AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 8.05.040 OF THE EDMONDS CITY CODE TO
REPEAT, THE ADOPTION BY REFERENCE OF THE SEAT BELT p
STATUTE AND ADOPT THE STATE STATUTES GOVERNING
SUSPENDED LICENSES AND UNLAWFUL ACTS Bx VEHICLE
DEALERS; AND AMENDING SECTION 5.50.020(C) TO ADD THE
OFFENSES ADOPTED BY REFERENCE TO THE PENALTY PROVISION;
CONTAINING A SEVERABILITY CLAUSE AND SETTING AN
EFFECTIVE DATE.
WHEREAS, the Edmonds City Council finds that state statutes
governing driving with a suspended license in violation of
financial responsibility laws and tl-e unauthorLzed use of dealer
plates are offenses which occur within the City limits of Edmonds
and therefore should be adopted by reference, and
WHEREAS, the Edmonds City Council finds that the adoption by
reference in Section 8.05.040 of the state statute governing seat
belt use should be repealed because the state legislature has
included this statute is the model Traffic Code under RCW
46.90.463 and the City has previously adopted this provision
under Edmonds City Code Section 8.05.010, and
WHEREAS, the Edmonds City Council finds that this ordinance
is in the interest of the public health, safety and delfare, now,
therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. Section 8.05.040 of the Edmonds City Code is
hereby amended to read as follows:
8.05.040 State Traffic Statutes Adopted by
Reference. The following state traffic statutes

are adopted as part of this code as if set forth
in full:
A. RCW 46.70.140, Handling "hot" vehicles --
unreported motor "switches" -- unauthorized use ^f
aealer plates -- penalty.
B. RCW 46.29.625, Driving when license suspended
or revoked until proof of ability to respond in
damages is furnished.
Section 2. Subsection (c) of Section 5.50.020 of
Edmonds City Code is hereby amended to read as follows:
5.50.020(c)
Any person violating any of the following
provisions of Title 8 shall be guilty of a crime,
and upon conviction thereof, he punished r)y fine
not to exceed $500 if the offense is a misdeme.

Any person violating any provision of Title 8,
other tha^ as set forth in this section, shall
have committed a traffic infraction and shall be
assessed a monetary penalty not to exceed $250.
Section 3. if any section, sentence, clause or phrase of
this ordinance should be held to je invalid or unconstitutional
by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitu-
tionality of any other section, sentence, clause or phrase of
tt.,_s ordinance.
Section 4. This ordinance, being an exercise of a power
specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
passage and publication of the attached summary which is hereby
appr3ved.
