THE EDMONDS CITY CODE TO PROHIBIT MULTIPLE -FAMILY RESIDENTIAL USES IN THE COMMUNITY BUSINESS ZONE. WHEREAS, following public meetings and hearings the Edmonds Planning Commission has reviewed the following amendments to the Edmonds Zoning Code and has forwarded its recommendations to the City Council in Resolution No. 606 and 607, and WHEREAS, the City Council, following public hearings and meetings, has determined that the establishment of a new multiple -family residential classification is necessary in order to preserve the unique character and appearance of the downtown area of Edmonds, pursuant to Planning Commission Resolution No. 606, and WHEREAS, the City Council having determined that allowing multiple -family residential structures and uses to be built in the community business zone would also tend to destroy the unique character of the City of Edmonds and that Planning Commission Resolution No. 607 should be modified, and -1- WHEREAS, the City Council having found that there will be no significant adverse environmental impacts, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 12.13.010 of the Edmonds City Code is hereby amended to read as follows: 12.13.010 Classifications designated. The city of Edmonds is divided into the following classes of zones (districts) in accordance with the comprehensive plan: RS -20 20,000 Single -Family Residence, Low Density Zone RS -12 12,000 Single -Family Residence, Low Density Zone RSW-12 12,000 Single -Family Residence, Low CG General Commercial Zone OS Open Space Zone -2- Density Waterfront Zone RS -8 8,000 Single -Family Residence, Medium Density Zone RS -6 6,000 Single -Family Residence, High Density Zone RD Two -Family (Duplex) Zone RMD Multiple -Family, Downtown Zone RML Multiple -Family, Low Density Zone RMH Multiple -Family, High Density Zone BN Neighborh000d Business Zone BC Community Business Zone CW Waterfront Commercial Zone CG General Commercial Zone OS Open Space Zone -2- IP Industrial Park Zone RMP Residential Mobile Home Park Zone MR Marine Resource Zone Section 2. Section 12.13.100 of the Edmonds City Code is hereby amended to read as follows: 12.13.100 Intent in RM, multiple residence districts. The principal objective and purpose to be served by the RM classification and its application is to establish areas permitting a greater population density than is allowed in more restrictive classifications, while at the same time, maintaining a residential environment consistent with such greater population density. By establishing three RM districts it is intended to allow a choice of density to potential residents, a more intensive use of certain smaller parcels, and to preserve the appearance and atmosphere of the downtown area of Edmonds. It is also the purpose of this classification to make it possible to more efficiently and economically design and install all physical public service facilities in terms of size and capacity to adequately and permanently meet needs resulting from a defined intensity of land use. Because of the unique character and scale of buildings in the downtown area of Edmonds, it is intended that the RMD zoning classification will be limited to an area east of Puget Sound, south of Caspers Street, west of 7th Avenue and north of Pine Street and which was previously zoned RMH or RML. Section 3. Section 12.13.130(a) of the Edmonds City Code is hereby amended to read as follows: 12.13.130 Development and dimensional regulations in RM districts. (a) Classifications Established. In recognition of the demand for both centrally -located and automobile -oriented multiple -family residences, and in recognition of the unique character and scale of the downtown area of Edmonds, three RM classifications are established, each with differing bulk and dimensional regulations in accordance with the densities to be achieved and the effect each will have on the appearance, bulk and scale of the buildings constructed. Section 4. Section 12.13.130(g) of the Edmonds City Code is hereby amended to read as follows: -3- "(g) Table of Bulk & Dimensional Requirements. RMD Zone RML Zone 1. Density 2900 sq.ft. 2600 sq.ft. Section 12.13.190(a) of the Edmonds City Code is hereby amended to read as follows: "12.13.190 Permitted uses in BC districts. In a BC zone the following types of uses are permitted as hereinafter provided and allowed by this section, subject to the general provisions and exceptions set forth in this title: (a) Any use permitted in an RS or BN zone as regulated therein; provided, however, as to buildings where there is a combination of residential and commercial uses, the building shall comply with the bulk and dimensional requirements of the BC zone. Section 6. This ordinance shall be in full force and effect five (5) days after passage and publication by posting as provided by law. Section 7. If any section, subsection, clause, phrase or word of this Ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, it being hereby expressly declared that this Ordinance, and each section, subsection, clause, phrase, and word hereof would have been prepared, proposed, adopted, approved and ratified irrespective of the fact that any one or more of said sections, subsections, M --M sentences, clauses, phrases or word or words thereof be declared invalid or unconstitutional.
