ORDINANCE NO. 2935
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF CHAPTER
20.50 RELATING TO SETBACK REDUCTIONS TO
ESTABLISH A NEW SECTION 20.50. 100 ESTABLISHING
A SUNSET CLAUSE FOR PREVIOUSLY APPROVED
SETBACK ADJUSTMENTS AND FIXING A TIME WHEN THE
SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City Council has amended the provisions of
Chapter 20.50 relating to setback adjustments in order to limit the
life of such approvals, and
WHEREAS, previously approved setback adjustments have
been interpreted by the staff to have a two year life due to their
similarity to other approvals of the City such as variance which
have a specific period of limitation, and
WHEREAS, the City Council deems it to be in the public
interest to clarify that all prior approved setback adjustments
unless otherwise limited shall expire on June 1, 1995, said date
being approximately two years after the date of passage of this
ordinance, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Chapter 20.50 Setback Adjustments is hereby
amended by the addition of a new Section 20.50.100 Sunset Clause to
provide as follows:
20.50.100 Sunset Clause. Any setback
adjustment approved without the establishment
of an expiration date, whether by amendment to

this chapter or on the face of the approval,
shall expire on June 1, 1995. Rights under a
prior approved setback adjustment may be
vested only by the filing of a fully complete
building permit application prior to that
date.
Section 2. In addition to the notice normally provided
for an amendment of the provisions of the Edmonds Community
Development Code, the Planning Manager is requested to provide
notice of the passage of this ordinance and the expiration of prior
approved setback adjustments to all persons shown in the files of
the Planning Division as having received such a prior approval.
This notice shall be a courtesy notice and nothing herein shall be
deemed to limit the affect of the sunset clause previously adopted.
Section 3. Severability. If any section, sentence,
clause or phrase of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
Section 4. Effective Date. This ordinance, being an
exercise of a power specifically delegated to the City legislative
body, is not subject to referendum, and shall take effect five (5)
days after passage and publication of an approved summary thereof
consisting of the title.
